CALL TO ORDER Mayor Ray Russom called the Regular City Council Meeting to order at 6:00 p.m. 2. ROLL CALL City Clerk Matson took roll call. 3. MOMENT OF REFLECTION 4. FLAG SALUTE Mayor Ray Russom led the flag salute. 1 5. AGENDA REVIEW 5.a Closed Session Announcements None. 5.b Ordinances read in title only Moved: Mayor Ray Russom Seconded: Council Member Barneich Move that all ordinances presented at the meeting shall be read by title only and all further readings be waived AYES (5): Mayor Ray Russom, Council Member Barneich, Council Member Secrest, Council Member George, and Mayor Pro Tem Guthrie Result: Passed (5 to 0) 6. SPECIAL PRESENTATIONS, ELECTION MATTERS, AND CITY COUNCIL REORGANIZATION 6.a City Manager Communications City Manager Downing gave an update regarding the 2025 Community Priorities Survey for the next budget cycle; Tree Lighting event on December 15th; and the 38th Annual Santa Cop Program. No action was taken on this item. 6.b Presentation to Outgoing Council Members Kristen Barneich and Lan George and Opportunity for Comments NOVEMBER 5, 2024 ELECTION MATTERS AND CITY COUNCIL REORGANIZATION Mayor Ray Russom presented Council Member George and Council Member Barneich with a plaque, a Certificate of Recognition from Senator Laird, and provided comments regarding their service to Arroyo Grande. Council Member George provided comments. Council Member Barneich provided comments. Mayor Pro Tem Guthrie, and Council Member Secrest commented on Council Members George's and Barneich's service to the City. Mayor Ray Russom invited public comment. Speaking from the public were Jimmy Paulding, Keith Storton, Adam Verdin, Hailey Barneich, and Maddy Barneich. No further public comments were received. 6.c Declaration of Results of the November 5, 2024 Consolidated General Municipal Election City Clerk Matson presented the item and reported on the election results. Mayor Ray Russom invited public comment. No public comments were received. 2 Moved by Mayor Pro Tem Guthrie Seconded by Council Member Secrest Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 5, 2024, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW". AYES (5): Mayor Pro Tem Guthrie, Council Member Secrest, Council Member George, Council Member Barneich, and Mayor Ray Russom Result: Passed (5 to 0) 6.d Swearing-In Ceremony and Seating of Newly Elected Officers City Clerk Matson administered the Oath of Office to the elected Mayor Caren Ray Russom, Council Member Aileen Loe and Council Member Jamie Maraviglia. The newly elected officials then took their seats at the dais. 6.e Comments by Newly Elected Officials Council Member Maraviglia and Council Member Loe provided comments. Mayor Ray Russom provided comments. Mayor Ray Russom called a recess for a brief reception at 7:02 p.m. The City Council reconvened at 7:28 p.m. to consider all remaining items on the City Council Agenda. City Clerk Matson took roll call. ROLL CALL: Council Members Loe, Maraviglia, Guthrie, Secrest, and Mayor Ray Russom were present. 7. CITY COUNCIL REPORTS None. Reports are made during the Second Council Meeting each month. 8. COMMUNITY COMMENTS AND SUGGESTIONS Mayor Ray Russom invited public comment. No public comments were received. 9. CONSENT AGENDA Mayor Ray Russom asked the Council if there were any questions or any items to be pulled from the consent agenda for further discussion. Council Member Maraviglia asked to pull Item 9h for separate consideration due to her conflict of interest being recently elected to the City Council and having previously heard and acted on this item as a member of the Planning Commission. Mayor Ray Russom declared a conflict of interest due to ownership of an ADU. City Manager Downing responded to questions from Council. 3 Mayor Ray Russom invited public comment. Speaking from the public was Alexandria Davis. No further public comments were received. City Manager Downing responded to questions from the public. Council Member Loe commented on Item 9.g. Moved by Mayor Pro Tem Guthrie Seconded by Council Member Secrest Approve Consent Agenda Items 9.a. through 9.g., with the exception of item 9.h. with the recommended courses of action. AYES (5): Mayor Pro Tem Guthrie, Council Member Secrest, Council Member Loe, Council Member Maraviglia, and Mayor Ray Russom Passed (5 to 0) 9.a Cash Disbursement Ratification Reviewed and ratified the listing of cash disbursements for the period of October 16 through October 31, 2024. 