CONSTRUCTION, INC. FOR CONSTRUCTION OF THE MONTEGO
STREET NORTH SIDEWALK, PHASE II PROJECT, PW 2013-02

RECOMMENDATION:
It is recommended the City Council:
1. award a contract for construction of the Montego Street Sidewalk, Phase II
Project to Brough Construction, Inc. in the amount of $137,486;
2. authorize the City Manager to approve change orders for 10% of the contract
amount, $43,562, for unanticipated costs during the construction phase of the
project (total construction costs= $137,486 + $13,749 = $151,235).
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
In 2008, the City successfully secured a $259,000 Federal Safe Routes to School
(SRTS) grant for 100% of the project costs. The construction portion of the project was
estimated at $174,900. There is no requirement for a local match. Engineering staff will
perform the administrative and inspection roles during the project, all of which are
eligible for reimbursement under the terms of the grant.
BACKGROUND:
The City was awarded federal grant funds as part of Safe Routes to School Program to
construct sidewalks on both sides of Montego Street, between Hillcrest Drive and the
cul-de-sac adjacent to Ocean View Elementary School. Phase I of the project,
constructing sidewalks on the south side of Montego Street, was completed in the late
1990's. In 2008, the City successfully secured funding to construct the sidewalks on the
north side of Montego Street. Unlike the homes on the south side of the roadway, the
homes on the north side are constructed on hillsides at a higher elevation than the
roadway and the setbacks are in close proximity with the curb. It was theorized that
conventional sidewalk construction may require expensive retaining walls to support the

foundation of some of the homes, and reconstruction of driveways to steep grades that
would exceed accepted engineering standards. Unfortunately, a topographic survey
would be required to determine the available design options.
On January 18, 2013, the Council considered a consultant services agreement with
Eikhof Design Group, Inc. to perform the Phase II design. Council approved a modified
consultant services agreement to perform a topographic survey and preliminary design
concepts with an option to proceed with the formal project design upon satisfactory
presentation to the neighborhood owners/residents.
On March 12, 2013, staff presented the completed Eikhof Design Group, Inc.
topographic survey and a preferred design option to the City Council. The topographic
survey showed that the width and grade of Montego Street could accommodate the
construction of a sidewalk within the existing roadway. Staff presented the design
concept to the Montego Street residents prior to the Council meeting and received
overwhelming support. The Council approved the design concept and authorized the
Eikhof Design Group, Inc. to proceed with the final design.
ANALYSIS OF ISSUES:
On June 13, 2013, eight bids were opened for the subject project. The lowest
responsive bid, from Brough Construction, Inc., was in the amount of $137,486. Staff
has determined the bid to be responsive and recommends the award of a construction
contract to Brough Construction, Inc.
The contract time is 30 working days. Due to the proximity of the Ocean View
Elementary School at the eastern end of Montego Street, all work will be performed
during the Lucia Mar Unified School District's summer break, completing August 15,
2013.
ALTERNATIVES:
The following alternatives are provided for the Council's consideration:
1. Approve staff's recommendations to award a construction contract to the lowest
responsive bidder;
2. Do not award a construction contract for the project at this time; or
3. Provide direction to staff.
ADVANTAGES:
The lowest responsive bid of $137,486 is below the Engineer's Estimate of $190,180
and ensures that the City will be fully reimbursed by the Safe Routes to School grant
funding.

DISADVANTAGES:
The construction timeline is tight. Upon issuance of the Notice of Award, Brough
Construction, Inc. will still need to secure the requisite bonds and insurance
documentation for submittal with the contract documents, a process that usually takes
two weeks. Staff anticipates the earliest issuance of a Notice to Proceed to be the
second week in July.
ENVIRONMENTAL REVIEW:
The project is categorically exempt from CEQA pursuant to Guidelines Section
15301(c).
PUBLIC NOTIFICATION AND COMMENTS:
The agenda was posted on Thursday, June 20, 2013. The agenda and staff reports
were posted on the City's website on Friday, June 21, 2013. No public comments were
received as of the time of preparation of this report.
