fu~ORDINANCE OF THE CITY OF ARROYO G~~DE APPROV-
ING THE ANNEXATION TO SAID CITY OF CERTAIN UNIN~
HABITED TERRITORY DESIGNATED "HALCYON ROAD NO. 2
ANNEXATION. "
WHEREAS, pursuant to the provisions of Section 35015 of the Government
Code of the State of California, territory proposed to be annexed to a city
may be annexed by the legislative body of the city without notice and hear-
ing and without an election, if all of the owners of the land within such
territory consent in writing to such annexation; and
WHEREAS, a petition signed by the owner of all of the real property
in the area described herein, more commonly known as the Halcyon Road No, 2
Annexation, has requested the proposed annexation and consented and agreed
that such property shall be subjected to taxation after such annexation
equally with property within the City of Arroyo Grande to pay the bonded
indebtedness of' the City of Arroyo Grande outstanding or authorized at the
date of the first publication of the notice of election for the acquisition,
construction, or completion of the municipal improvements; and
WHEREAS, no written protests against the annexation have been filed;
and
WHEREAS, the proposed annexation including the legal description of
the territory to be annexed had already been approved by the San Luis
Obispo County Local Agency Formation Commission on May 13, 1971 by Resolu-
tion No. 71-9; and
WHEREAS, the Local Agency Formation Commission has authorized the City
to complete the Halcyon Road No. 2 Annexation without further notice, hear-
ing or election and it appears that all proceedings relating to said annex-
ation have been conducted strictly in accordance with law.
NOW.> THEREFORE, BE IT ORDAINED by the Council of the City of Arroyo
Grande as follows~
SECTION 1. That the annexation of uninhabited territory contiguous
to the City of Arroyo Grande designated as "Halcyon Road No. 2 Annexation"
be and the same is hereby approved and the real property in said annexation
shall be subject to taxation equally with the property within the City of
Arroyo Grande to pay the bonded indebtedness of the City of Arroyo Grande
outstanding or authorized at the date of the first publication of the notice
of election for the acquisition, construction, or completion of the munici-
pal improvements. Said territory is located in the County of San Luis Obispo,
State of California, and is described as follows:
Part of Lot lOB of Stratton's Survey of the Ranchos Corral de Piedra,
Pismo and Bolsa de Chamisal, San Luis Obispo County, California, according
to map thereof filed in Book A of Maps at Page 65 in the office of the
County Recorder, more particularly described as follows:
Beginning at a point on the east line of 40 foot wide Halcyon Road which
bears South 890 34' West 10.00 feet from point S 256, the southwest corner of
said Lot 108, said point also being a point on the north line of Fair Oaks
No.4, an annexation to the City of Arroyo Grande, approved by the Secretary
of State on the 19th day of January, 1959; and proceeding thence along the
boundaries of the said annexation, South 890 34' West to a point on the
westerly line of said Halcyon Road; thence North along the westerly line of
said Halcyon Road and the easterly line of said Fair Oaks No. 4 annexation
and the easterly line of Tract No. 75 annexation, approved by the Secretary
of State on the 16th day of October, 1952, to the south line of the Mineau-
Loomis-Odell annexation, approved by the Secretary of State on the 19th day
of June, 1948; thence along the said southerly line of the Mineau-Loomis-
Odell annexation easterly to the easterly Une of said 40 foot wide Halcyon
Road; thence northerly to its intersection with the westerly prolongation of
the northerly line of Halcyon Road No. 1 annexation to the City of Arroyo
Grande approved by the Secretary of State On the 30th day of November, 1970;
thence Easterly along said westerly prolongation to the westerly line of said
Halcyon Road No. I annexation; thence southerly along said westerly line of
said Halcyon Road No. I annexation to the southwest corner thereof; thence
East 842,75 feet along the southerly line of said Halcyon Road No. 1 annexa-
tion to the southeast corner thereof; thence South 40 43' 30" East 512.58
