Tfiis Agreement, dated 7une 17, 1997, for the convenience of the parties is made by and
between the City of Arroyo Grande (hereinafter "City") and Mary A. Adams (hereinafter referred
to jointly as "Owne�") based on the following facts:

WI�REAS, Owner is the fee owner of th�'certain parcel �of real property (the "property")
generally described as situatsd at 615 Myrtle S�feet, Assessor's Parcel Number 007-511-019, City
of Arroyo Grande, County of San Luis F�ispo, California, more specifically described and
depictsd upon Exhibits "A" and "B" attached hereto and incorporated herein; and
V'V]HER�AS, the property is situated in a single family wne.within the City; and
�� , Owner resides in an existing single family home on the property, and Owner
desires to convert the single family residence into a 623 square foot second residential unit on the
property; and
V'Vl�, second units are, as of this date, pernutted in single-family zones only with a
City Conditional Use Pennit after public hearing; and
�+ S, after holding the requ;reci public hearing, the Planning Commission of the
City of Anoyo Grande approved Conditional Use Permit Case Number 97 (the "CUP") for a
second residential unit on the property; and
�+ , the City's Development Code and the conditions of approval of the CUP
requires that recorded notice be given of the restrictions that apply to second residential units in the
City.
NOW, T�FORE, in consideration of the foregoing and the following mutual
promises, covenants and conditions, the parties agree as follows:
1. If either the primary residence or the second residential unit located on the property is
rentsd, the odier shall be owner occupied.

2 The s�ond residential unit located on the property shall not be offered for sale.
3, The occupant of the second residential unit located on the property shall have the use of one

4. lfiis agreement shall run with the land and shall be binding upon, and inure to the be,nefit
of, all successors in int,erest in any manner of the parties hereto.
