RESOLUTION NO. 2906
A RESOLUTION OF THE ARROYO GRANDE CITY
COUNCIL UPHOLDING THE PLANNING COMMISSION'S
APPROVAL OF VARIANCE CASE NO. 91-157, INCLUDING
CONDITION OF APPROVAL NUMBER 2(c), APPLIED FOR
BY CHARLES DOSTER, TO EXCEED TIIE ALLOWED
AGGREGATE SIGN AREA, AND THE ALLOWED NUMBER
OF SIGNS, AND TO ALLOW TWO (2) NEON WINDOW
SIGNS LOCATED AT 320 E. BRANCH ST., AND DENYING
THE APPEAL OF THE ABOVE DECISION.

WHEREAS, the City of Arroyo Grande received an application for a variance from
Charles Doster to exceed the allowed aggregate sign area, the allowed number of signs, and to
allow two (2) neon window signs at 320 E. Branch Street in the Village CommercialIVC-D-2.4
District; and
WHEREAS, Pursuant to Section 9-01.120 of the Development Code, the Architectural
Advisory Committee reviewed the proposed signs and made recommendations to the Planning
Commission; and
WHEREAS, One of said recommendations of the Architectural Advisory Committee was
denial of signs numbered 3 and 5; and
WHEREAS, the Planning Commission held duly noticed public' hearings on the project
on August 6, October 15, November 19, and December 17, 1991; and
WHEREAS, after due study, deliberation and public hearing, the Planning Commission,
on December 17, 1991 approved the application for the Variance Case No. 91-157 with the
recommendations of the Architectural Advisory Committee; and
WHEREAS, Condition of approval2(c) stated that signs numbered 3 and 5 are denied; ---
and
WHEREAS, an appeal of the Planning Commission's decision to include condition of
approval number 2(c) was flied on December 27, 1991 by Charles Doster; and
WHEREAS, the Arroyo Grande City Council held a duly noticed public hearing on the
aforementioned appeal on January 28, 1992, at which time all interested persons were given the
opportunity to be heard; and
WHEREAS, after due study, deliberation and public hearing, the City Council makes
the following findings of fact:
1. The findings by the Planning Commission for approval of Variance Case No. 91-
157 were appropriate.
2. Condition of Approval number 2(c) is appropriate.
NOW, THEREFORE, BE IT RESOLVED that the Arroyo Grande City Council hereby
1. Adopts the findings made by the Planning Commission in the Planning
Commission Resolution adopted December 17, 1991 in this matter, which -
findings are incorporated herein by reference; and
2. Upholds the Planning Commission's approval of Variance Case No. 91-157
including condition of approval number 2 (c); and
3. Denies the appeal of the Planning Commission's actions on the above referenced
project.
