MEMORANDUM TO: City Council FROM: Nicole Valentine, Director of Administrative Services Sheridan Bohlken, Director of Recreation Services BY: Megan Schotborgh, Finance Manager SUBJECT: Amendments to the Comprehensive FY 2026-27 User Fee Schedule DATE: May 12, 2026 RECOMMENDATION: 1) Adopt a Resolution Establishing Additional User Fees and Adjusting the Rates and Charges for all User Fees for Regulatory Activities, Programs, and Services set forth in the Comprehensive Fee Schedule Effective July 1, 2026; and 2) Determine that adopting amendments to the Comprehensive FY 2026-27 User Fee Schedule is exempt from the California Environmental Quality Act (“CEQA”) because the activity is not a “project” subject to CEQA and it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378). IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: Revenue Adjustments (CPI Increase) The proposed amendment applies an annual Consumer Price Index (CPI) adjustment to existing user fees to maintain cost recovery levels and offset inflationary increases in labor, materials, contractual services, and overhead. The CPI adjustment will be incorporated into revenue projections during the FY 2026-27 Budget process. New Fees The addition of new user fees will allow the City to recover costs associated with services that are currently either under-recovered or not formally established in the adopted fee schedule. The fiscal impact of the new fees will depend on service dem and and will be incorporated into revenue projections during the FY 2026-27 Budget process. BACKGROUND: Historically, cities have relied on revenue generated by property and other taxes to provide services to the community. In addition, local governments rely upon user fees to fund programs and services that provide limited or no direct benefit to the community as Page 220 of 335 Item 10.b. California Constitution Article XIIIC Section 1(e)(1) distinguished fees from taxes, describing fees as “A charge imposed for a specif ic government service or product provided directly to the payor that is not provided to those not charged, and which does not exceed the reasonable costs to the local government of providing the service or product.” In order to determine the cost of providing user-specific services to individuals or businesses, a fee study is required. The City contracted with Willdan Financial Services to conduct a User Fee Study. On November 14, 20231, the City Council adopted Resolution 53332 updating user fees set forth in the Comprehensive Fee Schedule with an effective date of January 16, 2024. On March 25, 20253, the City Council approved the current FY 2025-26 Comprehensive Fee Schedule4. Resolution 5333 dictates that fees shall be administratively adjusted annually by modifying the adopted value up or down in conformance with the annual change in the CPI for the Los Angeles region. The CPI increase shall be calculated based on the reported CPI change as of the immediately preceding January, for Fee adjustment implementation in July of each year. ANALYSIS OF ISSUES: In addition to the adjustment of existing user fees by CPI, there are several recommended fees to be established as part of the Council’s action. The new fees are organized to be consistent with the order of fees in Exhibit A to the Resolution. Consumer Price Index The Director of Administrative Services has calculated that the user fees adopted as part of the Comprehensive Fee Schedule increase 3.0% based on the CPI for the Los Angeles region in January 2026. Annual CPI updates to the Comprehensive Fee Schedule take effect in July of each year and, therefore, will be effective July 1, 2026. Administrative Fee for Retirees Benefits Staff recommends establishing a 2% administrative fee for participation in the City’s Retiree Voluntary Dental and Vision Program. The purpose of this fee is to recover the City’s reasonable and actual costs associated with administering and maintaining access to voluntary dental and vision coverage for eligible retirees and their dependents. While premiums for coverage are funded by retiree contributions, the City performs essential administrative functions necessary to sustain the program. These functions include vendor coordination, enrollment and eligibility management, premium billing and reconciliation, regulatory compliance, required reporting, and ongoing retiree communications. This fee is supported by an internal cost analysis of staff time and direct program expenses associated with administering the retiree dental and vision program. The 2% amount is consistent with standard administrative fees applied to similar benefit programs, including those permitted under COBRA, and reflects a reasonable approximation of the City’s costs to administer the program. The fee will be applied uniformly and will not exceed the City’s actual cost of adminis tration. Participation in the Retiree Dental and Vision Program is voluntary, and the administrative fee supports the City’s ability to continue offering access