SUBJECT: CONSIDERATION OF REAL TOR LISTING AGREEMENT, LISTING PRICES AND UTILITIES INSTALLATION FOR SALE OF OLD RANCH ROAD PROPERTIES DATE: MARCH 26, 2013 RECOMMENDATION: It is recommended the City Council: 1) approve an exclusive listing agreement with Lenny Jones of Jones Goodell & Associates to sell three City-owned lots on Old Ranch Road; 2) approve listing prices of $275,000, $269,000, and $259,000 for the three lots; 3) authorize the City Manager to approve counter offers contingent upon City Council approval; and 4) appropriate $30,000 from the Sewer Fund and $70,000 from the Water Fund and authorize the City Manager to approve a contract to the lowest responsible bidder to install sewer and water line connections to the lots. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The sale of the lots is intended to generate revenue for construction of the new police station. The $100,000 in utility funds for improvements is proposed to be reimbursed from the proceeds of the sale. This cost was not considered in the original revenue estimates. The commission for realtor services is proposed to be 2% to the listing agent, 2.5% to the selling agent, and 4% if listing agent also represents the buyer. The sale will result in additional staff time for the City Manager and City Attorney and the improvements will require staff time for Public Works staff to coordinate. However, the Police station project has been established as a priority in the Critical Needs Action Plan. BACKGROUND: When the Recreation Center project was proposed at the City property on West Branch Street and Old Ranch Road, it was determined that the east portion of the property was not needed and could be better used to sell for residential use to generate revenue for the project. Sale of the property for private development required removal of a deed restriction by the County, which previously restricted the property to be used for a public purpose. This was accomplished in conjunction with rezoning of nearby County owned property. The excess portion of the City property was subdivided into four residential lots, each in the range of 10,000 square feet. Three of the four lots are now proposed to be sold to generate revenue for the Police station project. This revenue was assumed in the funding plan for both project alternatives approved by the City Council at the November 27, 2012 meeting. At that meeting, the City Council also directed staff to prepare a recommended process for sale of the three residential lots on Old Ranch Road. The process was approved by the City Council at the January 22, 2013 meeting. ANALYSIS OF ISSUES: A Request for Proposal (RFP) was distributed to all realtors in Arroyo Grande. Five proposals were received, which were evaluated by a Selection Committee composed of Council Member Ray, Planning Commissioner Barneich, and Community Development Director McClish. Proposals were ranked based on approach, commission, work plan, community involvement, qualifications, experience, and overall ability to meet the City's needs. As a result, the Jones Goodel and Associates proposal was ranked the highest and recommended by the Committee for award of the listing. A copy of the RFP and proposal are attached. The City Manager and Lenny Jones, the listing real estate agent met and reviewed comparable sales. As a result, listing prices of $275,000, $269,000, and $259,000 are recommended for the three lots. In order to facilitate the process, it is recommended to authorize the City Manager to accept counter offers. However, they would be contingent upon Council approval. It is also recommended to appropriate funding and authorize the City Manager to enter into a contract to provide water and sewer connections to the lots. Staff believes these connections are necessary in order to make sale of the lots feasible for individual buyers. Therefore, the improvements will make the sale more competitive and likely result in significantly higher sale prices. ADVANTAGES: Approval of staff's recommendations will enable the City to proceed with sale of the lots to generate revenue for the police station project and will likely result in the highest value for the properties. DISADVANTAGES: Installation of the utilities will be more expensive for the City to construct since the work will be subject to prevailing wage requirements. Cost of the work could be reduced if the lots were all purchased by one developer since they would not be required to pay prevailing wage. However, this would limit potential buyers. ENVIRONMENTAL REVIEW: Environmental review was accomplished through the subdivision process. PROPOSAL INTENT CITY OF ARROYO GRANDE REAL TOR SERVICES REQUEST FOR PROPOSALS FEBRUARY 2013 Attachment 2 The City of Arroyo Grande, California intends to contract with a local Arroyo Grande realtor to list, market and represent the City in the sale of three residential lots. Only realtors whose offices are located within the City of Arroyo Grande incorporated area are eligible. II. BACKGROUND The City owns an approximately 5 acre vacant parcel on the corner of West Branch Street and Old Ranch Road. A recreation center project proposed by a local non-profit foundation has been approved on the site. The City Council has also approved a plan to construct a new police station on a portion of the property if the recreation center project does not proceed. It was determined that the east portion of the property was not needed for either project and could be better used to sell for residential use to generate revenue. The property narrows as it extends up Old Ranch Road, and providing property for future residential development can create a buffer between the existing residences and whatever project is constructed on the main portion of the City parcel. The fourth lot will be retained for potential use as secondary access to the police station or parking for the recreation center. 111. SCOPE OF WORK The City is interested in contracting with a realtor to provide services including, but not limited to, the following tasks: A. Advise the City on establishing a listing price; B. List the properties; C. Market the properties; Item 8.e. - Page 21 D. Show the properties to potential buyers; E. Represent the City in negotiations; F. Coordinate escrow(s) and closing(s); and G. Prepare and process all necessary documents for the sale of each property. IV. PROPOSAL FORMAT AND CONTENT Each proposal shall include as a minimum the following information in this format: A. Introduction Present an introduction to the proposal describing the agent's and the firm's understanding of the desired work, strengths and service philosophy. B. Qualifications Include the following information for the agent and firm: 1 . Professional background 2. Resume 3. List of recent sales of comparable properties 4. References 5. Community involvement C. Work Plan Provide a brief description of the work plan and methodology proposed to carry out the scope of work, including specific steps and approach to market and sell the property. D. Commission Identify the proposed commission, terms and any other cost related items. V. SELECTION PROCESS A review committee will evaluate the proposals based on experience, qualifications, involvement in the community, work plan, commission and degree to which the proposed approach will meet the needs of the City. Once the most qualified applicants are selected, finalists will be invited to an interview with the selection panel.
