MINUTES OF THESPECIAL CITY COUNCIL MEETING OF NOVEMBER 19, 2014 DATE: JANUARY 12, 2015 Attached is an amendment to the November 19, 2014 City Council minutes which adds specific language (shown as italicized underlined text) explaining the amendment to the September 9, 2014 City Council minutes. c: Acting City Manager City Attorney Public Review Binder ACTION MINUTES SPECIAL MEETING OF THE CITY COUNCIL WEDNESDAY, NOVEMBER 19, 2014 COUNCIL CHAMBERS, 215 EAST BRANCH STREET ARROYO GRANDE, CALIFORNIA 1. CALL TO ORDER Mayor Pro Tern Guthrie called the Special City Council Meeting to order at 6:00 p.m. 2. ROLL CALL: Council Members Tim Brown, Kristen Barneich, Joe Costello, and Mayor Pro Tern Jim Guthrie were present. Mayor Tony Ferrara was absent. Staff present were City Attorney Tim Carmel and City Clerk Kelly Wetmore. 3. PUBLIC COMMENT: Mayor Pro Tern Guthrie led the Flag Salute. 4. PUBLIC COMMENT: Mayor Pro Tern Guthrie invited public comment on any item on the Agenda. Speaking from the public were: Patty Welsh, commented on the investigation; Otis Page, thanked Council Member Joe Costello for his service to the City; Jim Hill, thanked Council Member Joe Costello for his many years of service on the Council; Alegi Davar, commented on the investigation report; Colleen Martin, commented on the investigation, the need for the Council to take immediate action to remove City Manager Adams from his position, and that it was time to apologize to the community, employees, and AGPOA; Michael Andrews, commented on the Mayor's recent statements provided to the Santa Maria Times, commented on the July 3rd incident, and spoke in support of the Police Department; Glen Martin, commented on the July 3'd incident and lack of action taken by the Council, and expressed concerns about Brown Act violations regarding previous closed session meetings; Vanessa Andrews, commented that the original police reports and a follow up investigation by a third party with no conflict of interest would have been sufficient, expressed concerns about the investigation process, and stated that Mr. Adams should be terminated tonight; Jim Hill, referred to the closed session item, asked the Council to accept Mr. Adams' resignation effective immediately with no further action such as termination for cause or special compensatory action, requested appointment of a Director as Acting City Manager until an Interim Manager can be appointed by the incoming Council, and requested that no action be taken to engage any employee search organization until the incoming Council is seated, and thanked Mr. Adams for his good service to the City; April McLaughlin, expressed concern about closed session meetings; Will Power, congratulated the newly elected Council members and expressed concerns about how the attitudes of some people have impacted the residents of Arroyo Grande; Beatrice Spencer, commented on the public investigation report and stated that the report did not reveal anything they did not already know, and expressed concern about the City's legal exposure had the Council received better legal counsel; and LeAnn Akins, commented on statements made in the investigation report. 5. CONSENT AGENDA: 5.a. Correction to September 9, 2014 City Council Action Minutes. Recommended Action: Approve an amendment to Page 7, Item 17 of the September 9, 2014 City Council Meeting Action Minutes, as follows: Minutes of City Council Special Meeting November 19, 2014 Page 2 City Attorney Carmel reported that there was no formal reportable action taken under the Brown Act, however, the City Council asked him to announce that they would not be moving forward with an outside investigation of the July 3rd incident. Action: Council Member Costello moved to approve an amendment to Page 7, Item 17 of the September 9, 2014 City Council Meeting Action Minutes. Council Member Brown seconded, and the motion passed on the following roll -call vote: AYES: Costello, Brown, Barneich, Guthrie, NOES: None ABSENT: Ferrara 6. CITY COUNCIL CLOSED SESSION: At 6:35 p.m., Mayor Pro Tern Guthrie adjourned the meeting to closed session to consider the following item: Public Employee Discipline /Dismissal /Release pursuant to Government Code Section 54957: Title: City Manager 7. RECONVENE TO OPEN SESSION: Mayor Pro Tern Guthrie reconvened the meeting to open session and announced that the City Council decided to accept Steve Adams' resignation and immediately place him on paid administrative leave until an Interim Manager is hired. He stated the motion was made by Mayor Pro Tern Guthrie, seconded by Council Member Barneich, and the vote was unanimous. 