MINUTES
REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, OCTOBER 25, 1994
CITY COUNCIL CHAMBERS, 215 EAST BRANCH STREET
ARROYO GRANDE, CALIFORNIA
The City Council of the City of Arroyo Grande met at 7:30
P.M., with Mayor Matthew Peter Gallagher, III, presiding.
1 AND 2. FLAG SALUTE AND INVOCATION
Mayor Gallagher led the Pledge of Allegiance to our Flag,
and the Rev. James Wickstrom of Berean Bible Church delivered the
invocation.
3. ROLL CALL
Present with Mayor Gallagher were Council Members Bernard
Burke, Michael Lady and James Souza. Council Member Drew Brandy
was absent. Staff Members present were City Manager Chris
Christiansen, City Attorney Roger Lyon, City Clerk Nancy Davis
and Deputy Public Works Director Avelino Lampitoc.

No one came forward to speak.
5. CONSENT AGENDA
It was moved by Burke/Lady, and the motion passed
unanimously to approve Consent Agenda Items 5.a. through 5.e.,
with the recommended courses of action.
5.a. Proclamation, "Countdown to Construction Month, South County
Performing Arts Center," November, 1994. Mayor Gallagher
presented the proclamation to Clifford Clark. Mr. Clark said the
Performing Arts Center will draw tourists to the City. He said
the Center users will be groups from all over the County,
including Cuesta College. He said groups in Northern Santa
Barbara County also have expressed interest in presenting events
at the theater.
5.b. Proclamation, "Filipino American History Month," October,
1994. Mayor Gallagher presented the proclamation to Ernie
Cabreana, president of the California Central Coast Chapter,
Filipino American National History Society. He said Gabe deLeon,
former mayor of Arroyo Grande, was the first mayor of Filipino
descent in the United States. Mr. Cabreana said the mission of
the local chapter of the society is to help share a legacy of the
early Filipino pioneers and their families on the Central Coast.
He said the first Filipino, documented as having landed on the
shores of the United States, landed in Morro Bay.

5.e. Adjustment to Police Department Budget Due to Increased
Costs for the Narcotics Task Force. Approved.
6 REGISTER OF CHECKS
It was moved by Burke/Souza and the motion passed
unanimously to approve cash disbursements in the amount of
$717,052.70, as listed in the October 20, 1994, Staff Report of
Finance Director David Bacon.
7 A POSSIBLE CANCELLATION OF COUNCIL MEETING OF NOVEMBER 8
1994, DUE TO 1994 ELECTION
Mr. Christiansen recommended that the meeting of November 8,
1994, be cancelled because it would fall on Election Night. He
said if necessary a special meeting on another date could be
called.
It was moved by Burke/Lady, and the motion passed
unanimously to cancel the City Council meeting of November 8,
1994.
7 B APPOINTMENT OF ROBERT T. FEE TO THE SENIOR ADVISORY
COMMISSION; TERM EXPIRES JUNE 30 1996
Mayor Gallagher nominated Robert T. Fee to the Senior
Advisory Commission, and Council Members approved of the
nomination.
7 C JOINT AGREEMENT FOR SUBSIDIZED TAXI SERVICES FOR SENIOR
CITIZENS AND DISABLED RESIDENTS OF THE CITIES OF ARROYO GRANDE,
GROVER BEACH AND PISMO BEACH AND THE COMMUNITY OF OCEANO
Mr. Christiansen said the barriers regarding the taxi
subsidies have been dropped between the cities of Arroyo Grande,
Grover Beach, Pismo Beach and OCEANO. He said the taxi company
operators now must be insured for $1 million, and hopefully the
cities have found a competent new operator.
It was moved by Burke/Souza, and the motion passed
unanimously to approve the Joint Agreement for Subsidized Taxi
Services for Senior Citizens and Disabled Residents of the Cities
of Arroyo Grande, Grover Beach, and Pismo Beach and the Community
of Oceano.
7 D RESOLUTION AUTHORIZING EXTENSION OF EXISTING COOPERATIVE
AGREEMENT REGARDING THE USE OF MORTGAGE CREDIT CERTIFICATES IN
THE CITY OF ARROYO GRANDE AND AUTHORIZING APPLICATION FOR
ADDITIONAL MCC AUTHORITY
Mr. Christiansen referred to the October 17, 1994, letter

