NORTH SIDEWALK, PHASE II PROJECT, PW 2013-02

RECOMMENDATION:
It is recommended the City Council:
1. Accept the project improvements as constructed by Brough Construction
Company in accordance with the plans and specifications for the Montego Street
North Sidewalk, Phase II Project ("project");
2. Direct staff to file a Notice of Completion; and
3. Authorize release of the retention, thirty-five (35) days after the Notice of
Completion has been recorded, if no liens have been filed.
IMPACT TO FINANCIAL AND PERSONNEL RESOURCES:
In 2008, the City successfully secured a $259,000 Federal Safe Routes to School
(SRTS) grant for 100% of the project costs. The construction portion was estimated at
$174,900. The actual total construction project cost, including authorized construction
changes, is $169,926.
BACKGROUND:
On June 25, 2013, Council awarded a construction contract to perform the project to
Brough Construction Company for $137,486 and authorized the City Manager to
approve change orders in the amount of $13,749. On August 13, 2013, Council
increased the contingency amount to $45,000.
The City was awarded federal grant funds as part of Safe Routes to School Program to
construct sidewalks on both sides of Montego Street, between Hillcrest Drive and the
cul-de-sac adjacent to Ocean View Elementary School. Phase I of the project,
constructing sidewalks on the south side of Montego Street, was completed in the late
1990's. In 2008, the City successfully secured funding to construct the sidewalks on the
north side of Montego Street.

Since the Ocean View Elementary School is sited at the eastern end of Montego Street,
all work was performed entirely during the Lucia Mar Unified School District summer
break.
ANALYSIS OF ISSUES:
The contractor has completed the work in accordance with the approved plans and
specifications. There are no outstanding issues.
ALTERNATIVES:
The following alternatives are provided for the Council's consideration:
-Approve staff's recommendations accepting the project improvements;
-Do not accept the project improvements;
-· Accept the project improvements, but do not authorize release of retention; or
-Provide direction to staff.
ADVANTAGES:
The project is complete and closure will enable final payment of Federal grant funds.
DISADVANTAGES:
The disadvantage of accepting the improvements would be if subsequent deficiencies in
the work are identified. However, the contract documents include a one-year warranty
period for the contractor to address any construction defects that may arise.
ENVIRONMENTAL REVIEW:
The project is categorically exempt from CEQA pursuant to Section 15301 (c).
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted in front of City Hall on Thursday, September 19, 2013. The
Agenda and report were posted on the City's website on Friday, September 20, 2013.
No public comments were received.
