CITY OF ARROYO GRANDE
RESOLUTION NO.
REVISING THE CURRENTLY FLAG POLICY OF THE CITY OF ARROYO GRANDE
WHEREAS,the City of Arroyo Grande flag policy violates federal law by authorizing the display
of the LGBTQ+PRIDE ("Pride flag")as a commemorative flag on City property,and;
WHEREAS,the LGBTQ+PRIDE("Pride Flag")represents an ideology(religion)and is not
commemorative of a historic event,in accordance with federal law,and;
WHEREAS,the City Council'personal speech'represented by the display of the LGBTQ+PRIDE
("Pride Flag")and is not representative of 'government speech'authorized by the Supreme
Court Doctrine related to commemorative flags displayed on government property,and;
WHEREAS,the City of Arroyo Grande is obligated to follow federal laws,it is proposed that the
current flag policy be revised to authorize the display of the flags of the United States of
America,the State of California and City flag,on City property,and;
WHEREAS,in accordance with federal law the following are not allowed as commemorative
flags and may not be considered for approval by the City Council:
1.Flags of a particular religious(ideology)movement or creed,to avoid the appearance of City
government endorsing religion or a particular religious movement or creed;
2.Flags of a political party,to avoid the appearance of City government endorsing a political
party;and
3.Flags advocating a certain outcome in an election,and;
WHEREAS,the City of Arroyo Grande is obligated to ensure the City Council's government
speech is not personal speech,the flag policy will be revised to no longer include the display of
commemorative flags on City property to avoid future potential violations of federal law;
NOW,THEREFORE,BE IT RESOLVED,that the City of Arroyo Grande flag policy authorize the
display of the flags of the United States of America,State of California and City of Arroyo Grande
on City property that represent unity,diversity and the protected equal civil rights of all its
citizens.
