A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARROYO GRANDE RECOMMENDING THAT
THE CITY COUNCIL APPROVE TIME EXTENSION 09-005
� FOR CONDITIONAL USE PERMIT 06-005; LOCATED AT
231 SOUTH HALCYON ROAD
WHEREAS, the Planning Commission adopted Resolution No. 06-2016 which approved
Conditional Use Permit 06-005 on October 3, 2006; and
WHEREAS, the Planning Commission adapted Resolution No. 08-2073 which approved
a one-year time extension for Conditional Use Permit 06-005 on October 21, 2008; and
WHEREAS, the Planning Commission has considered a request for a second one-year
time extension for Conditional Use Permit 06-005, applied for by Jeff Hollister; and
WHEREAS, the Planning Commission finds, after due study and deliberation, that there
have been no significant changes in the General Plan, Municipal Code or character of the
area within which the project is located that would cause the approved project to be
injurious to the public health, safety, or welfare.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends
that the City Council approve a one-year time extension for Conditional Use Permit 06-
005, with the above findings and subject to all original conditions as set forth in Exhibit "A"
attached hereto and incorporated herein by this reference.
On a motion by Commissioner Brown, seconded by Commissioner Ruth, and by the
following roll call vote:
AYES: Commissioners Brown, Ruth, Barneich, Keen, and Chair Ray
NOES: None
ABSENT: None
The foregoing Resolution was adopted this 17 day of November 2009.

CONDITIONS OF APPROVAL
TIME EXTENSION 09-005
This approval authorizes a second one (1) year time extension for Conditional Use Permit
06-005, which will now expire on December 12, 2010.
COMMUNITY DEVELOPMENT DEPARTMENT
GENERAL CONDITIONS:
1. The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Conditional Use
Permit 06-005.
3. All conditions of approval for the project shall be included in construction
drawings.
4. The applicant shall, as a condition of approval of this application, defend,
indemnify and hold harmless the City of Arroyo Grande, its present or former
agents, officers and employees from any claim, action, or proceeding against the
City, its past or present agents, officers, or employees to attack, set aside, void,
or annul City's approval of this subdivision, which action is brought within the
time period provided for by law. This condition is subject to the provisions of
Government Code Section 66474.9, which are incorporated by reference herein
as though set forth in full.
