CITY OF ARRpyO GRANDE GRANTING A VARIANCE, CASE
NO. 8&-123, APPI,IEp FOR BY OAK�R�'p �'A�
AT LOT 59, PLATINO LANE. (E. DORFMAI�
WH � t� P�� C�n�ion of the City of Arroyo Grande has considered
Variance Application No. 88-123, filed by Oakcrest Fstates, for a Variance from the maxirnum
builc�ng height of 15 feet at Lot 59, Platino Lane in the "R-1" Single Family Residential
District; and
W��EAS, the Planning Crnmission hes held a public hearing on this application in
accordanee with the CYty Code; and
WHEREAS, the P]anning Crnrrussion finds that the following eircunstances exist:
1. That the adjustrnent authorized shall not constitute a grant of speciel privilege
inconsistent with the limitations upon other properties in the vieinity and cbstrict
in which the subject property is situated;
2. That because of special circur�tences applicable to the subject propertY, including
size, shape, topography, location, or surro�c�ngs, the strict application of the
provisions of this chapter is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and under identicai zone classifi-
cations;
3 • That the granting of the Variance will not be contraiy to the intent of this
chaptec or to the public safety, health and welfare;
4. That due to special conditions or exceptional characteristies of the property or its
location, the strict application of the pmviszons of this chapter would c�e�lt in
difffculties and tuu�ecessary har��p�
5• The granting of the Variance will not be materielly detrimental to other properties
or ]and us�s in the area because the views c�t�ently enjoyed by the stu�rouncling
properti�s will not be significantly impacted by the proposed development;
s• There are exceptional or extraordinary cir�u�t,a�c� applicable to the intended
use that do not apply to other properties in the seme zone. The property hns no
Appa�ent or significant viewsheds, nor does it appe�r to affect surrounding
viewsheds.
7. The strict application of the orchnance deprives such p►bperty of privileges
enjoyed by other praperties in the vicinity or in the same zone becai,�se the 15-
foot restriction would limit the buildable potential of the lot, and other parcels in
the area have been developed with two�tory hanes; and
$' T�e �� °f �� �ariance is cxampatible with the objectives, policies, and
g�neral land u�es specified in the General Plan because the intent of the urgency
orc�nance is being met, es there is substantiai pc�otection of the viewsheds on
adjacent property, and the propos� developrnent is in confom�ance with the goals,
policies and objectiveg of the General Plan.
NOW, THEREPORE, B8 IT 1tL�'SOLVED that the
Arroyo Grande hereby approves said Variance subject to th� ��ti og ��
and those ]isted below:
1. The development of the site shall occur in sulastantial confor�� �th the
�PP�ved plans.
