SUBJECT: CONSIDERATION OF ACCEPTANCE OF THE MID-BLOCK
CROSSWALK BARRIER REMOVAL PROJECT, PW 2015-03

RECOMMENDATION:
It is recommended the City Council:
1. Accept the project improvements as constructed by Victor Concrete, Inc. in
accordance with the plans and specifications for the Mid-Block Crosswalk Barrier
Removal Project;
2. Direct staff to file a Notice of Completion; and
3. Authorize release of retention, thirty-five (35) days after the Notice of Completion
has been recorded, if no liens have been filed.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The amended FY 2015-16/FY 2016-17 Capital Improvement Program Budget includes
$73,089 for the subject project, which includes $63,363 of Community Development
Block Grant (CDBG) funds. The total cost of the completed project (including
contingencies, design, contract administration and inspection) is estimated to be
$68,600.
In order to maximize the CDBG funds, $3,025 of local funds from the Various Striping
and Sidewalks Improvements project was transferred to the project at time of contract
award in order to fund both the base bid and additive bid. Only a small contingency was
needed during the course of the project and there was less contract administration and
inspection needed than planned for in the project budget. Therefore, the $3,025 of local
funds can be returned to the Various Striping and Sidewalks Improvements project. The
recommended action will not result in any impact on staff resources.
BACKGROUND:
On October 11, 2016, Council awarded a construction contract to perform the Mid-Block
Crosswalk Barrier Removal Project to Victor Concrete, Inc. in the amount of $43,482.00

and authorized the Interim City Manager to approve change orders in the amount of
$4,348.20. The project provides American with Disability Act (ADA) accessible curb
ramps where none currently exist at three mid-block crosswalk locations: Huasna
Road/Rosewood Lane, East Grand Avenue/Alder Street and Ash Street/Spruce Street.
ANALYSIS OF ISSUES:
The contractor has completed the work in accordance with the approved plans and
specifications at the three locations identified in the award of contract staff report ahead
of contract timelines and within budget. There are no outstanding issues.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Accept the Mid-Block Crosswalk Barrier Removal project;
2. Do not accept the project;
3. Accept the project but do not authorize release of retention; or
4. Provide direction to staff.
ADVANTAGES:
The project is complete. Accepting the improvements will allow staff to close out the
project. Remaining funds in this project account will be returned to the Various Striping
and Sidewalks Improvements project fund balance. The project is consistent with the
Council goal to support City infrastructure.
DISADVANTAGES:
The disadvantage of accepting the improvements would be if subsequent deficiencies in
the work are identified. However, the contract documents include a one-year warranty
period for the contractor to address any construction defects that may arise.
ENVIRONMENTAL REVIEW:
The project is categorically exempt from California Environmental Quality Act (CEQA)
pursuant to CEQA Guidelines Section 15301(c) covering the repair and maintenance of
existing highways, streets and sidewalks.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted at City Hall and on the City’s website in accordance with
Government Code Section 54954.2.
