CC 2015-08-25_11a Fireworks SlidesStatus Report Regarding the Sale and Use of Fireworks Arroyo Grande City Council Meeting – August 25, 2015 Stephen C. Lieberman, Fire Chief Steven N. Annibali, Police Chief 1 Municipal Code Section 8.08 governs the use and sale of “safe and sane” fireworks SALE - No person shall sell or offer for sale any fireworks within the city except in a temporary stand or structure used specifically for the display and sale of fireworks operated and maintained by a recognized charitable, civic or patriotic group or organization with the permit of the director of building and fire. USE - Discharge of "safe and sane fireworks" may only occur from the 3rd of July through midnight of July 5th and shall be in legally permitted locations. No person under eighteen (18) years of age may possess or discharge "safe and sane fireworks" except when under the direct supervision of a person twenty-one (21) years of age or older. VIOLATIONS - Persons violating any provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not to exceed one thousand ($1,000) dollars or by imprisonment in the county jail for a period not to exceed six months or by both such fine and imprisonment.
