PC R 88-1186' 3�+9 RFSOLUTION NO. 88-1186 A RESOLUTION OF Tf� PLANNING CO1tiMLSSION OF THE C1TY OF AR.ROYO GR.ANDE GRANTING A VAR.IANCE, CASE NO. 88-131, APPLIED FOR BY BUSS AND SANDR.A SANKOFF AT 629 CERRO VISTA G`IItCI,E , W�RF.AS� the PlAnning Conn�dssion of the City of Arroyo Grande has considered Variance Application No, 88-131, filed by Russ and Sandra Sankoff, for a Variance from the maximum building height of 15 feet at 629 Cerro Vista Circle in the "P�-1° Single Family Residential District; and WHEREAS, the Planning Conyrussion has helci a public hearir►g on this application in accordance ��th the City Code; and �YHEREAS, the Planning Conimissicn finds that the following circturstances exist: 1. That the adjustrr�ent authorized shall not constitute a grant of special privilege ineonsistent with the lirrntations upon other properties in the vieir�ity �nd district in which the subject property is situated; 2. That because of special circ�tances applicable to the subject property, including size, shape, topo�raphy, location, or surroundings, the strict application of the provisions of this chapter is found to deprive the suCject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications; 3. That the grt�nting of the Varianee will not be contrary to the intent of tYus chapter ar to the public safety, heAlth And welfare; 4. That due to special conditions or exceptional characteristics of the property or its location, the strict npplication of the provisions of this chapter �vould result in difficulties and unnecessary hardship; 5. The grAnting of the Variance will not be materially detrimental to other properties or lAnd uses in the Area because the views currently enjoyed by the surroundir�g properties will not be si�ni�cantly im�eted by the proposed development; 6. There are exceptional or extraordinary circturrtances applicable to the intended use that do not apply to other properties in the sam,e zone. The property hr�s no ' apparent or significant viecvsh�ds, nor does it appear to affect surrounding viewsheds. 7. The strict application of the ordinance deprives such property of privileges enjoyed by other �roperties in the vicinity or in the srut:e zone becA�.se the 15- foot restriction would lim�it the buildable potential of the lot, �nd other parcels in the area have been developed with two-story hanes; and. 8. The granting of the Variance i� compatible v�ith the objectives, policies, and general lnnd uses specified in the Ceneral Plan because the intent of the urgeney ordinfince is being met, as there is stibstantial protection of the viewsheds on adjacent property, And the proposed developrr�ent is in cbnform�ance with the goals, policies and objectives of the General Plan. I�TOW, THER,EFORE, BE IT RESOL`VID that the PlFU�ning Comlussion of the City of Arroyo Grunde hereby approves said Varianee subject to tl�e standard conditions of the City and those listed below: 1. The cievelop�r�ent of the site shFill occur in substantial conformance with the pl�ns approved by the Planning Comr�ission on Jw�e 21, 1988. 4n motion by Corrvnissioner Gerrish, seconded by Comrnissioner nlsen, and by the following roll call vote, to wit: AYFS: C',oi�rdssicners Flores, 1�^oore, Olsen, Scott, Gerrish and Chairman Soto NOFS: None AIiSENT: Canvnissioner Bog�gess the foregoing Resclution was adopted this 21st day of June, 1988.
