WRRRRI\S, the City COuncil of the City of Arroyo Grande has considered a Variaree
application No. 87-113, filed by Leonlll'd Berry and Valerie Bennett, fOt' a Variaree from the
maximum ~ height of 15 feet at 1585 HillcIut Drive in the "K-1" S~le Family
Residential District; and
WHEREAS, the Cbuncil finds that the foUow~ circ\unstarK!es exist:
1. That the adjustment authorized shall oot constitute a grant of special privilege
iooonsistent with the limitations upon other properties in the vicinity and district
in which the subject property is situated.
2. That because of special circumstanc!es spplicllble to the subject property, includi~
siZe, shape, tOJ?<Waphy, location, Ot' ~, the strict application of the
provisions of this chapter Is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and under identical zone clBssifications.
. 3. That the gran~ of the Variaooe will not be contrary to the intent of this
chapter Ot' to the public safety, health and welfare.
4- That due to special conditions Ot' exceptional charflCteristics of the property or its
location, the strict application of the provisions of this chapter would result in
difficulties and UlUlE!Ce56III'Y hardWp.
5. The gran~ of the Variaree will oot be materiaUy detrimental to other
properties orland uses in the area because the views currently enjoyed by the
IiIII'I'OU/ldii properties will oot be aigniflcantly impacted by the propaied
development.
6. There are exceptional Ot' extraordinary circumstances applicable to the intended
use that do oot apply. to other properties in the same zone. The property has an \
extreme slope and is an oddly shIIped parcel.
7. The strict application of the OI.'<Iin8ooe deprives such property of privileges
enjoyed by other properties in the vicinity Ot' in the same zone because the 15-
foot restriction would limit the buildable potential of the lot due to the steep
slope and odd shape of the lot.
8. The gran~' of the. variance is compatible with the objectives, policies, and
general land uses specified In the General Plan because the intent of the urgency
OI.'<Iin8ooe is be~ met, as there is IlUbstantial protection of the viewsheds on
adjacent property, and the proposed development Is in confonnance with the goals,
policies and objectives of the Oeneral Plan.
NOW, 'mEREPORE, BE IT RBSOLVED that the aty Calncil of the City of Arroyo
Orande hereby approves said Variance subject to the standard conditions of the City end tlae
listed below:
1. The development of the site shall occur in substantial conformaree with the
planI approved by the aty OxInctt on January g)" 1988.
