',," RFSO'LUTlO'N NO'. 2458 A RFSO'LUTlON OF THE CITY COUNCIL O'F THE CITY OF ARROYO' GRANDE MAKING CERTAIN FINDINGS REGADING THE ENVIRO'NMENTAL IMPACTS OF THE 1991 DEVELOPMENT CODE. WHEREAS, the City of Arroyo Grande has prepared a Program Environmental Impact Report (Program EIR) for the 1990 General Plan Update of the Land Use;,. Housing, Open Space and Conservation Elements, Development Code, and Resource Managentent Plan; and l WHEREAS,- on May 22, 1990, the City Council of the City of Mroyo Grande certified the Program EIR as being prepared and circulated pursuant to the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City's Ruk!s and Proc:ecIura for Implementation of CEQA; and WHEREAS, public participation in the development of the Program EIR included mailing public hearing notices to all property owners in the City and witbUt 300 feet of the City limits, as shown on the latest equalized assessment roll; and WHEREAS, duly noticed public hearings were held by the Planning Commission of the City of Arroyo Grande on October 30, November 20, and December IS:, 1990, and January 10 and February 19, 1991, at which all interested persons were given the opportunity to be heard; and WHEREAS, duly noticed public hearings were held by the City Council of the City of Arroyo Grande on March 12, March 26, and Apri19, 1991 at which all inteiested persons were given the opportunity to be heard; and WHEREAS, the City Council at its meeting of even date herewith adopted a Resolution certifying that said Program EIR was completed in compliance with CEQA, the State CEQA Guidelines, and the City's Rules and Procedures, adequately addresses die impacts of the 1991 Development Code and no additional environmental document need be prepared; and WHEREAS, the City Council has reviewed and considered the information contained in the Program EIR. - NO'W, THEREFORE, BE IT RFSO'LVED by the City Council of the City of Arroyo Grande, California as follows: 1. 'The City Council hereby finds and determines that the implementation of the 1991 Development Code may have a significant effect on the environment. 2. 'The City Council hereby finds with respect to the adverse environmental impacts l detailed in the EIR: (a) that, based on the information set forth in the BIR and the Statement of Significant Environmental Effects and Mitigation Measures, attached to this Resolution as Attachment' A' and incorporated herein by reference, the City Council finds and determines that changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the adverse environmental effects identified in the EIR for: (1) Water; (2) Noise; (3) Police/Fire; (4) Air Quality; (5) Recreation; (6) Traffic; and (7) Infrastructure. (b) that no additional adverse impacts will have a significant effect or result in a substantial or potentially substantial adverse change in the environment as a result of the 1991 Development Code. --- ------_.--------_.-- . The City Council hereby finds and determines that all significant environmental effects identified in the EIR have been reduced to an acceptable level in that all significant environmental effects that can feasibly be avoided have been eliminated or substantially lessened as determined through the findings set forth in paragraph 2(a) of this Resolution; 4. ATTACHMENT "A" STATEMENT OF SIGNIFICANT ENVIRONMENrAL EFFECTS AND MITIGATION MEASURES BACKGROUND The California Environmental Quality Act ("CEQA") and the Slate CEQA Guidelines promulgated pursuant thereto provide: "No public agency shall approve or carry out a project for which l an Environmental Impact Report has been completed _ which identifies one or more significant environmental effects> of the project unless the public agency makes one or more' written findings for each of those significant effects, accompanied by a brief explanation of the rationale for each finding." (Section 15(91) The City Council of the City of Arroyo Grande proposes to approve the 1991 Development Code (Revision of Title 9 of the Municipal Code). The proJOsedaction constitutes a project under CEQA and the State CEQA Guidelines. A Program Ell. was prepared for the 1990 General Plan Update of the Land Use (LUE), Housing (HE), Open ~ and Conservation (OSeE) Elements, Development Code, and Resource Management Plan. The BIR identified certain significant effects that may occur as a result of this project. Farther, the City Council has previously determined that the BIR is complete and has been prepared in accordance with CEQA and the State CEQA Guidelines. Therefore, the following findings are set forth herein pursuant to Section 15091 of theCEQA Guidelines. \ I. WATER A. Efti:&.t: The 1991 Development Code would result in increased demand for domestic water over existing use. The updated Land Use Element and 1991 Development Code, however, reduces water demand compared to the previous general plan and existing zoning ordinance. B. Miti~ation: Of the five alternatives presented in the Environmental Impact Report, the "lower density alternative" has been selected. The following Land Use, Housing and Open Space and Conservation Element objectives and policies mitigate water impacts: LUE Objective 8.0, LUE Policies 8.1 and 8.2; HE Policy 14; OSCE Objectives 2.0 and 3.0; OSCE Policies 1.4,2.1 - 2.4, and 3.1 . 3.3. The City would be able to prevent significant impacts to water resources by investigating potential new sources of water for domestic U1IeS. If no new sources are procured, the City will limit approval of new development(s) so as to not l overburden available water resources. This will be acComplished with a Resource Management Ordinance. C. Findin2s: Changes or alterations have been required in or incotpotated into, the project which avoid or substantially lessen the significant environmental effect as identified in the fmal BIR. . Statement of Facts: The Resource Management Ordinance will limit the number D. of dwelling units to the amount of available water, therefore, ensuring that 'the City has enough water (or its cilimns until additional supplies are located. n. NOISE A. ~: Increased traffic will generate corresponding increases in local noise. Continuation of agricultural activities and growth on non-residential uses will also increase local noise levels as the City builds out. --------- ~-_..._--_. . , RESOLtTl'IOO 00. 