Comments should be limited to those matters that are within the jurisdiction of the City Council. The Brown Act restricts the Council from taking formal action on matters not published on the agenda. In response to your comments, the Mayor or presiding Council Member may: Page 2 of 548 Direct City staff to assist or coordinate with you.• A Council Member may state a desire to meet with you.• It may be the desire of the Council to place your issue or matter on a future Council agenda. • Please adhere to the following procedures when addressing the Council: Comments should be limited to 1 minute or less.• Your comments should be directed to the Council as a whole and not directed to individual Council members. • Slanderous, profane or personal remarks against any Council Member or member of the audience shall not be permitted. • 9.CONSENT AGENDA The following routine items listed below are scheduled for consideration as a group. The recommendations for each item are noted. Any member of the public who wishes to comment on any Consent Agenda item may do so at this time. Any Council Member may request that any item be withdrawn from the Consent Agenda to permit discussion or change the recommended course of action. The City Council may approve the remainder of the Consent Agenda on one motion. 9.a Cash Disbursement Ratification (VALENTINE) Recommended Action: Review and ratify the attached listing of cash disbursements for the period of July 1 through July 15, 2025. 9.b Statement of Investment Deposits for June 2025 (VALENTINE) Recommended Action: Receive and file the attached report listing investment deposits of the City of Arroyo Grande as of June 30, 2025, as required by Government Code Section 53646(b). 9.c Receive and File the Biennial Budget Book for Fiscal Years (FY) 2025-27 (VALENTINE) Recommended Action: Receive and file the City of Arroyo Grande Biennial Budget Book for Fiscal Years (FY) 2025-27. 9.d Approval of Minutes (MATSON) Recommended Action: Approve the minutes of the Regular City Council Meeting of July 22, 2025, as submitted. 9.e Appointment of a Voting Delegate and Alternate for the League of California Cities Annual Conference (MATSON) Page 3 of 548 Recommended Action: Appoint Mayor Ray Russom as the voting delegate and Council Member Guthrie as the alternate for the League of California Cities Annual Conference; and authorize submittal by the City of the League of California Cities’ Voting Delegate/Alternate Form. 9.f Confirmation of Appointment of David Culver as Chief of Police (DOWNING) Recommended Action: Confirm the appointment of David Culver as the Chief of Police, effective August 15, 2025. 9.g Subscription Agreement with Safe Fleet’s COBAN NEXUS Cloud Platform Data Storage System (CULVER) Recommended Action: 1) Adopt a Resolution approving and authorizing the City Manager to execute the five-year Safe Fleet Nexus Customer Subscription Agreement in an amount not-to-exceed $178,502, subject to any minor, technical, or non-substantive changes as approved by the City Manager in consultation with the City Attorney; and 2) Find that adopting the Resolution is not a project subject to the California Environmental Quality Act (“CEQA”) because approval of a software subscription agreement does not in itself have potential to result in either a direct, or reasonably foreseeable indirect, physical change to the environment. (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.) 9.h Agreement with the California Office of Traffic Safety (CULVER) Recommended Action: 1) Adopt a Resolution authorizing the Chief of Police to execute a grant agreement with the California Office of Traffic Safety (OTS) to accept grant funding for traffic safety programs; 2) Approve a Budget Amendment Request for FY 2025-26 in the amount of $80,000 to account for the additional revenue and expenditures related to the grant; and 3) Find that adopting the Resolution is not a project subject to the California Environmental Quality Act (“CEQA”) because adopting the Resolution does not in itself have potential to result in either a direct, or reasonably foreseeable indirect, physical change to the environment. (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.) 9.i Temporary Use Permit 25-005; Authorization for the 86th Annual Arroyo Grande Valley Harvest Festival, Friday and Saturday September 26-27, 2025; Location – Heritage Square Park and Olohan Alley (PEDROTTI) Recommended Action: 1) Adopt a Resolution approving Temporary Use Permit 25-005, authorizing closure of City streets, sale of alcohol, waiver of fees, and use of City property for the 86th Annual Arroyo Grande Valley Harvest Festival, Friday and Saturday, September 26-27, 2025; and 2) Find the action exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304 of the CEQA Guidelines. Page 4 of 548 10.PUBLIC HEARINGS 10.a Public Hearing to Consider Amending the Authorized Uses of the Arroyo Grande Tourism Business Improvement District (AGTBID) Funds and Amending the Arroyo Grande Municipal Code (BOHLKEN) Recommended Action: 1) Conduct a public hearing to receive public comment and any protests regarding the City Council’s intention to amend authorized improvements and activities funded by assessments imposed through the Arroyo Grande Tourism Business Improvement District (AGTBID); 2) Determine whether a majority protest has been received; if no majority protest has been received: a. Adopt a Resolution to make modifications to the authorized uses funded by assessments imposed through the AGTBID, and directing the introduction of an ordinance amending Chapter 3.46 of the Arroyo Grande Municipal Code, b. Introduce an Ordinance for first reading to amend Chapter 3.46 of the Municipal Code authorizing amendments to authorized uses of AGTBID funds; and 3) Find that the recommended actions to support the Arroyo Grande Tourism Business Improvement District are not subject to the California Environmental Quality Act (“CEQA”) because these efforts have no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060 (c)(2) and (3), 15378). 11.BUSINESS ITEMS 11.a 2024 Annual Report for the Northern Cities Management Area and City Water Supply and Future Resources Evaluation Update (ROBESON) Recommended Action: 1) Receive and file the 2024 Northern Cities Management Area (NCMA) Annual Report; and 2) Receive and file this update on water supply for current and upcoming needs. 12.COUNCIL COMMUNICATIONS Any Council Member may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council policies and procedures, Council Members may request staff to report back to the Council at a subsequent meeting concerning any matter or request that staff place a matter of business on a future agenda. Any request to place a matter of business for original consideration on a future agenda requires the concurrence of at least two other Council Members. 13.ADJOURNMENT All staff reports or other written documentation, including any supplemental material distributed to a Page 5 of 548 majority of the City Council within 72 hours of a regular meeting, relating to each item of business on the agenda are available for public inspection during regular business hours in the City Clerk’s office, 300 E. Branch Street, Arroyo Grande. If requested, the agenda shall be made available in appropriate alternative formats to persons with a disability, as required by the Americans with Disabilities Act.
