CC 2015-01-13_08h Accept Hoosegow Park ImprovementsMEMORANDUM TO: CITY COUNCIL FROM: BY: GEOFF ENGLISH, DIRECTOR OF PUBLIC WORKS MIKE LINN, CAPITAL PROJECTS ENGINEER SUBJECT: CONSIDERATION OF ACCEPTANCE OF THE HOOSEGOW PARK ADA IMPROVEMENTS PROJECT, PW 2014-02 AND APPROPRIATION OF PARK DEVELOPMENT FUNDS DATE: JANUARY 13, 2015 RECOMMENDATION: It is recommended the City Council: 1. Accept the improvements as constructed by J&P Construction, Inc. for the subject project; 2. Direct staff to file a Notice of Completion; and 3. Authorize the appropriation of $20,000 from the Park Development Fund for the purchase of park furnishings. 4. Authorize release of retention, thirty-five (35) days after the Notice of Completion has been recorded, if no liens have been filed. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The actual construction project cost for the Phase I Hoosegow Park Barrier Removal project to install an ADA accessible ramp, including authorized construction changes, is $61, 171. The total cost of the project, including all design, construction, contract administration, inspection and testing is $73,000. Additional expenses for Phase II of the project, to install the interior park pathways, irrigation and plant materials, were $35,264.63 for a total cost of $108,264.63. This park improvement project was funded as follows: Community Development Block Grant Funds- Mankins Family Donation- Park Development Funds- Water Neutralization Funds- Five Cities Rotary Club Grant- Total project funding $ 24,947.35 $ 50,000.00 $ 20,000.00 $ 5,000.00 $ 7.794.79 $107,742.14 Item 8.h. - Page 1 CITY COUNCIL CONSIDERATION OF ACCEPTANCE OF THE HOOSEGOW PARK ADA IMPROVEMENTS PROJECT, PW 2014-02 JANUARY 13, 2015 PAGE2 Project costs exceeding the allocated project budget by $522.49 and will be charged to the General Fund Park operating budget unless additional Park Development funds are approved. The Park Development Fund currently has an estimated fund balance of approximately $491,000. BACKGROUND: On June 24, 2014, Council awarded a construction contract for the Phase I Hoosegow Park Barrier Removal project to install an ADA accessible ramp, to J&P Construction, Inc. for $54,667 and authorized the City Manager to approve change orders in the amount of $5,467. The project scope of work involved the construction of a concrete ADA ramp to access the park at Le Point Street, retaining walls, concrete pathways and minor drainage improvements. Staff issued a Notice to Proceed to J&P Construction to start construction on July 28, 2014 with an anticipated completion date of September 10, 2014 (45 calendar days). Two events affected the project time and contingencies: • Arroyo Grande in Bloom requested that the City consider the installation of split- faced masonry block for the retaining wall in lieu of the specified slump stone. Staff authorized payment for the differential material price of $3,763 and directed J&P Construction to proceed with the retaining wall installation. • On August 1, 2014, J&P Construction discovered a shallow, unmarked PG&E conduit directly in the projected footprint for the new retaining wall foundation. Staff immediately halted all work on the project pending review and resolution by PG&E. PG&E redesigned the installation and mobilized crews to lower the conduit and pull new conductors on September 7, 2014. Staff authorized J&P Construction to provide support to PG&E's crews on a time and materials basis, which calculated to $2,741. Staff also authorized an additional 37 calendar days to the contract, extending the contractual completion date to October 17, 2014. Staff drafted Contract Change Order No. 1 in the amount of $6,504 for the above noted items, $1,037 above the project contingency amount of $5,467. On October 14, 2014, Council adopted a resolution to reallocate additional funds from the City's FY 2014/15 ADA Program to cover additional costs for the Hoosegow ADA Improvements Project. Phase II work for the Hoosegow Park project included the installation of interior pathways, irrigation and planting. This work was completed by a combination of private contractors, City staff, Arroyo Grande in Bloom volunteers and the Five Cities Rotary Club. Item 8.h. - Page 2 CITY COUNCIL CONSIDERATION OF ACCEPTANCE OF THE HOOSEGOW PARK ADA IMPROVEMENTS PROJECT, PW 2014-02 JANUARY 13, 2015 PAGE3 ANALYSIS OF ISSUES: The contractor has completed the work for the Phase I Hoosegow Park Barrier Removal project to install an ADA accessible ramp, in accordance with the approved plans and specifications. There are no outstanding issues. As such, staff is requesting that the City Council accept the improvements for the subject project and to direct staff to file a Notice of Completion for the work completed by J&P Construction, Inc. Staff is also requesting that the City Council appropriate an additional $20,000 in Park Development funds to purchase the following park furnishings that were not included in the original project budget. The proposed purchases and additional furnishings include the following: • Park Entrance signs- • Picnic Table and Trash cans- • Flagstone benches- • Hoosegow Interpretive Signs/ Interior Gate- • Current budget overage Total Cost for Furnishings- ALTERNATIVES: $ 2,750 3,750 8,500 4,500 500 $20,000 The following alternatives are provided for the Council's consideration: 1. Approve staff's recommendation; 2. Do not accept the project; 3. Accept the project but do not authorize release of retention; or 4. Provide direction to staff. ADVANTAGES: The project is complete. Accepting the improvements will allow staff to close out the project. DISADVANTAGES: The disadvantage of accepting the improvements would be if subsequent deficiencies in the work are identified. However, the contract documents include a one-year warranty period for the contractor to address any construction defects that may arise. ENVIRONMENTAL REVIEW: The project is categorically exempt from CEQA pursuant to Guidelines Section 15301 (f). PUBLIC NOTIFICATION AND COMMENTS: The agenda was posted on Thursday, January 8, 2015. The agenda and staff report was posted on the City's website on Friday, January 9, 2015. No public comments were received as of the time of preparation of this report.
