O 436 C.S. , 1~O,~ t. ORDINANCE NO. 436 C.S. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING THE MUNICIPAL CODE TITLE 5. BY ADDING CHAPTER 20 REGARDING PUBLIC EXHIBITIONS THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE HEREBY ORDAINS AS FOLLOWS: SECTION 1: Title 5 of the Arroyo Grande Municipal Code is amended by adding Chapter 20 as follows: """'" PUBLIC EXHIBITIONS 5-20.01 Definitions For the purpose of this chapter, certain words and phrases used in the chapter are defined as follows: a. "Public Exhibition" shall mean any exhibition, show and/or display which is open to the pUblic for purposes of exhibiting, and the trading, selling and/or buying of property. b. "Open to the Public" shall mean where the public is admitted, whether with or without charge. c. "Property" shall mean any property, items, products, collections (whether in "whole or in part), precious metals and/or stones, antiques, services, and/or any tangible personal property. d. "Gun exhibition" shall mean any public exhibition where the primary purpose is the exhibition of i guns, knives, and/or related articles. ! 5-20.02 Permits: Reauired It shall be unlawful for any person to conduct or assist in conducting any public exhibition or gun exhibition in the city without first having obtained a written permit to do so from the Chief of Police. Violation of this section is a misdemeanor. 5-20.03 Permit: ADDlications The permits required by the provisions of Section 5-20.02 ~ of this chapter shall be issued only upon written , application of the app1icant(s). Such application shall \ set forth the following information. \ a. The name and residence address of the applicant(s); if the applicant is a firm, association, or corporation, the names and residence address of the person constituting the same or the names and residences of the officers and directors of the same; I b. The specific purpose for which the permit is desired; and I c. The specific date(s) and location where the public exhibition or gun exhibition will be held. / } ~--._.~.~_...- ------, r .. Ordinance 4361&l. , 5-20.04 Permits: Issuance. Conditions and Denial a. The permit required by this chapter shall be issued by the Police Department. b. Prior to the granting of a permit pursuant to the provisions of this chapter, the Chief of Police shall review the application and may impose conditions, including, but not limited to, hours of operation, restricting or prohibiting alcoholic beverages at the location of the exhibition, and/or the requiring of security officers licensed by the state of California and employed by a company hOlding a city of Arroyo Grand~ business license or .~ City Police Officers contracted from the Police Department to provide security services. c. If conditions are imposed, the applicant shall furnish proof to the Police Department that all conditions have been met before a permit may be issued. d. The Chief of Police shall refuse to issue a permit for any of the following reasons: l. The application required under Section 5-20.03 of this chapter is incomplete; 2. The issuance of the permit would be detrimental to the health, safety and welfare of the citizens of the city. e. Appeal of a permit denial shall be to the City Council. 5-20.05 Public Exhibition Fees ! The. permit fee for public exhibitions and gun exhibitions shall be established by resolution of the City Council. The Council may waive such permit fee for an activity by an organization or individual, the main purpose which is to raise funds for charity. 5-20.06 InsDection Members of the Arroyo Grande Police Department shall have the right to inspect a location where an event is being conducted pursuant to a permit which has been issued as required by this chapter to ensure compliance with all the requirements imposed upon the permitee as a condition of the issuance of the permit and to ensure compliance with all applicable local ordinances and state laws. r Refusal to permit such an inspection is a misdemeanor. I 5-20.07 susDension and Revocation The Chief of Police may suspend the operation of, and close, any public exhibition or gun exhibition activity prior to the expiration of a permit granted therefore because of the violation of this chapter or any condition of such permit. -_. r---- - - - , f ,.. .,-J .. Ordinance 436 C.S. 108 . SECTION 2. A summary of this ordinance shall be published in a newspaper and circulated in said city at least five (5) days prior to the City Council meeting at which the proposed ordinance is to be adopted. A certified copy of the full text of the proposed ordinance shall be posted in the office of the city Clerk. Within fifteen (15) days after adoption of the ordinance, the summary with the names of those city Council members voting for and against the ordinance shall be published again, and the City Clerk shall post a certified copy of the full text of such adopted ordinance.
