This P,greement, dated d� 1 �� Q ��� �for the convenience of the
parties is by and between the City of Arroyo Grande (hereinafter "City") and
Antony C. Sabino (hereinafter referred to jointly as "Owner").
RECITAi.S
WE�RFAS, Owner is the fee owner of that certain parcel of real property
generally described as situated at 1053 Ash Street, City of Arroyo Grande, Co�ty
of San Luis Obispo, California, more specifically described and depicted upon
Exhibit "A" attached hereto and incorporated herein; and
WE�iF1�.S, said real property is situated in a single family zone of the
City; and
Fffffi2EAS, Owner resides in an existinq sinqle family hane on said Exhibit
"A" property, and Owner desires to construct a 496 square foot second residential
unit on said property; and -
�.5, second-units are, as of this a date, permitted in sinqle-family
zones aaily with a City Conditional Use Permit after public hearing; and
FII�RFAS, after holdinq the required public hearing, the Planning Camnssion
of the City of Arroyo Grande approved Conditional Use Permit Case No. 89-454 for
a seco�d residential unit o� said Exhibit "A" property; and
F�.S, City desires to give recorded notice to all persoa�s, and
especially suhsequent owners, of the restrictions that apply to second
residential �its in the City.
NIOW, T�E, in consideratio¢� of the foregoing and the following mutual
pranises, covenants and conditions, the parties agree as follows:
1. Occupancy of the secoa�d residential unit shall be limited to a maxim�an of
two (2) persons.

2. Either the primary residence of the second residential w�it shall be owner
occupied at all times. Using bothiuiits simultaneously as rentai units is
prohibited.
3. '1"he second residential unit shall be used for rental purposes only and
shall not be offered for sale.
4. Owner represents and warrants that the fee owner and lienholder
signatories hereto are the only owners and lienholders now of record
concerning the Exhibit "A" property. However, nothing herein shall be
construed or applied to require the Owner to obtain City approval or
permission for any sale, transfer, encunbrance, or similar actiari
affecting the real property subsequent hereto.
5. 4'he agreanent shall nm with the land and shall be binding upoai, and inure
to the benefit of, all successors in interest in any manner of the parties
hereto. Executed in Arroyo Grande, California, on the date first written.

Arroyo Grande, County of San Luis Obispo, State of California,
according to map recorded November 18, 1926 in Book 3, Page 82 of
maps, described as follows:
Beginning at the Northeast corner of said lot:
Thence south along the east line thereof 222.5 feet to the
Northeast corner of the property conveyed to A. L. Teaque, et us,
by deed dated October 3, 1949, and recorded October 21, 1949 in
Book 538, Page 584 of official records; Thence west alonq the north
line of the property so conveyed 108.1 feet to the east line
thereof;
Thence north al ong said east 1 ine 97 . 5 feet to the southwest corner
of the property conveyed to Jennie J. Johnson, an unmarried woman,
by deed dated September 24, 1952 and recorded September 29, 1952 in
Book 678 Paqe 11 of official records; Thence east along the south
line of the property so conveyed 50 feet, to the southeast corner
thereof ;
Thence north al ong the east 1 ine of the property conveyed to Jennie
J. Johnson as aforesaid 125 feet to the northeast corner thereof;
thence east al ong the north 1 ine of said 1 ot 58 .1 feet to the point
of beginning. '
