(E. DORFMAI� WHEREAS, the Planning Cqrmission of the C�ty of Arroyo Grande hes considered Variance Application No. 88-127, filed by Oakcrest Fstates, for a Variance fran the ma�num builchng height of 15 feet at Lot 64, La G�esta Drive in the "R-1" Single Family Residential Distriet; and WHE�AS, the P'lanning Carmission has held a public hearing on this application in accordance with the Aty Cale; and � W� �RRP.A� the Planning Crnirnission finds that the following circ�xr�tances exist: 1. That the adjustrnent authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vieinity and district in which the subject praperty is situated; 2. `I't�t because of special circurr�stances applicable to the subject property, ineluding - size, shape, topography, location, or surrotu�chngs, the strict application of the provisions of this chapter is found to deprive the subject property of privilegas enjoyed by other properties in the vicinity and under identical zone classifi- cations 3. That the granting of the Variance will not be contrary to tlie intent of this etuipter or to the publie safety, health and welfare; 4. That due to special conditions or exceptional characteristics of the property ar its location, the strict application of the provisions oP this chapter would result in difficulties ana iuu�ec.�essary t�ardship; 5. The granting of the Variance will not be materially detr'vnental to other pcoperties or land uses in the area because the views currently enjoyed by the surrounding properties will not be significantly impaeted by the proposed development; 6. There are exceptional or extraordinary circurBtsnc�s applicable to the intended use that do not apply to other p�.rties in the same zone. The property has no apparent or significant viewsheds, nor do�s it appear to uffect surnounding viewsheds. 7. The strict application of the ordinance deprives such property of privileges enjoyed by other pro�erties in the vicinity or in the sarr►e zone because the 15- foot restrlction would limit the buildable potential of the lot, and other parcels in the a�ea t►ave been developed with two-story harnes; and 8. The granting of the Variance is canpatible with the objectives, palicies, and general ]end uses speci�ed in the General Plan beca�e the intent oP the urgency ordinance is being met, as there is substantial protection of the viewstieds on adjacent propec�ty, and the pt�oposed developrnent is in conforn�ance with the g�oels, policies and objectives of the General Plan. NOW, �iFREFORE, BE IT RL�SOLYED that the Plarining Ccxm�ission of the City of Arroyo Grande hereby approves said Variance subject to the standard conditions of the C7ty and those listed belows 1. The development of the site shall occur in substantial conYom�ance with the aPProved plans.
