MEMORANDUM TO: City Council FROM: Bill Robeson, Assistant City Manager/Director of Public Works BY: Shannon Sweeney, City Engineer SUBJECT: Offer of Dedication, Frontage at 151 South Elm Street DATE: October 14, 2025 RECOMMENDATION: 1) Adopt a Resolution accepting the Offer of Dedication for an easement for public right - of-way along the frontage of 151 South Elm Street for public purposes to fill in a sidewalk gap on the east side of South Elm Street between Sunset Drive and Poplar Street; and 2) Find that the action is not a project subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060, subd.(c)(2)-(3), 15378.) or alternatively, that it is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3) (the “common sense exception”). IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The Offer of Dedication has no financial impact, other than the cost of construction of the curb gutter and sidewalk (CG&SW). The estimated cost to complete the curb, gutter, and sidewalk to fill in the sidewalk gap at 151 South Elm Street (approximately 60 feet), is $25,000, which will be paid for from the $500,000 in the FY 2025-26 budget for the Sidewalk Repairs and Improvements Capital Improvement Project (CIP) and funded through Measure E -24 sales tax funds. For economy of scale/cost efficiency and ease of project management, this work is being designed and scheduled for completion along with the $340,560 Highway Safety Improvement Program grant funds slated for pedestrian improvements on East Bra nch Street east of Mason Street and across Huasna Road in front of Strother Park. BACKGROUND: Due to the current sidewalk gap at 151 South Elm Street, the City plans to install a new concrete curb, gutter, and sidewalk in the right-of-way to fill in the gap. This new CG&SW will connect to the existing CG&SW to the south of this property and to a new segment of Page 160 of 353 Item 9.e. City Council Offer of Dedication, Frontage at 151 South Elm Street October 14, 2025 Page 2 CG&SW to the north that will continue up South Elm Street to Sunset Drive. The new CG&SW up South Elm to Sunset Drive did not require an Offer of Dedication but will be installed at the same time. The 151 South Elm Street Offer of Dedication for the easement being offered includes an approximate 90.00-foot by 35.00-foot area of the property frontage. The 151 South Elm Street ‘IRREVOCABLE AND PERPETUAL OFFER TO DEDICATE’ is included in Attachment 2, which also includes a survey map of the offered property. The hatched area on the survey map shows the area of dedication. This area extends out to the centerline of South Elm Street and was not properly acquired when the street was originally aligned, nor when the original pavement was installed. Staff is correcting this oversight with this Offer of Dedication, which the property owner fully supports. The exchange of property will allow for the City to install new CG&SW, and a new driveway apron. This Offer of Dedication includes a portion of already-improved asphalt roadway to the original centerline of South Elm Street. Accepting this Offer of Dedication adjusts the property line to behind the sidewalk, which is the appropriate location to differentiate right- of-way from private property. The red highlighted line on the aerial photo shows the extent of the new sidewalk CG&SW for the frontage of 151 and for context, the green highlighted line shows the segment of CG&SW up South Elm Street to Sunset Drive. The 2025 Active Transportation Plan1 (ATP) recommend 72 pedestrian enhancements. On August 26, 20252, the City Council provided input on the City’s Sidewalk Management Program and supported the use of the Sidewalk Repairs and Improvements. CIP funding for the infill of sidewalk gaps identified in the ATP. ANALYSIS OF ISSUES: The Offer of Dedication for the segment of street frontage along 151 South Elm is required to allow the City to install CG&SW and connect sidewalk gaps. The connection of sidewalk gaps was a priority direction to staff when the City Council considered the 2025 Annual Sidewalk Management Program. This connection and infill encourage pedestrian travel, allowing pedestrians to use the City’s sidewalk system safely. The City requires this Offer of Dedication to meet sidewalk width requirements. If this offer is not accepted, this sidewalk will not align with adjacent sidewalk or will not meet standard sidewalk width. ALTERNATIVES: 1. Adopt a Resolution accepting the Offer of Dedication for an easement for a public right-of-way along the frontage of 151 South Elm Street; 2. Do not approve staff’s recommendations and request further inf ormation; 3. Modify staff’s recommendation and approve; or 4. Provide direction to staff. ADVANTAGES: Accepting this Offer of Dedication provides the City the property necessary to construct the curb, gutter, and sidewalk to fill in a sidewalk gap identified in the City’s ATP and create a safer and more aesthetic pathway for pedestrian travel. DISADVANTAGES: None identified. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO ACCEPTING AN OFFER OF DEDICATION OF FRONTAGE AT 151 ELM STREET FOR PUBLIC PURPOSES TO FILL IN A SIDEWALK GAP ON EAST SIDE OF SOUTH ELM STREET BETWEEN SUNSET DRIVE AND POPLAR STREET WHEREAS, the Active Transportation Plan (ATP) identified multiple sidewalk gaps in need of infill, one of which exists on the east side of South Elm Street between Sunset Drive and Poplar Street; and WHEREAS, on August 26, 2025, City Council supported the infill of sidewalk gaps identified in the ATP using Sidewalk Repairs and Improvements Capital Improvement Project funding; and WHEREAS, during design, the need for additional right-of-way along the frontage of APN 007-171-001 at 151 South Elm Street was identified; and WHEREAS, the property owner of APN 007-171-001 at 151 South Elm Street has agreed to offer the necessary land for additional right-of-way for public purposes, with no financial impact to the City, as shown in the “Offer of Dedication for 151 South Elm Street” provided in Attachment 2 to the Staff Report dated October 14, 2025, subject line “Offer of Dedication, Frontage at 151 South Elm Street” and on file with the City Clerk. Both the Staff Report and Offer of Dedication for 151 Elm Street are incorporated herein by this reference; and WHEREAS , all legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande that: 1. All recitals above are true and correct and incorporated herein. 2. The City Council of the City of Arroyo Grande finds that acceptance of the Offer of Dedication for 151 South Elm Street is not a project subject to the California Page 164 of 353 65501.00014\44272638.2 RESOLUTION NO. The City Council of the City of Arroyo Grande does hereby accept the Offer of Dedication for 151 South Elm Street, for the property described on Exhibit “A” (the “Property”), attached and incorporated herein by reference. 4. The City Manager or his designee is hereby authorized to take any actions necessary or incidental to effect the purposes of this Resolution. 5. This Resolution shall take effect immediately upon adoption.
