This Agreement, dated �y 9 � 1989 , Yor the convenience of the
part ies i s by and between the Ci ty;of Arroyo Grande (hereinafter "Ci ty°) and Drew L.
Brandy and M. Sharon Brandy (hereinafter referred to jointly as "Owner").
RBCITALS �
{�RFAS, O�er is the fee a�er of that certain parcel of real property
general ly dscribed as situated at 444'PoyonCourt, Ci ty of Arroyo Grande, County of
Sanluis Obiapo, CaliPornia, more specifically described and depicted upon Exhibit
"A" attached hereto and incorporated herein; and ,
V1�REAS, said real property is situated in a single femily zone of the City;

property, and0�er desires to enlarge said hane by the addition of a bedroan, living
roan, bathroan and other living accamiodations which will add approximetely 594
square feet to the existing hane; and

added outside entrance to the new living area poses a subatantiel potentiel for
creation of a second living unit without City knowledge or approval; and ��'

pranises, covenants and conditions, tt►c parties agree as follawss
1. The residence on the Exhibit "A" real property shall be used only for single-
fmnily purposes, unless the City approves aConditional Use Permit for a second
living unit.

seprate kitchen or cooking facilities within said residence shall be prima
facie evidence of a second living unit.
3. If theCity is required to institute an action or proceeding, civil or criminal,
to abate an illegal second wit on saidExhibit "A" property, theCitymay seek
to require O�er to pay all relocation costs of a second unit tenant shown to
have no knowledge of the illegality of the second unit.
4. Owner represents and warrants that the fee owner and lienholder signatories
hereto are the only awners and lienholders now of record concerning the Exhibit
"A" property. However,nothing herein shallbe construed or applied to require
the Oqmer to obtain City approval or permission for any sale, transfer,
encuribrance, or similar action affecting the real property subsequent hereto.
5. 'tt�is agreement shsl l run with the land and shall be binding upon, and inure to
the benefit of, ell successors in interest in any rtnnner of the prties hereto.
