HomeMy WebLinkAboutR 5323 RESOLUTION NO. 5323 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING AND AUTHORIZING THE CHIEF OF POLICE TO EXECUTE AN AGREEMENT WITH THE DEPARTMENT OF ALCOHOL AND BEVERAGE CONTROL FOR ALCOHOLIC BEVERAGE SALES EDUCATION AND ENFORCEMENT AND TO APPROPRIATE THE FUNDING FOR THE PROGRAM ACTIVITIES AND FIND THE ACTION EXEMPT UNDER CEQA WHEREAS, the City of Arroyo Grande, through its Police Department, is eligible to receive Federal and/or State funding through public awareness, minor decoy operations, shoulder tap operations and Informed Merchants Preventing Alcohol-Related Crime Tendencies(IMPACT)though the department of Alcoholic Beverage Control ("ABC"): and WHEREAS, ABC has awarded $41,500 in grant funding to the Arroyo Grande Police Department for its Alcohol Policing Partnership program.; and WHEREAS,ABC requires approval of this Resolution and execution of a grant agreement in order to obtain the funding, incorporated into this Resolution as Exhibit A; and WHEREAS, by accepting this grant and executing the ABC grant agreement, funding will allow for the cost associated with equipment, educational materials, training, and overtime staffing for operations will be directly reimbursed through this grant; and WHEREAS, by accepting this ABC grant, an appropriation of funding will be required for the activities; and WHEREAS, the City Council of the City of Arroyo Grande wishes to delegate authorization to the Chief of Police to execute this grant agreement and any amendments thereto. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande as follows: 1. The Recitals above are incorporated herein in their entirety. 2. The grant agreement is approved, and the Chief of Police is authorized to accept the grant award in the amount of $41,500 and execute the ABC grant agreement and amendments thereto with the State of California, Department of Alcoholic Beverage Control incorporated into this Resolution as Exhibit A. RESOLUTION NO. 5323 PAGE 2 3. A Budget Amendment Request for FY 2023-24 in the amount of$41,500 is hereby approved to account for the additional revenue and expenditures related to the grant. 4. Grant funds received hereunder shall not be used to supplant expenditures controlled by this body, and this award is not subject to local hiring freezes. 5. The City Council finds adopting this Resolution is not a project subject to the California Environmental Quality Act ("CEQA") because the action in itself has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378.) The Police Department is a full service law enforcement agency with budgeted personnel of 26 sworn and 6 non-sworn employees. The city spans over 6 miles, making the population density 3,166 people per square mile. Of the population, 23% of persons are under the age of 18 and 8% of persons are between the ages of 18-24. The median household income is $88,068 while the poverty rate is 6.43%. On a daily basis, Arroyo Grande experiences an increase in vehicular and pedestrain traffic due to the adjacent cities, making up the "Five Cities" area with Arrroyo Grande being the largest of the five. The Five Cities area population is 54,000, not including an added 40,000 in tourist annually. The large increase in tourist population is due to its' conveinent location halfway between San Francisco and Los Angeles, as well as it being directy west of California's Central Valley, serving as a top destination for coastal activites and weather. The city's business community offers full services consisting of gasoline, hotels, resturants, and major grocery stores. Arroyo Grande also has the only public High School in the Five Cities area. The Village (downtown) area is highly populated and mostly consists of resturants and bars. Direct access to the Village is through two exits off Highway 101, which is the main artery in the center of the city. The Arroyo Grande Police Department (AGPD) is a full service law enforcement agency with budgeted personnel of 26 sworn and 6 non-sworn employees. In the last year, AGPD handled 18,262 calls for service, approximatley 50 calls per day. In order to accomplish our goals and objectives that align with the regulations and strategies of ABC, I am requesting the grant amount of$41,500. Arroyo Grande has 52 active on- sale licensed retail establishements and 28 active off-sale licensed retail establishments. Project Personnel The Arroyo Grande Police Department is a full service law enforcement agency with budgeted personnel of 26 sworn and 6 non-sworn employees. Our current staffing includes 24 sworn staff and 5 non-sworn employees. Our staff includes 4 adminstration staff, 5 Sergeants, 12 Patrol Officers, 2 Motor/Traffic Officers, 1 School Resourse Officer, 2 Detectives, 1 Property and Evidence Clerk, 1 Records Clerk, and 2 Police Cadets. The Patrol division will be responsible for carrying out the grant objectives due to it being the largest division and more available to carry out the day to day objectives and goals addressing community threats and issues. Personnel responsible will be as follows: - Police Commander Culver - Police Sergeants Castillo, Burns, Bio, and Pierce - Senior Police Officers Corral, Smith, Esparza, Doherty, and Ramirez - Police Officers Giesman, Estrada, Esparza, Black, Sousa, Earnest, Peinado, Easter, Bennett, and Pierce ***See attched documentation for annual budget*** SCOPE OF WORK Problem Statement The City of Arroyo Grande has a population of approximately 18,500 residents and consists of nearly 6 square miles. However, the city experiences a significant increase in daily population and traffic due to employment, business and service providers located within Arroyo Grande. Additionally, our service population experiences an increase from the other 4 cities immediately adjacent to ours, making up the " Five Cities" area. The larger Five Cities area population is approximately 54,000 residents, not including the constant tourist population, which is approximately per year. Arroyo Grande is conveniently located half-way between San Francisco and Los Angeles and directly west of California's Central Valley area, making it a top destination for coastal beaches and weather. The City experience significant increases in traffic, pedestrians, and alcohol related incidents due to the many opportunities