MEMORANDUM TO: City Council FROM: Bill Robeson, Assistant City Manager/Public Works Director BY: Shane Taylor, Utilities Manager SUBJECT: Consideration of Agreement for Cross-Connection Inspection Services DATE: September 23, 2025 RECOMMENDATION: 1) Adopt a Resolution ratifying the City Manager’s approval and execution of an agreement for cross-connection inspection services with the County of San Luis Obispo. 2) Find that the action is not a project subject to the California Environmental Quality Act (“CEQA) because it has no potential to result in either a direct or reasonably foreseeable indirect, physical change of the environment. (State CEQA Guideline §15060, subd. (c)(2)-(3), 15378) or, alternatively, that is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3) (the “common sense exemption”). IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The funds are budgeted annually to support this agreement . The current amount for FY 2025-26 is $14,700. The amount over the ten (10) year term is estimated at $175,000. Staff spend approximately 100 hours per year on the Cross-Connection Control Plan. BACKGROUND: A Cross-Connection Control Plan is a component of the Domestic Water Supply Permit issued by the State Water Resources Control Board Division of Drinking Water for the City. This plan is essential for preventing contamination of drinking water systems by inspecting and managing connections between potable and non-potable water sources. The current Plan was approved by the Board on June 27, 2025. There are currently 743 cross connection or backflow devices located throughout the City, installed to protect the water distribution system. This agreement for a cross-connection inspection plan provides the City with the required services to maintain the Cross- Connection Control Plan. Page 53 of 169 Item 9.c. City Council Consideration of Agreement for Cross-Connection Inspection Services September 23, 2025 Page 2 ANALYSIS OF ISSUES: Since 1971, the City has had a cross-connection program. The County of San Luis Obispo Department of Public Health, Environmental Health Division, provides the City with qualified inspection staff who are trained, experienced, and certified to perform all aspects of the Cross-Connection Control Program. Every incorporated City in San Luis Obispo County contracts with County Health to perform cross-connection services. Having an agreement for cross-connection inspection services with County Health is the most cost-effective and efficient method of administering the Cross-Connection Program. The initial approval of the cross-connection inspection services agreement and the typical annual costs of the agreement are within the City Manager’s authority. However, since the cost of the County’s services will exceed the City Manager’s spending threshold over the full term, Council is being asked to formally approve and ratify the agreement for the full 10-year term. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Adopt a Resolution ratifying the City Manager’s approval and execution of an agreement for cross-connection inspection services with the County of San Luis Obispo. 2. Do not approve the Cross-Connection Agreement; or 3. Provide directions for staff ADVANTAGES: Approval of the Agreement will authorize the County to continue providing this critical inspection service up to the year 2035 and keep the City in compliance. DISADVANTAGES: No disadvantages are foreseen. ENVIRONMENTAL REVIEW: No environmental review is required for this item. ATTACHMENTS: 1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE RATIFYING THE CITY MANAGER’S APPROVAL AND EXECUTION OF AN AGREEMENT FOR CROSS-CONNECTION INSPECTION SERVICES WITH THE COUNTY OF SAN LUIS OBISPO WHEREAS, the City of Arroyo Grande is required, under its Domestic Water Supply Permit issued by the State Water Resources Control Board Division of Drinking Water, to maintain a Cross-Connection Control Plan to protect the potable water supply from contamination; and WHEREAS, the Cross-Connection Control Plan requires the inspection and management of cross-connection and backflow prevention devices located throughout the City; and WHEREAS, the County of San Luis Obispo Department of Public Health Environmental Health Division has trained, certified, and experienced staff who provide cross-connection inspection services to every incorporated city in San Luis Obispo County; and WHEREAS, the most recent agreement with the County of San Luis Obispo expired on June 30, 2025, and it is necessary to enter into a new agreement to continue services; and WHEREAS, this agreement is exempt from competitive solicitation as it is in the City’s best interest to take advantage of the cost savings of the County of San Luis Obispo’s county-wide cross connection inspection services, and the County of San Luis Obispo is a governmental agency, satisfying an additional, independent exemption of the City’s competitive bidding requirements; and WHEREAS, the City’s approved budget has accounted for the support and continuation of cross-connection inspection services, with an estimated cost of $175,000 over the ten (10) year term of the proposed agreement; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Council ratifies the execution of the agreement for cross-connection inspection services with the County of San Luis Obispo as set forth in Exhibit A, as approved by the City Manager, in substantially final form, subject to any minor, technical, Page 55 of 169 RESOLUTION NO. PAGE 2 or non-substantive changes as approved by the City Manager in consultation with the City Attorney. SECTION 3. CEQA. That the City Council finds that the action is not a project subject to the California Environmental Quality Act (“CEQA) because it has no potential to result in either a direct or reasonably foreseeable indirect, physical change of the environment. (State CEQA Guideline §15060, subd. (c)(2)-(3), 15378) or, alternatively, that is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3) (the “common sense exemption”). SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end, the provisions of this Resolution are declared to be severable. SECTION 5. Effective Date. This Resolution shall become effective immediately.
