WHERF.AS, the Planning Conmis.sion of the C�ty of Arroyo Grande has considered a Variance application No. 87-110, filed by Paul fteiril�ardt and Joni fIiu�stad, for a Variance fran the ma�dmum building height of 15 feet at 360 Gularte Road in the "R-1" Single Family Residential District; and WHEREAS, the Cc�mission has held a public hearing on this application in accordance with the G7ty Code; and WHEREAS, the Carrnission finds that the following circurrstances e�dst: 1. That the adjustment authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject prope: ty is situated. 2. Tl�t because of special circunstances applicable to the subject property, inclucling size, shape, topography, location, or surrounchngs, the strict application of .the provisions of this chapter is found to deprive the subject property of privileges enjoyed by other pi�aperties in the vicinity Arid wider identical zone classifications. 3. That the granting of the Variance will not be contraiy to the intent of this chapter or to the public safety, health and welfare. 4. That due to special conditions or exceptional characteristics of the prnperty or its location, the strict application of the prov�s�sions of this chapter would result in difficulties and unnecessHry hardship. 5. The granting of the Variance w�ll not be materially detrimental to other properties or land uses in the area because the views currently enjoyed by the s�urounding properties will not be signi�cantly im�acted by the proposed development. 6. There are exceptional or extraordinary circ�tances applicable to the intended use that do not apply to other properties in the same zone. 1fie property has a significant slope and is odd shaped. 7. The strict application of the ordinance deprives such property of privileges enjoyed by other properties in the vicinity or in the seme zone because the 15- foot restriction would limit the bt.uldable potential of the lot, and other parcels in the area have been developed with two-story hanes. 8. The granting of the variance is canpatible with the objectives, policies, and general ]and uses specified in the General Plan because the intent of the urgency ordinance is being met, as there is substantial p�otection of the viewsheds on adjacent property, and the proposed development is in confomuuice with the goals, policies and objectives of the General Plan. NOW, THF_FtEFORE, BE P�' ItESOLVL'D that the Planning Carmission of the G�ty of Arroyo Grande hereby approves said Variance subject to the standard conditions of the GYty and those listed below: 1. The development of the site shall occur in substantial conformance with the plans approved by the Planning Cam�;ssion on January 5, 19 88. On motion by Carmissioner Olsaz, seconded by Carmussioner Soto , and by the following roll call vote, to wit: Ay� Comnissioners Olsen, Flor_es, Soto, Gerrish and Chairman Carr NOFS; O�rrmissioners NY�ore and Boggess ABSENT: Non� the faregoing Resolution was adopted this 5thday of Jan�ry 1988.
