LaVine hereinafter referred to joinfly as "Owner"), based on the following facts: � RECITA�.S vV]E�ERTAS, Owner is the fee owner of that certain parcel of real ProPeriY �the °Pr°PertY°) generally described as situated at 238 West Branch Street, Assessor's Parcel Number 007-186-052, City of Arroyo Grande, County of San Lui,s Obispo, California, more specifically described and depicted upon Fxhibits "A" and "B" attache�l hereto and incorporatsd herein; and WHEREAS, the property is situated in a single family zone within the City; and VVHEREAS, Owner resides in an existing single family home on the property, and Owner desires to convert an existing studio into a 540 square foot second residential unit on the property; and VVIEiER�AS, second residential units are, as of this date, pernutted in single-family zones only with approval by the City of a Conditional Use Permit after a public hearing has been held; . and V�V�RF�AS, after holding the required public hearing, the Planning Commission of the City of Arroyo Grande approved Conditional Use Pernut Case Number 97-551 (the "CUP") for a second residential unit. on the property; and WHEREAS, the City's Development Code and the conditions of approval of the CUP require that recorded notice be given of the restrictions that apply to second residential units in the City. NpW, THEREFORE, in consideration of the foregoing and the following mutual promises, covenants and conditions, the parties agree as follows: 1.
