THIS AGREEMENT, entered into'this �day of February, 1986, by
and between KARL A. HOGAN and SONDRA J. HOGAN (Hogans), and the CITY OF
ARROYO GRANDE, a Municipal Corporation (City):
RECITALS:
A. Hogans own certain real property in the City of Arroyo Grande,
County of San Luis Obispo, California, more particularly described in
Exhibit A, attached hereto, and commonly known as 1260 Poplar, Arroyo
Grande, on which is located a duplex structure and studio apartment.

scribed in:Exhibit B, �ttached hereto, and commonly known as 1270 Poplar,
Arroyo Grande; on which'is located three sinqle famil,y residences to-
gether with four garage stalls.
C. Applicable building and zoning ordinances of the City require
that one additional covered garage space be made available to 1260
Poplar, and Hogans are willing to commit one such garage space at 1270
Poplar for such purpose, pursuant to the terms and'conditions hereinafter
set forth.
NOW, THEREFORE, the parties hereto agree as follows:
1. Hogans shall make available to and for the benefit of the occu-
pant of the studio apartment at 1260 Poplar the center parking stall of
the existing qarage at 1270 Poplar, for vehiCle parking purposes. Such
right shall include necessary and reasonable ingress and egress and
pedestrian use of 1270 Poplar for such use.
2. Hogans shall nota transfer ownership of 1270 Poplar to another
party unless and until they have constructed an additional covered park-
ing space at 1260 Poplar. Upon construction of such additional parking

space, this Agreement shall be null and void, and City shall execute any
documents necessary to cancel said Agreement of record.
3. In the event of any litigation arising under or by virtue of
this Agreement or any provision thereof, the prevailing party shall be
entitled to an award of reasonable attorney's .fees, toqether with such
other relief as may otherwise be awarded by the Court.
4. This Agreement shall run with the land herein described and be
binding on all parties having or acquiring any right, title, or interest
in the property or any portion thereof.
