PC R 01-1811� RESOLUTION NO. 01-1811 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A ONE-YEAR TIME EXTENSION CASE NO. 01-004 FOR TENTATIVE TRACT MAP NO. 2240 FOR A NINE PARCEL SUBDIVISION, LOCATED AT 410 SOUTH ELM STREET, APPLIED FOR BY ZADDIE R. BUNKER TRUST WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a request for a third one-year time extension for Tentative Tract Map No. 2240 filed by Zaddie R. Bunker Trust for a nine-parcel subdivision located at 410 S. Elm Street; and WHEREAS, the Planning Commission approved Tentative Tract Map No. 2240 on November 18, 1997; and WHEREAS, the Planning Commission held a Public Hearings on December 7, 1999 and November 21, 2000 to approve one-year time extensions, WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved project to be injurious to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves a one-year time extension for Tentative Tract Map No. 2240, with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. Elm Street, Arroyo Grande, California. 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Tentative Tract Map No. 2240. 3. Tentative Tract Map No. 2240 shall automatically expire November 18, 2002. The applicant may not apply for an additional time extension pursuant to Development Code Section 9-02.140. 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. The applicant shall be subject to all currently applicable development fees.