to this coverage. Staff will periodically review program costs to ensure the fee remains appropriately aligned with actual administrative expenses. The proposed fee of 2% is reflected in the Resolution, Exhibit A, line 48, under the Administrative Services section of the User Fee Schedule. Tree Permit Application Staff recommends the establishment of a new annual Tree Trimming Permit. This permit will be required for tree trimming companies performing work within the public right -of- way. Historically, tree trimming companies have not consistently obtained encroachment permits for individual projects, largely due to the short-duration and rapid nature of this work, making enforcement challenging. The proposed annual permit will streamline administration while ensuring proper insurance and liability protections are in place, shifting responsibility to the contractor for work performed in the right-of-way. The permit will also incorporate standard traffic control requirements to maintain public safety. The proposed fee is intended to recover the administrative costs associated with processing and monitoring the annual permit, including approximately 1.5 hours of review by the City’s Senior Engineer and approximately 2 hours of staff time by the Permit Technician to complete insurance verification, issue the permit, and provide ongoing coordination and communication with contractors throughout the permit term. The proposed fee of $400 per year is based on cost recovery related to staff time and is reflected in the Resolution, Exhibit A, line 18, under the Engineering section of the User Fee Schedule. Deposit Fee for Centennial Park Gazebo Staff recommends the establishment of a security deposit requirement for rentals of Centennial Park and the Gazebo. While a rental fee is currently charged for use of these facilities, no deposit is required, which differs from the City’s standard practice for other facility rentals. Implementing a deposit will provide financial protection to the City in the event of damage, excessive cleaning needs, or non -compliance with rental agreement terms. Establishing a deposit for these facilities will ensure consistency across rental policies and promote responsible use of City property. The proposed deposit amount will be structured similarly to other comparable City facility rentals. The proposed deposit is $54 per use and is reflected in the Resolution, Exhibit A, line 17, under the Recreation Services section of the User Fee Schedule. Court Rental Fee Staff recommends renaming the existing “Tennis Court Rental – 1 Court” fee listed under Soto Sports Complex Use Fees (Line 36) in the Recreation Services section to “Court Page 222 of 335 Item 10.b. City Council Amendments to the Comprehensive FY 2026-27 User Fee Schedule May 12, 2026 Page 4 Rental – 1 Court” to better reflect the variety of recreational court facilities available for reservation and use. The updated fee title would apply consistently to rentals of tennis, pickleball, basketball, volleyball, and other similar court facilities maintained by the City. This proposed change is administrative in nature and intended to provide greater clarity and flexibility within the User Fee Schedule as recreational programming and facility use continue to evolve. No changes to the current rental rate of $14 per hour are proposed. The proposed fee title change is reflected in the Resolution, Exhibit A, line 36, under the Recreation Services section of the User Fee Schedule. Light Key Fees Staff recommends establishing two new fees related to light keys. The proposed new fees include an annual Soto Sports Pickleball Light Key fee of $25, in addition to the existing pickleball club annual membership fee, and an annual Soto Sports Complex Tennis Court Light Key fee of $75. Unlike the pickleball program, no current tennis club membership structure exists. These fees will better reflect the operational and maintenance costs associated with the use of specialized recreational amenities, and formalize fees for facility features that are currently unstructured within the User Fee Schedule. The Pickleball Light Key fee is reflected in the Resolution, Exhibit A, line 45, under the Recreation Services section of the User Fee Schedule. The Tennis Light Key fee is reflected in the Resolution, Exhibit A, line 38, under the Recreation Services section of the User Fee Schedule. Trash Service Fee for Soto Sports Complex Staff recommends the establishment of a new tournament-related service fee for events held at Soto Sports Complex. Currently, there is no permanent dumpster located at the site, and tournament events rely on City staff to empty trash receptacles during and after events. Because staff are not scheduled for the full duration of tournament activities, this arrangement creates operational challenges and additional staff time impacts. The proposed fee would ensure that tournament organizers are responsible for properly emptying trash and cleaning the fields prior to