2458 B. Mitieation: As growth occurs in the City, care should be exercised to exert proper planning on circulation routes and land uses so that acceptable noise levels are maintained. Developments may be required to provide noise or acoustical studies to identify noise impacts and mitigation measures. LUB Objective 7.0 and Policy 7.1 require adequate buffers between land uses. Street widths shall be planned and constrocted to prevent unacceptable noise impacts to adjacent land uses. Appropriate construction practices and materialS may be required on development projects where potential noise impacts are projected. The City may develop special ordinances to address particular types oHand uses that produce unacceptable noise levels. The City will revise the NOise Element based on information generated by the new Circulation Element. C. Findines: Changes or alterations have been required in or incoJporated into, the project which avoid or substantially lessen the significant environmental effect as identified in the final EIR. D. Statement of Facts: The Noise Element is in the process of being updated. m. POUCFJFIRE A. ~: Buildout of the City to the level in the adopted land use plan and 1991 Development Code will require an increase in police otlic:ers and f11'efighters. Buildout of the City according to the 1990 General Plan and 1991 Development Code will incrementally increase the amount and type of hazardous materials within the City. B. Miti~ation: The following Land Use Element objectives and policies mitigate crimelf11'e protection and hazardous materials impacts by maintaining adequate land for future public facilities, requiring safe urban design, reviewing development projects for impacts and requiring appropriate on- and off-site improvements, and limiting location of hazardous materials: Objective 5.0, Policies 4.1,5.1, 6.4, and 8.2. C. FindinL!s: Changes or alterations have been required in or incorporated into, the project which avoid or substantially lessen the significant environmental effect as identified in the final EIR. D. Statement of Facts: The City has in the past increased the size and strength of the Police and Fire Departments as necessary and is expected to do so in the future. IV. AIR QUALITY A. ~: The land use proposed within the study area, as shown on the zoning map will generate significant impacts on the local air basin. r B. Miti,ation: Of the five alternatives presented in the EIR, the "lower density alternative" has been selected. The following Open Space and Conservation Element objectives and policies mitigate impacts related to air quality by proposing energy conservation measure that reduce electricity and natural gas use and other general measures to control pollutants: Objectives 6.0 and 7.0, Policies 6.1 - 6.4, 7.1 - 7.5. C. Findin~s: Changes or alterations have been required in or incorporated into, the project which avoid or substantially lessen the significant environmental effect as identified in the final EIR. D. Statement of Facts: The majority of air quality problems experienced within San Luis Obispo County relate to vehicular trips. The City will comply with the Air Quality Attainment and Management Plan currently being prepared by the San Luis Obispo County Air Pollution Control District. Attachment "A" 1')........,. Miti~ation: As long as the facilities/programs identified in the Parks and Recreation Element are implemented as proposed, there should be no significant impacts. LUE Policy 2.6 and OSCE Policies 2.2 and 5.1 ~ consistent with the Parks and Recreation Element. C. Findin~s: Changes or alterations have been required in or iftcorporated into, the project which avoid or substantially lessen the significant erMronmental effect as identified in the fmal EIR. , l i D. Statement of Facts: The Parks and Recreation Elemenf outlines actions to mitigate parks and recreation impacts based on a popuJatkm of 19,378. The buildout of the Land Use Element is projected to be less tIiIn this population. VI. TRAFFIC A. ~: Development occurring pursuant to the General Plan and Development Code will increase traffic volumes both on a citywide and ngional basis. Various I roadway improvements will be necessary in order to ac\ICOmmodate projected traffic volumes. B. Mitieation: The improvements identified in the Environmental Impact Report will be included in the Circulation Element. The Circulaticln Element will also identify phasing and funding for these improvements to prevent significant circulation impacts. In addition, development in areas with deficient roadways will be limited until adequate improvements can be made (LUE Objective 8.0). The City will coordinate future planned roadways with appmpiiate agencies (LUE Objective 9.0). C. Findinl:s: Changes or alterations have been required in or incorporated into, the project which avoid or substantially lessen the significant environmental effect as identified in the final EIR. D. Statement of Facts: The Circulation Element will be updated within the next fiscal year. vn. INFRASTRUCfURE A. ~: The proposed project would result in increased wastewater flow and increased demand on the project areas sanitation systems. Proposed uses would result in the increased coverage of the area with impervious surfaces resulting in increased speed and volume of runoff. Additionally, portions of the project area are exposed to flooding from local drainage channels. l B. Mitieation: Measures that help reduce domestic water use will also help reduce the production of wastewater. Therefore, the mitigation measures proposed for water consumption are also applicable to wastewater. In addition the City will coordinate with the sanitation district to assure adequate wastewater treatment . capacity will be maintained to support development of the City. The master plan for flood cOntrol will identify funding and phasing for identified improvements. All development plans will be reviewed by the City Engineer to assure that adequate flood control measures are constructed as needed. City staff will coordinate with County staff to assure that planned growth is consistent with the County Solid Waste Management Plan. C.