8. NEW BUSINESS: 8.a. Presentation By Sintra Group Regardina Investigation of July 3, 2014 Incident at City Hall Chuck Hookstra and Peter Ruggiero, Sintra Group, provided a summary of the investigation report. Mayor Pro Tern Guthrie invited public comment. Speaking from the public regarding the investigation report were Vanessa Andrews, Colleen Martin, Alegi Davar, Julie Tacker, and Carole Henson. Chuck Hookstra responded to questions from the Council and public. Council comments ensued regarding the investigation report and its conclusions, and the need for the City to move forward with City business. No formal action was taken on this item. 5. I am unable to attend, the meeting on Tuesday so I want to express my opinion. She will be asking AG to join this organization and require that hotels and vacation rentals pay yet another 1% for marketing and advertising. This may be a worthwhile organization that would benefit tourism to Arroyo Grande. But I would respectfully ask that home stays and vacation rentals be exempt from this one. Enough is enough. I was against the BID tax until it was explained that each of us home stay/vacation rental hosts would have a page on the Visit AG web site with a link to our AirBnB listing. That sounded like potentially good exposure for the additional 2% tax, and I changed my mind and did not speak against it at the December 9 city council meeting. (I have not been listed on Visit AG as yet, by the way.) Homestay hosts are tiny businesses. I haven't received my 1099 yet, but I would guess I make $3-4,000 a year. The room rate increase to accommodate TOT and BID has already had a negative impact on my rentals. I had one guest over the past 2.5 months. I would not want to object to something that has a benefit to the city of Arroyo Grande if you believe it does after you hear Stacey's presentation. But please, exclude home stays and vacation rentals from this additional tax. There are currently plans under way to renovate the large dog side of the park,to which I donate, and yet can get very little information about what is going on for the , safety of dogs and owners alike.arraLi One of the mission statements for the dog park is to have a safe and healthy off leash area for dogs to run. The letter that the association sent to the parks and rec commission on Nov 22nd states, the need to replace the wood chips,because of splinters in the dogs feet and other ' i problems such as glass and metal in the chips. Yet the new design shows the existing wood chips being used in the new design. On their face book page it states"the project will mostly be paid for from funds we i already have raised with your help and participation. But that will impact our ability to � � cover our regular cost like mutt mitts. We also need to raise money to maintain and to eventually replace the artificial turf" So how does a project get approved when it appears the funding is not fully in place? The project itself I have questions about, such things as how much water will be used and how often,we are in a serious drought, and as homeowners we were asked to cut back, yet the park will use more water than they have in the past. I think the city should be a ` shining example of water conservation, and to put forth a project that uses more during a drought is Wrong. I have asked for a tree to be planted where we lost one in the dog park, and was told my director Rogers one of the reasons they had said NO until just recently was WATER USEAGE. How hot will this product get in full sunshine after a few hours,will dogs be able to use the park during the hotter days of summer? The dog park association never asked for our input or even let us know this was proposed. I feel the input from the park users is very important. I also feel the dogs who use it should be the ones who have the say on this. Both the big and little dog parks originally had grass ground cover.Unfortunately,it didn't last in the big dog park because of heavy use and insufficient watering.Almost all dog parks wind up using wood chips.. We have used wood chips for nearly four years,but have never been happy with them.Many big dog owners either stopped using the park or try to bring their dogs into the smaller dog park area which has grass.In ad lido Wehave-had reports-of-dogs-getting s lintels°and etin g the chi R s and-some oof chips containe -glass-fragments-that somehow work their way in to the mix,sharp palmfronds that:could-i cbe dangerous-for-our dogs;and larger chunks of wood.The chips also decompose over time and continually need replacement and they drift,not staying where they are needed.The drift is a result of both the dog park being built is on a slope which we cannot grade to fix and from dogs playing.As a result of the drift, the big dog park has large areas of dirt ground cover and mud(the few times it now rains).