9.b Statement of Investment Deposits for October 2024 Received and filed the report listing investment deposits of the City of Arroyo Grande as of October 31, 2024, as required by Government Code Section 53646(b). 9.c Authorization to Execute Agreements with the California Department of Tax and Fee Administration and Authorize the Examination of Transactions and Use Tax Records 1) Adopted Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH THE CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION FOR IMPLEMENTATION OF A LOCAL TRANSACTIONS AND USE TAX"; and 2) Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AUTHORIZING EXAMINATION OF SALES OR TRANSACTIONS AND USE TAX RECORDS"; and 3) Authorized the City Manager to amend the agreement with Hinderliter, De Llamas, and Associates (HdL Companies) for continued Transactions and Use tax Audit and Information Services. 9.d Approval of Minutes Approved the minutes of the Regular City Council Meeting of November 26, 2024, as submitted. 9.e 2025 City Council Regular Meeting Schedule Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ESTABLISHING THE 2025 CITY COUNCIL REGULAR MEETING SCHEDULE". 4 9.f Resolution Updating the Policy for the Distribution of Tickets and Passes Pursuant to Title 2, Section 18944.1 of the California Code of Regulations 1) Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE UPDATING THE TICKETS AND PASSES DISTRIBUTION POLICY, A POLICY GOVERNING THE RECEIPT AND DISTRIBUTION OF TICKETS AND PASSES PURSUANT TO TITLE 2, SECTION 18944.1 OF THE CALIFORNIA CODE OF REGULATIONS"; and 2) Made findings that adopting the Resolution is not a project subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060 (c)(2) and (3), 15378.) 9.g Notice of Award, Traffic Way Bridge Replacement Project, PW 2023-02 1) Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AWARDING THE TRAFFIC WAY BRIDGE REPLACEMENT PROJECT CONSTRUCTION CONTRACT TO GRANITE CONSTRUCTION COMPANY FOLLOWING A COMPETITIVE BID PROCESS, AND FINDING THAT SAID ACTION IS EXEMPT FROM CEQA PURSUANT TO STATE CEQA GUIDELINES SECTION 15060"; and 2) Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AWARDING THE TRAFFIC WAY BRIDGE REPLACEMENT PROJECT CONSTRUCTION MANAGEMENT PROFESSIONAL SERVICES AGREEMENT TO FILIPPIN ENGINEERING FOLLOWING A REQUEST FOR PROPOSALS PROCESS, AND FINDING THAT SAID ACTION IS EXEMPT FROM CEQA PURSUANT TO STATE CEQA GUIDELINES SECTION 15060". 9.h Adoption of an Ordinance Amending Title 16 of the Arroyo Grande Municipal Code Regarding Accessory Dwelling Units Moved by Mayor Pro Tem Guthrie Seconded by Council Member Secrest Adopted an Ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING TITLE 16 OF THE ARROYO GRANDE MUNICIPAL CODE RELATING TO ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS AND FINDING THE ACTION TO BE STATUTORILY EXEMPT FROM CEQA". AYES (3): Mayor Pro Tem Guthrie, Council Member Secrest, and Council Member Loe ABSENT (2): Mayor Ray Russom, and Council Member Maraviglia Passed (3 to 0) 10. PUBLIC HEARINGS None. 5 11. BUSINESS ITEMS 11.a Selection of Council Member Secrest as Mayor Pro Tem City Clerk Matson presented the report. Mayor Ray Russom invited public comment. No public comments were received. Council Member Secrest accepted the nomination. Moved by Council Member Maraviglia Seconded by Mayor Pro Tem Guthrie Appoint Council Member Secrest as the Mayor Pro Tem for the next one-year period, pursuant to City Council policy. COUNCIL COMMUNICATIONS Council Member Guthrie asked staff regarding a procedure, and City Attorney Rosen responded; commented on Elegant Night in the Village and the Holiday Parade. Mayor Pro Tem Secrest commented on the Holiday Parade and commended staff; wished staff and the public a Merry Christmas and Happy Holidays.
