Appointment to Fill Council VacancyMEMORANDUM TO: CITY COUNCIL FROM: STEVEN ADAMS, CITY MANAGER jk SUBJECT: CONSIDERATION OF APPOINTMENT TO FILL CITY COUNCIL VACANCY DATE: NOVEMBER 12, 2013 RECOMMENDATION: It is recommended: 1) the City Council approve an appointment to fill the existing City Council vacancy; and 2) the individual appointed be sworn in and take the Oath of Office by the City Clerk. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: There is no cost impact from making the appointment. BACKGROUND: Former Council Member Ray submitted her resignation on October 4, 2013 following her appointment to the County of San Luis Obispo Board of Supervisors. State law does not identify any specific procedure that must be followed in filling a vacancy on a City Council. Therefore, the City Council has considerable discretion in determining what procedure to utilize, with the only significant constraint being the sixty (60) day statutory time frame within which to act, which means the Council must take action by December 3, 2013. At the October 8 meeting, the City Council considered options for the process to fill the vacancy. The following was agreed upon: • The City Council vacancy would be filled by City Council appointment. • Application and Notice of Vacancy forms were approved and a deadline to submit applications by October 18, 2013 was established. • An applicant public forum would be scheduled to provide public involvement in the process. • The appointment was tentatively scheduled to take place at the November 12, 2013 meeting. Following an additional opportunity for candidate and public feedback, Council Members would rank all the applicants. The initial motion would be for either of the top two ranked applicants. • The new Council Member would be seated at the November 12, 2013 meeting. At the October 22, 2013 meeting, four City Council questions were then developed for candidates to respond to at the forum. Staff issued the Notice of Vacancy and a press release. Applications were made available on the City website and at City Hall. The public forum was scheduled and conducted on October 29, 2013, which was moderated by the League of Woman Voters. Announcements of the forum were placed on the City's website, cable television government access channel, and through a flyer distributed to community organizations. The forum was taped by AGP Video and subsequently broadcast on the City's cable television government access channel a number of times. ANALYSIS OF ISSUES: The City received applications from the following individuals: • Kristen Barneich • Dale Hanson • Barbara Harmon • Burke Nelson • Glo Rivera • Christopher Fontes Glo Rivera and Christopher Fontes have since withdrawn their applications. Copies of the applications of the four remaining applicants are attached. The City Clerk has verified that they are eligible for appointment pursuant to State law. The Brown Act requires that all deliberation regarding the appointment be done in public. A ranking form is attached, which is identical to the one used in 2010. The following process is recommended based on Council direction: 1. Each applicant is provided an opportunity to make a five minute statement. 2. City Council members may ask questions of the applicants either after their statement or at the end of all their statements. 3. The public is provided an opportunity for comment. 4. City Council may discuss the applications and/or process. 5. The ranking form is completed by each Council Member. The tabulation will be done openly at the meeting. Once the ranking forms are completed, it is recommended they be submitted to the City Clerk to tabulate the results. As a part of the tabulation process, each Council Member's individual ranking sheet will be displayed for public review and results will be entered onto a Final Ranking Sheet. Upon tabulation by the City Clerk, the final applicant rankings will be displayed. When an appointment is approved by a majority of the Council, it is recommended the individual appointed be invited to come forward to be sworn in by the City Clerk and be seated for the remainder of the meeting. If for some reason the City Council is not successful in approving an appointment at the meeting, it would still have until December 3, 2013 to take action. Therefore, it could be accomplished by continuing the item to the November 26, 2013 meeting or by scheduling a special meeting. ALTERNATIVES: The following alternatives are provided for the Council's consideration: Make the appointment at the November 12, 2013 meeting per the process set forth by the Council; Modify the process and make the appointment at the meeting; Continue the appointment to the November 26, 2013 meeting or direct staff to schedule consideration of the appointment at a special meeting; or Provide staff other direction. ADVANTAGES: The appointment shall fill the vacancy in a timely manner and provide a full City Council to address a number of important City issues that will be coming up in the near future. The process developed by the City Council is fair, objective and provides for public involvement. DISADVANTAGES: No disadvantages have been identified. ENVIRONMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted in front of City Hall on Thursday, November 7, 2013. Kristen Barneich is the logical choice for the vacant seat on the Arroyo Grande City Council. Her experience alone qualifies her for this position, but her passion and intelligence are a plus. She has been on the Planning Commission for seven years and was on the Architectural Review Commission for two years before that. In 2005 she and her dad and a handful of Arroyo Grande citizens founded the Arroyo Grande Tree Guild. Since that time the Guild has planted 292 trees all over the city with the cooperation of city staff. She has a collaborative spirit with everyone with whom she works.