for outdoor actives, popular winery destinations, and the Oceano Dunes Vehicular recreation area. The City of Arroyo Grande business community provides full services including gasoline sales, major grocery and department stores, hotels and restaurants. Highway 101 is a main artery which is routed through the center of the City used for direct access by everyone utilizing the City's business and community services including those traveling through the area. In addition, Arroyo Grande has the only public high school in the Five Cities area, servicing approximately 2100 high school students. This causes an increase in the number of underage alcohol consumption in the area and inexperienced drivers on the road. With the resident, student, and tourist populations impacting our total service population, we have seen increases in alcohol related and traffic incidents over the last several years. Arroyo Grande biggest community threat is underage alcohol consumption and alcohol involved traffic incidents. These incidents do not consider factors such as age or economic status and affect the community as a whole. This issue directs law enforcement efforts to target the heavy vehicle and pedestrian traffic areas of the city. The City of Arroyo Grande and the local beach communities are a desirable destination for tourists and residents year around. In particular, Arroyo Grande's Village (downtown) area consists of numerous restaurants and bars. These qualities draw large crowds, both vehicular and pedestrian on weekends and Holidays. In the last year, AGPD responded to 176 calls for service at the popular bars and restaurants of the Village area involving reoccurring issues of intoxicated subjects, DUI drivers, physical altercations, trespassing, battery, and the majority of the city's violent crimes. In addition to the holidays such as the end of summer vacation/Labor Day period, Memorial Day, Independence Day weekends, Halloween and the holiday period (Thanksgiving through New Year's), Super Bowl Sunday, and Cinco de Mayo, the City celebrates local festivals/events including the Harvest Festival and Parade, Car Show, Christmas Parade. In 2020, AGPD made 81 DUI arrests, in 2021 AGPD made 156 DUI arrests, and in 2022 AGPD made 202 DUI arrests. In addition, in the last year, AGPD made 28 DUI arrest of persons under the age of 21, 63 arrest for 647(f) PC, and had a total of 268 reports documented related to alcohol which is 13% of total reports documented. To address the community issues and provide better safety for our revolving population, significant I progress is made in reducing the frequency of DUI's, minor consumption of alcohol, and other alcohol related issues, by law enforcement conducting awareness, education campaigns, and enforcement efforts. SCOPE OF WORK Project Description section 1 of 2 The goals of Arroyo Grande Police Department are listed as the following: 1. Reduce the number of persons injured in alcohol related incidents (violent crimes, physical altercations, and falls). 2. Reduce the number of persons injured or killed in alcohol-involved crashes. 3. Reduce the number of alcohol consumption by minors. 4. Reduce the number of ABC licensed establishments furnishing alcohol to minors. 5. Reduce the number of persons over the age of 21 furnishing alcohol to minors. 6. Reduce the number of ABC licensed establishments overserving intoxicated subjects. 7. Coordinate and conduct IMPACT (Informed Merchants Preventing Alcohol Related Crime Tendencies) Operations at 50% of the licensed premises within our jurisdiction. 8. Host at least 2 TRACE trainings. 9. Identify and target problematic ABC license establishments. 10. Coordinate and conduct 2 Drunk Decoy operations through 5 ABC licensed establishments. 11. Conduct at least 6 Minor Decoy operations. 12. Conduct at least 6 "Shoulder Tap" operations. 13. Conduct 4 patrol briefings on ABC laws. 14. Issue 4 Social Media Releases regarding the grant and/or the activities conducted under the grant. 15. Issue 2 press releases regarding the grant and/or the activities conducted under the grant. The objectives of the goals desired by Arroyo Grande Police Department as as followed: 1. Issue 1 press release announcing the grant by July 15th. The press release and social media announcement must be approved by the division commander prior to public release. 2. Issue 1 Social Media release regarding grant and activities to be conducted by July 15th. 3. Conduct 1 briefings for each shift (4) on ABC laws and activities prior to first grant activity (middle of August). Use this opportunity to talk with each shift regarding issues with local ABC licensed establishments. 4. Develop and maintain a BOL list of local on sale and off sale establishments to notify patrol, ABC, and those involved with the grant of reoccurring issues and violations. 5. Conduct IMPACT operations at 40 of the licensed establishments in Arroyo Grande. 20 of them will be conducted by December 31 2023. The other 20 will be conducted from January 1 2024- June 1 2024. 6. Host 2 TRACE trainings in September. Each of the trainings will have 2 of the 4 shifts in attendance. 7. Coordinate and conduct Minor Decoy operations. 3 of the Minor Decoys should be conducted during weekends, preferably during summer or Holidays from July 2023 - December 31 2023. AGPD volunteer explorers will be able to participate as minors with permission and waivers from their legal guardians. These Minor Decoys will be conducted operations that will hold the licensed premises accountable, prevent furnishing alcohol to minors, and make sure premises are checking IDs. 8. Coordinate and conduct Shoulder Tap operations. Shoulder Tap operations should be conducted during weekends, preferably summer or Holidays due to the high volume of traffic. 3 operations will be conducted from July 2023-December 31, 2023 and 3 more operations shall be conducted from January 1 2024 - June 15 2024. AGPD volunteer explorers will be able to participate as minors in the operation with permission and signed waivers from the minor legal guardians. Shoulder Taps will be conducted to deter future shoulder tap activity in our area. These operations are conducted outside of licensed premises with the objective of reducing furnishing alcohol to minors through arrests or citations. 9.
