(E. DORFMAN) WHERF.AS, the Plaru�ing Carrmission of the �Ty of Arroyo Grande has considered Variance Application No. 88-128, filed by Oakcrest Fstates, for a Variance ft�cm the ma�mn�.¢n building height of 15 feet at Lot 65, La Cresta Drive in the "R-1" Single Family Residential District; and WHEItI..AS, the P7anning Carrmission has held a public hearing on this application in Accordanc�e with the Ctty Code; nnd WHEREAS, the Planning Crnmission ffnds that the following circurstances exist: 1. That the edjus�hnent authorized shfill not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity And district in which the subject property is situated; 2. That because of special circur�stances applicable to the subject property, incluc�ng size, shape, topography, location, or surroundings, the strict application of the provisions of this chapter is fowid to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone clessifi- cations; 3. That the granting of the Variance will not be contraty to the intent of this chapter or to the public safety, health end welfare; 4. '17,at due to special conditior�s or exeeptional characteristics of the property or its location, the strict application of the provisions of this chapter would result in dif$culties and iuu�ecessary hards}up, 5. The granting of the Variance will not be materially detrirr�ental to other properties or land uses in the area because the views currently enjoyed by the surroun�ng properties will not be significantly impacted by the proposed development; 6. There ere exceptional or e�r�ordin�uy circurstances applicable to the intended use that do not apply to other properti�s in the sarne zone. The p�bperty has no apparent or significant viewsheds, nor does it appear to affect surinunding viewsheds. 7. The strict application of the ordinance deprives such property of privileges enjoyed by other properties in the vicinity or in the same zone because the 15- foot restriction would limit the buildable potential of the lot, and other parcels in the area have been developed with two-story hanes; and 8. The granting of the Variance is campatible with the objectiv�s, policies, and general 18nd use5 speci�ed in the General F'l.en becat�se the intent of the urgency ordinance is being met, es there is substantiel ptbtection of the viewst,eds on ad jacent property, and the proposed development is in confom�nce wlth the goals, policies and objectives of the General Plan. NOW, THERF.FORE, BE IT RF50LVED that the P'lanning Crnmission of the City of Arroyo Gtnnde hereby approves said Variance subject to the st.andard conditions of the C�ty and those listed below: 1. The development of the site shall occur in sub6tantial confocmance with the aPProved plans.
