� A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT CASE
NO. 10-005 8 ADMINISTRATIVE SIGN PERMIT 10-015;
ESTABLISHMENT OF A 5,100 SQUARE FOOT CHASE BANK; 900
RANCHO.PARKWAY
WHEREAS, the applicant proposes to establish a 5,100 square foot Chase Bank within
an existing commercial building; and
WHEREAS, the property is zoned Regional Commercial; and
WHEREAS, the property is currently developed with a 40 acre commercial center; and
WHEREAS, Municipal Code Table 16.36.030.A requires the approval of a Conditional
Use Permit to establish Bank/Financial Services within the Regional Commercial
Center; and
WHEREAS, on October 19, 2010, the Planning Commission reviewed the project at a
duly noticed public hearing; and
-- WHEREAS, the Planning Commission finds that this project is consistent with the City's
General Plan, Development Code; and
WHEREAS, the Planning Commission finds, after d�e st�ady, deliberation and public
� hearing, the following circumstances exist:
FINDINGS FOR APPROVAL
1. The proposed use is permitted within the subject district pursuant to the
provisions of this section and complies with all the applicable provisions of
this title, the goals, and objectives of the Arroyo Grande General Plan,
and the development policies and standards of the city.
Ban�nancial services are permitted in the Regional Commercial zoning
district if approved by a Conditional Use Permit. The Five Cities Center is
a 40 acre commercia/ center developed for multi-tenant retail and
services. The General Plan indicates locating Regional Commercial uses
along the 101 freeway corridor.
2. The proposed use would not impair the integrity and character of the
district in which it is to be established or located.
' The proposed use is to be located within an exisfing commercial building
-- and signs and the installation of automated teller machines will present
minor changes to the building's exterior.

3. The site is suitable for the type and intensity of use or development that is
proposed.
The Five Cities Center is 40 acres in size and is developed as a regional
commercial center. The development includes adequate access and
parking facilities. The proposed bank will be located within existing tenant
space.
4. There are adequate provisions for water, sanitation, and public utilities and
services to ensure public health and safety.
The property is served by public infrastructure including ufilities and
streets. There is no substantial change in the intensity of use.
. 5. The proposed use will not be detrimental to the public health, safety or welfare or
materially injurious to properties and improvements in the vicinity.
The proposed use will not be detrimental to the public health, safety or
. welfare or materially injurious to properties and improvemenfs in the
vicinity since the proposed development adheres to the General Plan and
development standards of the Municipal Code.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby approves the establishment of a Chase Bank with the above
findings and subject to the conditions as set forth in Exhibit "A", attached hereto and
. incorporated herein by this reference.
On a motion by Commissioner Ruth, seconded by Commissioner Barneich, and by the
following roll call vote to wit:
AYES: Commissioners Ruth, Barneich, Brown, Keen and Martin

ESTABLISHMENT OF A CHASE BANK
Conditions of Approval
Planninq Division
1. The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Conditional Use
Permit 10-005.
3. This Conditional Use Permit shall automatically expire on October 19, 2012 unless
a building permit is issued or an extension is granted pursuant to Section
16.12.140 of the Development Code.
4. The applicant shall agree to defend at his/her sole expense any action brought
against the City, its present or former agents, officers, or employees because of
the issuance of said approval, or in anyway relating to the implementation
� thereof, or in the alternative, to relinquish such approval. The applicant shall _
reimburse the City, its agents, officers, or employees, for any court costs and
attorney's fees which the City, its agents, officers or employees may be required
by a court to pay as a result of such action. The City may, at its sole discretion,
participate at its own expense in the defense of any such action but such
participation shall not relieve applicant of his/her obligations under this condition.
5. Proposed Sign Number 4 (south facing wall) shall not be place on the building.
� All other development shall occur in substantial conformance with the plans
presented at the Planning Commission on October 19, 2010 and the plans dated
September 10, 2010 on file in the Community Development Department.
6. The applicant shall install lighting under the front fa�ade canopy to assist in ATM
security to the satisfaction of the Director of Community Development.

7. The project shall comply with the most recent editions of all California Building and
Fire Codes, as adopted by the City of Arroyo Grande.
8. Provide complete compliance with the State and Federal Disability access
requirements.
9. Provide Fire Sprinkler test to the satisfaction of the Building Official.

10. No reflective or opaque window film shall be installed.
