Reports are made during the second Council Meeting each month. 8.COMMUNITY COMMENTS AND SUGGESTIONS This public comment period is an invitation to members of the community to present issues, thoughts, or suggestions on matters not scheduled on this agenda. Comments should be limited to those matters that are within the jurisdiction of the City Council. The Brown Act restricts the Council from taking formal action on matters not published on the agenda. In response to your comments, the Mayor or presiding Council Member may: Direct City staff to assist or coordinate with you.• A Council Member may state a desire to meet with you.• It may be the desire of the Council to place your issue or matter on a future Council agenda. • Please adhere to the following procedures when addressing the Council: Comments should be limited to 1 minute or less.• Your comments should be directed to the Council as a whole and not directed to individual Council members. • Slanderous, profane or personal remarks against any Council Member or member of the audience shall not be permitted. • 9.CONSENT AGENDA The following routine items listed below are scheduled for consideration as a group. The recommendations for each item are noted. Any member of the public who wishes to comment on any Consent Agenda item may do so at this time. Any Council Member may request that any item be withdrawn from the Consent Agenda to permit discussion or change the recommended course of action. The City Council may approve the remainder of the Consent Agenda on one motion. 9.a Cash Disbursement Ratification (VALENTINE) Recommended Action: Review and ratify the attached listing of cash disbursements for the period of January 1 through January 15, 2025. 9.b Statement of Investment Deposits for December 2024 (VALENTINE) Recommended Action: Receive and file the attached report listing investment deposits of the City of Arroyo Grande as of December 31, 2024, as required by Government Code Section 53646(b). 9.c Approval of Minutes (MATSON) Recommended Action: Page 3 of 239 Approve the minutes of the Regular City Council Meeting of January 28, 2025, as submitted. 9.d Appointments to Tourism Business Improvement District Advisory Board and Architectural Review Committee (MATSON) Recommended Action: 1) Adopt a Resolution appointing Tricia Kesselring to the Tourism Business Improvement District (TBID) Advisory Board and Mike Harris to the Architectural Review Committee (ARC); and 2) Determine that approving the appointments to the Tourism Business Improvement District Advisory Board and the Architectural Review Committee is not a project subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, Cal. Code Regs., tit. 14, §§ 15060, subd. (c)(2)-(3), 15378.). 9.e Traffic Way Bridge Compensatory Mitigation Memorandum of Understanding (ROBESON) Recommended Action: Adopt a Resolution authorizing the City Manager to execute the proposed Memorandum of Understanding (MOU) with the Land Conservancy of San Luis Obispo County (“Land Conservancy”) to contribute funds to support long-term maintenance of the Black Lake Ecological Area (“Black Lake Project”) as environmental mitigation for the Traffic Way Bridge Replacement Project. 9.f Summary Vacation of a Public Equestrian Easement on Ridgeview Way (PEDROTTI) Recommended Action: 1) Adopt a Resolution summarily vacating the public equestrian easement pursuant to summary vacation procedures set forth in Streets and Highways Code Section 8330 et seq; and 2) Find that the action is not a project under CEQA or, alternatively, that it is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3) (“common sense exemption”). 9.g Amendments to Title 16 of the Arroyo Grande Municipal Code Regarding Wireless Telecommunication Facilities (PEDROTTI) Recommended Action: 1) Adopt an Ordinance amending Arroyo Grande Municipal Code regarding wireless telecommunication facilities; and 2) Find that the “project” is exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Sections 15061(b)(3), 15378 and in the alternative, State CEQA Guidelines sections 15301, 15302, 15303 and 15304. 10.PUBLIC HEARINGS 10.a Final Approval of Community Development Block Grant Projects for Year 2025 Page 4 of 239 (PEDROTTI) Recommended Action: 1) Adopt a Resolution Recommending to the County Board of Supervisors Approval of Community Development Block Grant (CDBG) Projects for Year 2025; and 2) Find that the preliminary approval of projects is exempt from CEQA, pursuant to CEQA Guidelines Section 15061 subd. (b)(3). 10.b Authorization of a Lease Agreement for City Property; Location – 138 E. Branch Street (PEDROTTI) Recommended Action: 1) Adopt a Resolution authorizing the City Manager to execute a new lease agreement between the City of Arroyo Grande and Gina’s Italian Restaurant subject to any minor, technical, or non-substantive changes as approved by the City Manager in consultation with the City Attorney; and 2) Determine that the authorization of a lease agreement for the right-of-way adjacent to 138 E. Branch Street is not a project subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378). 11.BUSINESS ITEMS 11.a Pre-Application for a New Hotel at 400 W. Branch Street (PEDROTTI) Recommended Action: Review the proposed pre-application, receive public comment, and provide preliminary comments to the applicant. 12.COUNCIL COMMUNICATIONS Any Council Member may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council policies and procedures, Council Members may request staff to report back to the Council at a subsequent meeting concerning any matter or request that staff place a matter of business on a future agenda. Any request to place a matter of business for original consideration on a future agenda requires the concurrence of at least two other Council Members. 13.ADJOURNMENT All staff reports or other written documentation, including any supplemental material distributed to a majority of the City Council within 72 hours of a regular meeting, relating to each item of business on the agenda are available for public inspection during regular business hours in the City Clerk’s office, 300 E. Branch Street, Arroyo Grande. If requested, the agenda shall be made available in appropriate alternative formats to persons with a disability, as required by the Americans with Disabilities Act.
