CC 2017-03-28_09k Accept 2016 Street Repairs MEMORANDUM TO: CITY COUNCIL FROM: GEOFF ENGLISH, PUBLIC WORKS DIRECTOR BY: JILL MCPEEK, CAPITAL IMPROVEMENT PROJECT MANAGER SUBJECT: CONSIDERATION OF ACCEPTANCE OF THE 2016 STREET REPAIRS PROJECT, PW 2016-03 DATE: MARCH 28, 2017 RECOMMENDATION: It is recommended the City Council: 1. Accept the project improvements as constructed by R. Burke Corporation in accordance with the plans and specifications for the 2016 Street Repairs Project; 2. Direct staff to file a Notice of Completion; and 3. Authorize release of retention, thirty-five (35) days after the Notice of Completion has been recorded, if no liens have been filed. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The FY 2016/17 Capital Improvement Program Budget includes $905,000 for the pavement management program. The contractor’s final construction cost is $686,432.21 which is within the project budget approved by Council at time of contract award and within the available pavement management program budget reserved for street repairs. The recommended action will not result in any impact on staff resources. BACKGROUND: On September 13, 2016, Council awarded a construction contract to perform the 2016 Street Repairs project to R. Burke Corporation in the amount of $673,798.00 and authorized the City Manager to approve change orders in the amount of $67,379.80. The project consisted of street surface repairs which involved the grinding and repaving of isolated pavement failures on several streets in preparation for the 2016 Street Resurfacing project. The project also included full width pavement overlays and the replacement of thirteen curb ramps for Americans with Disability Act (ADA) compliance on two streets, Oro Drive and Collado Corte, and an overlay of the Le Point Street parking lot. Item 9.k. - Page 1 CITY COUNCIL CONSIDERATION OF ACCEPTANCE OF THE 2016 STREET REPAIRS PROJECT, PW 2016-03 MARCH 28, 2017 PAGE 2 ANALYSIS OF ISSUES: The contractor has completed the work in accordance with the approved plans and specifications at the locations identified in the award of contract staff report within the contract time and within budget. There are no outstanding issues. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Accept the 2016 Street Repairs project; 2. Do not accept the project; 3. Accept the project but do not authorize release of retention; or 4. Provide direction to staff. ADVANTAGES: The project is complete. Accepting the improvements will allow staff to close out the project. The project is consistent with the Council goal to support City infrastructure. DISADVANTAGES: The disadvantage of accepting the improvements would be if subsequent deficiencies in the work are identified. However, the contract documents include a one-year warranty period for the contractor to address any construction defects that may arise. ENVIRONMENTAL REVIEW: The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline Section 15301(c) covering the repair and maintenance of existing highways and streets. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. Attachment: 1.
