RESOLUTION NO. 2923
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE SETTING FORTH ITS INTENTION
TO VACATE AND ABANDON A PORTION OF A
TWENTY-FIVE (25) FOOT ALLEY, ADJACENT TO 600
TlERRA STREET IN THE CITY OF ARROYO GRANDE,
AND FIXING TIME AND PLACE FOR HEARING AS
PROVIDED BY STREETS AND HIGHWAYS CODE
SECTION 8300, ET SEQ ,
WHEREAS, the owner of property at 600 Tierra Street has requested the
abandonment of an adjacent unimproved portion of a twenty-five (25) foot alley; and
WHEREAS, the City Council of the City of Arroyo Grande elects to proceed with
the vacation and abandonment of a portion of a twenty five (25) foot alley pursuant to
Section 8320 of the Streets and Highways Code of the State of California; and
WHEREAS, it appears that a portion of a twenty-five (25) foot alley is unnecessary
for present or prospective public use; and
WHEREAS, it appears that the abandonment is for the best interests of the public.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE that it intends to vacate and abandon the hereinafter
described portion of a twenty-five (25) foot alley in the City of Arroyo Grande, County of
San Luis Obispo, State of California. For this purpose, the City Council will hold a Public
Hearing in connection with said intention to vacate and abandon the hereinafter described
portion of a twenty-five (25) foot alley, which hearing will be held in the Council Chambers,
215 East Branch Street, Arroyo Grande, on the 14th day of April, 1992, at the hour of 7:30
p. m. at said time and place. those persons interested in or objecting to the proposed --
vacation and abandonment may appear and be heard.
BE IT FURTHER RESOLVED that the City Clerk of the City of Arroyo Grande
be, and is herewith directed to cause to be posted along said portion of a twenty-five (25)
foot alley at intervals not to exceed three hundred (300) feet in distance apart and at least
three (3) in number on said alley, notices of passage of Resolution, which said notices shall
be entitled "NOTICE OF INTENTION TO VACATE AND ABANDON A PORTION OF
A TWENTY.FIVE (25) FOOT ALLEY, IN THE CITY OF ARROYO GRANDE,
COUNTY OF SAN LUIS OBISPO, STATE OF CAUFORNIA."
In addition thereto, the City Clerk is herewith ordered and directed to cause a copy
of said Resolution to be published at least two successive weeks prior to the hearing in the
newspaper of general circulation within the City, which publication shall be at least ten (10)
. days prior to the date of said hearing.
BE IT FURTHER RESOLVED THAT the portion of a twenty-five (25) foot alley,
which the City of Arroyo Grande proposes to vacate and abandon, is more particularly
described as follows:
All that portion of a twenty-five (25) foot alley, lying easterly of the northerly
prolongation of the easterly line of Tierra Street in Tract 80, recorded in ~
Book 5, Page 91 of Maps in the County Recorder's Office. San Luis Obispo
County, California. See Exhibit "A".
Further particulars as to the proposed vacation and abandonment are shown on the
map pertaining thereto on file in the Office of the City Clerk of the City of Arroyo Grande,
California.
