'owie, RESOLUTION NO. 4767 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2016, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held in the City of Arroyo Grande, California, on Tuesday, November 8, 2016 as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and matter as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution Nos. 4730 and 4731, the San Luis Obispo County Clerk-Recorder canvassed the returns of the election and has certified the results, which are attached hereto and made a part herein as "Exhibit A". NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Arroyo Grande, California, that: 1. All of the above recitals are true and correct and incorporated herein by reference. 2. The whole number of ballots cast in the City was 10,265. 3. The names of the persons voted for at the election for Mayor are as follows: Jim Hill and Richard G.Waller. 4. The names of the persons voted for at the election for Member of the City Council are as follows: Caren Ray, Kristen Barneich, John F. Mack, Ken Sage, and LeAnn Akins. 5. The Measure voted upon at the election is as follows: Measure E-16: Shall the City of Arroyo Grande be authorized to purchase water from the State Water Project to supplement the City's existing water supplies during local water emergencies declared by the Arroyo Grande City Council? 6. The whole number of ballots cast and the number of ballots cast for the above- named offices are listed in "Exhibit A", attached hereto and made a part hereof. 7. The City Council does declare and determine that as a result of the election: o Jim Hill was elected as Mayor for a full term of two (2) years; o Caren Ray was elected as Member of the Council Member for a full term of four (4) years; RESOLUTION NO. 4767 PAGE 2 o Kristen Barneich was elected as a Member of the City Council for a full term of four (4) years; o A majority of the voters voting on Measure E-16 relating to the City's authority to purchase water from the State Water Project to supplement the City's existing water supplies during local water emergencies declared by the Arroyo Grande City Council did vote in favor of it, and that the measure was carried, and shall be deemed adopted and ratified. 8. The City Clerk shall enter into the records of the City a statement of the results of the election, showing: (1) The whole number of ballots cast in the City; (2) the names of the persons voted for; (3) the measure voted upon; (4) for what office each person was voted for; and (4) the total number of votes given to each person, and for and against the measure. 9. The City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. 10. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. On motion by Council Member Brown, seconded by Council Member Guthrie, and on the following roll call vote, to wit: AYES: Council Members Brown, Guthrie, Barneich, Harmon, and Mayor Hill NOES: None ABSENT: None The foregoing Resolution was passed and adopted this 13th day of December, 2016.