from George J. Moylan, executive Director -Secretary of the San
Luis Obispo Housing Authority, concerning support for requests
for additional allocations. Mr. Christiansen said about a year
ago the Council approved an agreement regarding the use of
mortgage credit certificates in the amount of $8 million via the
San Luis Obispo Housing Authority. He said -those monies have
been expended and the authority is requesting support for an
amount of $10 million. He said the monies would be used for the
purchase of homes for low income individuals. He recommended
adopting a resolution approving the request.
Council Member Burke asked if their was any liability on the
part of the City, and Mr. Christiansen said no. Mrs. Carol
Hatley, Finance Director for the Housing Authority, said the
program had been very successful and 51 percent of the buyers
could not have qualified for home ownership without the benefits
of the Mortgage Credit Certificate program.
It was moved by Burke/Lady (4-0-1, Burke, Lady, Souza and
Gallagher voting aye, Brandy absent) to approve Resolution No.
3058 Authorizing Extension of Existing Cooperative Agreement
Regarding the Use of Mortgage Credit Certificates in the City of
Arroyo Grande and authorizing Application for Additional MCC
Authority.
7.E. REPORTS FROM VARIOUS COMMITTEES:
1. South San Luis Obispo County Sanitation District. Mayor
Gallagher said the district is in the process of the shellfish
monitoring program to determine the contamination of offshore
shellfish. He said the first results show that the district is
well below the standards set by the Regional Water Quality
Control Board. He said there is discussion of Grover Beach
joining the board. He said the district entered into a study and
analysis with Cal Poly to investigate the feasibility of a
cogeneration plant within the Sanitation District. He said the
district's financial audit was favorable.
2. South County Area Transit (SCAT). Council Member Burke said
there would be no report on SCAT or the South County Regional
Transit Authority.
3. Council of Governments (COG). Council Member Burke said the
COG passed a resolution pertaining to the transportation funding
shortfall of $4.9 million. He said the resolution (1) requested
that the State resolve the matter of seismic retrofit funding so
it would not jeopardize the funding of much -needed projects
already on the books, (2) placed higher priority on the ready -to -
go projects involving local -federal matching programs, and (3)
requested Congress to appropriate full funding as authorized by

the Federal Transportation Efficiency Act of 1991.
4. Integrated Waste Management Authority (IWMA) Board. Council
Member Lady said there would be no report, and that the next
meeting would be November 9, 1994. He said the board is waiting
to hear if the cities of Paso Robles and Atascadero will join the
Joint Powers Agreement.
5. Zone 3 Water Advisory Committee. No Report
6. County Water Advisory Board. No Report.
7. Long -Range Plan Update Committee. Council Member Souza said
Alex Hinds, County Planning Director, spoke at the last committee
meeting. He said traffic mitigation fees on County fringe
projects were discussed, and Mr. Hinds said County staff has been
directed to work with the cities on this. Council Member Souza
said he asked Mr. Hinds about fringe well usage affecting the
Arroyo Grande water basin, and was given the impression that the
matter was an inexact science. He said the County is planning to
decrease the size of second units ("granny houses") to 640 square
feet. He said the committee would met again October 26, 1994.
Council Member Souza said the Long -Range Plan Update
Committee also is the steering committee for the Omni -Means study
of Short Range Improvements on East Branch Street; Circulation
Element; Alignment Study; AB 1600; and Environmental Analysis on
these projects. He said Omni -Means representatives met with the
steering committee and asked for input on improvements on East
Branch Street.
8. Chamber of Commerce Economic Development Committee. Council
Member Souza said Economic Development Committee representatives
had made a presentation to the Council at the October 11, 1994,
meeting. He asked the City Manager where matters stand on a
response to their presentation. He said it was his understanding
that Staff was going to look at those recommendations and
alternatives and the two groups would get together and bring a
report back to the Council. Mr. Christiansen said the sub-
committee made up of Council Member Lady, Grover Beach City
Manager Penelope Culbreth-Graft and Chief of Police Rick TerBorch
met and were working on a report. Council Member Lady said a
report would be coming shortly. He said there were some good
ideas for consideration and the report would be ready shortly.
Council Member Souza said it was his impression that the EDC
would study the report and the two groups would come up with a
final proposal for the Council. Mr. Christiansen and Council
Member Lady agreed with that statement.

9. Coordinated Agriculture Support Program (GASP). Council
Member Souza said the final report is available, but the State
Coastal Commission will be providing additional economic analysis
data to include. He said an extension of the grant has been
received and it is valid until September, 1995.
10. Air Pollution Control Board. No Report.
8. WRITTEN COMMUNICATIONS

9. ORAL COMMUNICATIONS
None.
10. CLOSED SESSION
Upon the unanimously approved motion of Souza/Burke, the
Council adjourned at 8:10 P.M. to a Closed Session on the
following:

11. ADJOURNMENT
Upon the unanimously approved motion of Burke/Lady, the
Council reconvened at 8:20 P.M. and immediately adjourned the
