CC 2013-09-10_08.h. 2013 Concrete Repair ProjectTO: FROM: BY: MEMORANDUM CITY COUNCIL GEOFF ENGLISH, DIRECTOR OF PUBLIC WORKS MIKE LINN, ASSISTANT CITY ENGINEER SUBJECT: CONSIDERATION OF ACCEPTANCE OF THE 2013 CONCRETE REPAIR PROJECT, PW 2013-01 DATE: SEPTEMBER 10, 2013 RECOMMENDATION: It is recommended the City Council: 1. Accept the improvements as constructed by J.J. Fisher Construction, Inc. for the 2013 Concrete Repair Project; and 2. Direct staff to file a Notice of Completion; and 3. Authorize release of retention, thirty-five (35) days after the Notice of Completion has been recorded, if no liens have been filed. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The budget included $70,800 for the 2013 Concrete Repair Project. The actual total ·project cost, including authorized changes, for design, construction, construction administration and Public Works construction costs, was $38,881. The recommendation will not result in any impact on staff resources. The remaining balance in the project account will be used for a second phase of concrete repair work. BACKGROUND: On April 23, 2013, Council awarded a construction contract to perform the 2013 Cor1crete Repair Project to J.J. Fisher Construction, Inc. for $41,469 and authorized the City Manager to approve change orders in the amount of $8,294. The project scope of work involved the replacement of sidewalk, curb and gutter, and driveway approach segments along East Grand Avenue, Halcyon Road, and South Elm Street that have experienced damage from adjacent trees. All asphalt pavement patching was performed by City crews following the concrete placement. Item 8.h. - Page 1 • CITY COUNCIL CONSIDERATION OF ACCEPTANCE OF THE 2013 CONCRETE REPAIR PROJECT, PW 2013-01 SEPTEMBER 10, 2013 PAGE2 ANALYSIS OF ISSUES: The contractor has completed the work in accordance with the approved plans and specifications. There are no outstanding issues. ALTERNATIVES: The following alternatives are provided for the Council's consideration: 1. Approve staff's recommendation; 2. Do not accept the project; 3. Accept the project but do not authorize release of retention; or 4. Provide direction to staff. ADVANTAGES: The project is complete. Accepting the improvements will allow staff to close out the project. Remaining funds in the project account will be used for a second phase of concrete repair work. DISADVANTAGES: The disadvantage of accepting the improvements would be if subsequent deficiencies in the work are identified. However, the contract documents include a one-year warranty period for the contractor to address any construction defects that may arise. ENVIRONMENTAL REVIEW: The project is categorically exempt from CEQA pursuant to Guidelines Section 15301(c). PUBLIC NOTIFICATION AND COMMENTS: The agenda was posted on Thursday, September 5, 2013. The agenda and staff report was posted on the City's website on Friday, September 6, 2013. No public comments were received as of the time of preparation of this report. Attachment: 1.
