AMENDMENT TO DECLARATION OF COVENANTS,
CONDITIONS AND RESTRICTIONS
Lots 1 through 70, Tract 1158
City of Arroyo Grande, County of San Luis Obispo, California
That certain Declaration of Covenants, Conditions and Restrictions ("the Declaration") recorded
Apri124, 1985, in Volume 2699, Pages 575-580, Official Records of San Luis Obispo County,
is hereby amended as follows:
1. In lieu of maintenance of the sidewalk, and the landscape strip adjoining the
sidewalk, along Oak park Boulevard by the Oak Park Villas Homeowners Association, such
maintenance shall hereafter be performed by the City of Arroyo Grande.
2. In lieu of the levying of annual charges against each lot by the Association, the City
of Arroyo Grande shall annually charge each lot within Tract No. 1158 (the "Tract") the flat sum
of $60.00 to cover all mairitenance obligations for which the Association is now responsible and
the City's administrative expenses incurred in connection therewith. The recordation of this
instrument shall constitute a binding agreement on behalf of each lot owner to pay such charges.
The right to enforce collection of such charges is hereby delegated from the Association to the
City of Arroyo Grande.
3. The City may elect to have annual charges specified herein collected on the tax roll
in any forthcoming fiscal year in the same manner, by the same persons, and at the same time as,
together with and not separately from, its other taxes.
4. As an alternative to other available collection procedures for said annual charges,
the City may record, in the Office of the San Luis Obispo County Recorder, a certificate
specifying the amount, the name and last known address of the person liable therefor, and that
such charges remain delinquent for a period of sixty (60) days. From the time of recordation of
the certificate, the amount required to be paid for such charges constitutes a lien upon all real
property of the delinquent property owner in the County. The lien created by recording the

certificate shall have the force, effect, and priority of a judgment lien and shall continue from the
time of recording unless sooner released or otherwise discharged.
S. Each lot owner within the Tract agrees to, and shall maintain and keep in good
condition that portion of the perimeter fencing surrounding the project which abuts each lot
owner's property.
6. The Oak Park Villas Homeowners Association is hereby dissolved.

7. This instrument shall not be amended without the prior written consent of the City
of Arroyo Grande.
