A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE AUTHORIZING THE DIRECTOR OF COMMUNITY
DEVELOPMENT TO EXECUTE AN AMENDMENT EXTENDING THE
AGREEMENT FOR CONSULTANT SERVICES WITH MINTIER HARNISH
FOR THE COMPREHENSIVE GENERAL PLAN UPDATE
WHEREAS, Council approved a consultant services agreement with Mintier Harnish to
assist the City with the comprehensive General Plan Update on a three-year schedule;
and
WHEREAS, the agreement with Mintier Harnish will expire March 28, 2026, and the
scope and cost of the Comprehensive General Plan Update have not changed ; and
WHEREAS, the City and Consultant desire to extend the termination date to June 30,
2027; and
WHEREAS, the project scope is divided into eleven (11) phases. There are three (3)
phases with estimated completion dates after the agreement’s expiration ; and
WHEREAS, the Program EIR is estimated to be completed in August 2026. However,
efforts on the Comprehensive Development Code Update and the Climate Action Plan
have begun but will extend into 2027; and
WHEREAS, the City Council finds that approving and authorizing the Community
Development Director to execute the agreement amendment is not a project subject to
the California Environmental Quality Act “(CEQA)” because it has no potential to result in
either a direct, or reasonably foreseeable indirect, physical change in the environment.
(State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378.).
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande does hereby:
1. Find that the recitals set forth above are true, correct and incorporated herein by
this reference.
2. Approve and authorize the Director of Community Development to execute
Amendment No. 1 (Exhibit A), extending the contract for consultant services with
Mintier Harnish to assist the City with Comprehensive General Plan Update for one
(1) year and three (3) months to June 30, 2027, subject to any minor, technical, or
non-substantive changes approved by the City Manager in consultation with the
City Attorney.

On a motion by Council Member Maraviglia, seconded by Council Member Guthrie, and
by the following roll call vote to wit:
AYES: Council Members Maraviglia, Guthrie, Loe, Secrest, and Mayor Ray Russom

the foregoing Resolution was passed and adopted this 9th day of December, 2025.

EXHIBIT A
AGREEMENT FOR CONSULTANT SERVICES
AMENDMENT NO. 1
This First Amendment ("First Amendment") to Agreement for Consultant Services
(“Agreement”) by and between the CITY OF ARROYO GRANDE and
Mintier Harnish ("Consultant") is made and entered into this 9th day of December,
2025.
WHEREAS, the parties entered into an Agreement dated March 28th, 2023 for the
Comprehensive General Plan Update; and
WHEREAS, Section 1 ("Term") of the Agreement states that the agreement shall
remain and continue in effect until March 28th, 2026; and
WHEREAS, the parties desire to further modify the Agreement as set forth herein.
NOW THEREFORE, for valuable consideration the receipt and sufficiency of which
is acknowledged, the parties agree as follows:
1. The agreement is extended for one (1) year and three (3) months and shall
remain and continue in effect until June 30th, 2027.
2. Except as modified herein, all other terms and conditions set forth in the
Agreement for Consultant Services, as amended, shall remain unchanged.
