RESOLUTION NO. 2909
A RESOLUTION OF TIm CITY COUNCIL
OF THE CITY OF ARROYO GRANDE, CALIFORNIA
DECLARING THE COUNCIL'S INTENTION TO FORM A
LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT

WHEREAS, the owner and developer of Arroyo Grande Tract 1769
has consented to formation of a landscaping and lighting assessment
district to install and maintain landscaping in Arroyo Grande Tract
1769: and

WHEREAS, the Landscaping and Lighting Act of 1972 enables
local agencies to fornl assessment districts based on the provisions
of the Act as revised; and
WHEREAS, the formation of a landscaping installation and
maintenance assessment district, consisting of the property owners
in Tract 1769, will meet conditions placed on the approval of
permits for Tract 1769.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Arroyo Grande that it is the intent of the Council to order the
formation of an assessment district, designated as Landscaping
District No.1, to install and maintain landscaping in Tract 1769,
Lots 1 through 30.
BE IT FURTHER RESOLVED by the city tQ4ncil that the
improvements at Tract 1769 are specified as the installation and
maintenance of landscaping improvements and ornamental vegetation
in public rights-of-way to serve and benefit properties within the
boundaries of the District as well as any subsequent annexations,
as delineated in the Engineer's Report, which received preliminary
approval from the City Council on January 28, 1992.
BE IT FURTHER RESOLVED by the City Council that the assessment
- upon assessable lots within the district is proposed to total
$3,000.00 or $100.00 per assessable parcel in the initial year.
BE IT FINALLY RESOLVED that a public hearing is hereby set for
February 25, 1992, when all oral statements and written protests as
to the formation of the assessment district will be heard. The
public hearing will be a part of the regular City Council meeting
beginning at 7:30 P.M. in the Council Chambers, 215 East Branch
Street, Arroyo Grande, California.
On motion of Council Member Smith , seconded by
Council Member Gallagher , and on the following roll call vote,
to wit:
AYES: Council Members Smith, Gallagher and Moots
NOES: None
ABSENT: Council Member Dougall and Mayor Millis
the foregoing resolution was passed and adopted this 28th day of
January, 199.2.