departure, consistent with the requirements outlined in the facility rental agreement. The fee will be imposed to recover the trash service and staff time associated with oversight and coordination of this requirement. The proposed fee is $225 per use and is reflected in the Resolution, Exhibit A, line 39, under the Recreation Services section of the User Fee Schedule. Increase Refundable Security Deposits for Soto Sports Complex Tournaments Staff recommends renaming the existing “Cleaning Deposit” listed under line 47 in the Recreation Services section to “Security Deposit” to better reflect its intended purpose. This deposit is applied when a facility is left in poor condition, equipment or property is damaged, or the terms of the rental agreement are not followed by the event organizer. The current deposit amount is lower than comparable facilities of similar size, which may reduce its effectiveness as a deterrent. Increasing the deposit to $1,033, consistent with the existing security deposit required for the Woman’s Club facility, will bolster compliance with rental agreement requirements and discourage organizers from leaving cleanup Page 223 of 335 Item 10.b. City Council Amendments to the Comprehensive FY 2026-27 User Fee Schedule May 12, 2026 Page 5 items such as sesame seed shells, cigarette butts, and other trash with the expectation that the deposit will simply be forfeited without compliance. This adjustment better aligns the deposit with potential City costs and promotes responsible facility use. The proposed fee of $1,033 per use is reflected in the Resolution, Exhibit A, line 47, under the Recreation Services section of the User Fee Schedule. Increase Basketball & Softball league fees to reflect referee fees Staff recommends an adjustment to the adult league fees for softball and basketball to incorporate the cost of referee and umpire services into the overall league registration fee. Currently, the City charges $671 for adult softball and $594 for adult basketball, exclusive of referee or umpire fees, which are paid directly by each team. Incorporating these costs into the league fee would allow the City to centrally manage and compensate officials, providing greater consistency, accountability, and administrative efficiency. This approach would streamline the payment process for participants and ensure timely and reliable officiating services. The proposed fee for softball is $911 per season; this is using the current fee of $671 and incorporating the $240 cost associated wi th umpire fees. The proposed fee for softball is reflected in the Resolution, Exhibit A, line 90, under the Recreation Services section of the User Fee Schedule. The proposed fee for basketball is $954 per season; this is using the current fee of $594 and incorporating the $360 cost associated with referee fees. The proposed fee for basketball is reflected in the Resolution, Exhibit A, line 91, under the Recreation Services section of the User Fee Schedule. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Adopt a Resolution amending the City’s Comprehensive Fee Schedule with updates to certain User Fees previously adopted by the City Council on March 25, 2025; 2. Modify and adopt the Resolution amending the City’s Comprehensive Fee Schedule with updates to certain User Fees previously adopted by the City Council on March 25, 2025; or 3. Provide other direction to staff. ADVANTAGES: Updating a user fee schedule to incorporate new fees and apply CPI adjustments helps maintain cost recovery by ensuring revenues keep pace with inflation and rising service delivery costs. It promotes fiscal sustainability by providing predictable, incremental increases that reduce the need for large future adjustments or General Fund subsidies . Adding new fees improves fairness and transparency by ensuring users pay for the actual cost of services provided, rather than shifting costs to the broader community. Overall, these updates support stable funding, equitable cost allocation, and continue d service quality. Page 224 of 335 Item 10.b. City Council Amendments to the Comprehensive FY 2026-27 User Fee Schedule May 12, 2026 Page 6 DISADVANTAGES: Updating a user fee schedule to incorporate new fees and apply CPI adjustments may result in higher costs for specific services. When fees do not fully recover the cost of providing those services, the difference must be subsidized by unrestricted revenue sources, which can limit the availability of general revenues for other community priorities. ENVIRONMENTAL REVIEW: Updating user fees set forth in the Comprehensive Fee Schedule is exempt from the California Environmental Quality Act (“CEQA”) because the activity is not a “project” subject to CEQA and it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060 (c)(2) and (3), 15378.) