R 2412 33 RESOLUTION NO. 2412 i i A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DIRECTING CALTRANS TO CONVERT A PORTION OF ARROYO GRANDE'S COMBINED ROAD PLAN (CRP) FUNDS TO FEDERAL AID-PRIMARY FUNDS TO BE CREDITED TO THE STATE OF CALIFORNIA AND DESIGNATED AS THE CITY'S FULL AND FINAL CONTRIBUTION TOWARDS TI-IE COST OF RECONSTRUCTION OF THE OAK PARK BOULEVARD INTERCHANGE AT U.S. 101 Whereas, on December 4, 1989, the City of Arroyo Grande entered into District Agreement #5CA8907 with the State of California to participate financially in the reconstruction of the Oak Park Interchange at U.S. 101; and r Whereas, the agreement calls for a contribution from the City of Arroyo Grande in the amount of $556,750 to be paid from Federal-Aid Urban (FAU) apportionments; and Whereas, FAU funds are now combined with Federal Aid Secondary and Bridge Replacement apportionments and administered as Combined Road Plan (CRP) funds since June 1, 1989; and Whereas, CRP resources that cannot be obligated by June 1, 1991, are to be reallocated to other agencies which have projects ready to advertise for bid; and Whereas, it is the determination of the Staff of CalTrans that the Oak Park Interchange project cannot be scheduled to be advertised for bid until after June 1, 1991; and Whereas, it has been proposed by said Staff of the State Department of Transportation that this matter can be resolved by redesignation of funds upon written direction by the City of Arroyo Grande; NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Arroyo Grande does hereby direct the Staff at CalTrans District 5 Headquarters, to convert $556,750 of CRP funds designated for use by the City of Arroyo Grande to Federal-Aid Primary Funds for credit to the State of California as full and final payment by Arroyo Grande of its share of funding for the reconstruction of Oak Park Boulevard Interchange at U,S, 101; and I BE IT FURTHER RESOLVED, that CalTrans is directed to take appropriate action with regard to preparation of any required supplementary agreement or modification of the City's agreement with the district designated as #5CA8907 to accommodate this funding conversion; and BE IT FURTHER RESOLVED, that the proposed conversion be conditional such that in the event unforseen circumstances delay for an extended period of time, or cancel the reconstruction project for the Oak Park Interchange at U.S. 101, the State shall reimburse the City for the funding credited as the City's share of the project costs.
