This Agreement, dated s��7, 1994, for the convenience of the parties is by and
between the City of Arroyo Grande (hereinafter "City") and Richard A. and Patricia L. Shaffer
(hereinafter referred to jointly as "Owner"). �
RECITALS
WHEREAS, Owner is the fee owner of that certain parcel of real pmperty generally
described as situated at 700 White Court, Assessor's Pazcel Number 007-241-023, City of
Arroyo Grande, County of San Luis Obispo, California, more specifically described and depicted
upon Exhibits "A" and "B" attached hereto and incorporated herein;. and
WHEREAS, said real property is situated in a single family zone of the City; and
WHEREAS, Owner resides in an existing single family home on said Fxhibit "A"
property, and Owner desires to construct a 500 square foot second residential unit on said
property; and
WHEREAS, second units are, as of this a date, pernutted in single-family zones only
with a City Conditional Use Permit after public hearing; and
WHF.RF.AS after holding the required public hearing, the Planning Commission of the
City of Arroyo Grande approved Conditional IIse Permit Case Number 94-521 for a second
residential unit on said Exhibits "A" and "B" property; and
�'VHEREAS, City desires to give recorded notice to all persons, and especially
subsequent owners, of the restrictions that apply to second residential units in the City.
NOW, THEREFORE, in consideration of the foregoing a�id the following mutual
promises, covenants and conditions, the parties agree as follows:
1. If either the primary residence or the second residential unit is rented, the other shall be
� owner occupied.
2. The second residential unit shall be used for rental purposes only and shall not be offered
for sale.

The occupant of the second residential unit shall have the use of one garaged parking
space and one open pazking sgace.
The agreement shall run with the land and shall be binding upon, and inure to the benefit
of, all successors in interest in any manner of the parties hereto. Facecuted in Arroyo
Grande, California, on the date first written above.