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ESTABLISHING ADDITIONAL USER FEES AND ADJUSTING THE RATES AND CHARGES FOR ALL USER FEES FOR REGULATORY ACTIVITIES, PROGRAMS, AND SERVICES SET FORTH IN THE COMPREHENSIVE FEE SCHEDULE EFFECTIVE JULY 1, 2026 WHEREAS, the City Council of the City of Arroyo Grande (“City”) has authority to establish fees or service charges (“User Fees”) which do not exceed the reasonable cost of providing various City regulatory activities, programs, and services (collectively, the “Services”); and WHEREAS, in July 2022 the City retained Willdan Financial Services, an independent rate consultant, to conduct a user fee study (the “Study”) analyzing the costs of providing Services; and WHEREAS, User Fees are intended to be paid by those utilizing the Services and to reimburse the City for the estimated, reasonable costs of providing said Services; and WHEREAS, the City has established a proposed Comprehensive Fee Schedule, attached hereto as Exhibit “A” based on the Study; and WHEREAS, the City Council has identified the need for additional User Fees to accurately reflect the types of Services the City provides and the City Council now desires to impose the certain additional User Fees identified in this Resolution and to incorporate them in to the Comprehensive Fee Schedule; and WHEREAS, the proposed new User Fees are subject to the provisions of the Mitigation Fee Act, codified pursuant to Government Code section 66000 et. seq., and more specifically the public meeting requirements of section 66016 and the notice and public hearing requirements of section 66018; and WHEREAS, the amount of the User Fees do not exceed the cost of providing the City Services; and WHEREAS, at a duly noticed public hearing, the City Council considered all verbal and written presentations that were made and desires to adopt the User Fees; and WHEREAS, the City Council previously authorized an annual inflationary adjustment to the Comprehensive Fee Schedule and the User Fees therein to annually update the Page 226 of 335 RESOLUTION NO. PAGE 2 amount of the User Fees rates in order to reflect the increased costs of providing the Services due to inflation; and WHEREAS, the Director of Administrative Services has calculated the required inflationary adjustment and proposes the Comprehensive Fee Schedule and the User Fees therein be increased by 3.0% per the City Council adopted methodology based on the Los Angeles Region Consumer Price Index (CPI) of the preceding January; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred . NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Arroyo Grande as follows: 1. The foregoing recitals are true and correct and are incorporated herein by this reference. 2. The City Council finds that all substantive and procedural requirements of the Mitigation Fee Act have been satisfied. 3. The City Council further finds, based upon the information and documents prepared for and presented to the City Council to support this action, that the proposed new User Fees are for the purposes of and necessary for (i) meeting operating expenses, including employee wage rates and benefits; (ii) purchasing or leasing supplies, equipment, or materials; (iii) obtaining funds necessary for the operations and maintenance of City property and facilities; and (iv) any other costs incurred by the City attributable to providing the Services for which the User Fees are imposed. 4. The City Council further finds that the User Fees specified by this Resolution do not exceed the reasonably estimated costs of providing the Services for which the User Fees are imposed. 5. The proposed new User Fees included in this proceeding shall be subject to the same inflationary adjustment as the existing Comprehensive Fee Schedule, to be administratively adjusted annually by modifying the adopted value up or down in conformance with the annual change in the CPI for the Los Angeles region. The factor for the adjustment of the User Fees shall be calculated and established each year by the Director of Administrative Services, based on the reported CPI change as of the immediately preceding January, for User Fee adjustment implementation on July 1 of each year. However, in no event shall the User Fees be increased annually to exceed the costs of providing the Services for which they are imposed. 6. The schedule of User Fees entitled “Comprehensive Fee Schedule” in Exhibit “A” attached hereto is hereby adopted. 7. The approval of the User Fees is exempt from the California Environmental Quality Act (“CEQA”) pursuant to State Guidelines Section State CEQA Guidelines, sections 15060, subd. (c)(2)-(3), 15378 because the activity is not a “project” subject to CEQA and it has no potential to result in either a direct, or reasonably Page 227 of 335 RESOLUTION NO. If any section, subsection, sentence, clause, phase, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such a decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have passed this Resolution and each section, subsection, sentence, clause, or phase thereof irrespective of the fact that any one of or more sections, subsections, clauses, or phases be declared unconstitutional on their face or as applied.
