AGREEMENT AFFECTING REAL PROPERTY
This Agreement, dated _ Mav 14. 1991 . for the convenience of the parties is by and
beiween the City of Arroyo Grande (hereinaiter "City") and Wayne and Beth Pierce (hereinafter
referred to joinUy as "Owner'�.
RECITALS
WHEREAS, Owner is the fee owner of that certain parcel of real property generally

described as situated at 189 Deer Trail Circle, City of Arroyo Grande, County of San Lufs Obispo,
Caiffomia, specifically described as 1ot 8 of tract 675, recwded in book 9 of Maps page 70 in the
office of the recorder of the County of San Lu(s Obispo, State of Califomia.
WHEREAS, sald reai property is situated in a single family zone of the City; and
� WHEREAS, Owner resides in an existtng single family home on said property, and
Owner desires to construct a 638 square foot second residential unit on said pioperty; and
WHEREAS,second units are, as of this a date, perm(tted in single-famfly zones only with
a City CondiUonal Use Permit after public hearing; and
WHEREAS, atter holding the required pubUc hauing, the Planning Commiss(on of the
City of Arroyo Grande approved Condltional. Use Permit Case Number 89-451 for a second
resldential unn on sald property; and

WHEREAS, City deslres to give recorded noUce to all persons, and especially
subsequent owners, of the restrlctions that appiy to second residential units In the Cfty.
NOW, TMEREFORE, in consideration of the foregoing and the following mutual
promfses, covenants and con�itions, ths pariies agree �3 fo!lu:ti�s:

Occupancy of the second residenUal unit shali be limited to a maxlmum of two (2)
persons.
Either the primary residence or the second residential unit shali be owner occupied at all
times. Using both units simultaneously as rental unfts ts prohibfted.

3. The second resldential unit shail be used for rental purposes only and shall not be offered
for sale. -

Owner represents and warrants that the fee owner and Ilenholder signatories hereto are
the only owners and lisnholders now of record concerning the subject property.
However, nothf�g heretn shall be consVuod or appltod to requlre the Owner ta obtain City
approval or permission for any sale, Vansfer, encumbrance, or similar action affecting the
real property subsequent hereta
5. The agreement shall run with the land and shall be binding upon, and (nure to the benefit
of, all successors in tnterest (n any manner of the parties hereto. Executed in Arroyo
Grande, California, on the date first written above.
