CC 2017-06-13_09e MOA Regional Groundwater EIR otROyo INCORPORATED 92 * JULY 10, 1911y 14 FORD MEMORANDUM TO: CITY COUNCIL FROM: JIM BERGMAN, CITY MANAGER BY: TERESA MCCLISH, COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: CONSIDERATION OF A MEMORANDUM OF AGREEMENT BETWEEN CITY OF PISMO BEACH AND CITIES OF ARROYO GRANDE AND GROVER BEACH TO PROVIDE FUNDING FOR PRELIMINARY ENGINEERING WORK FOR REGIONAL GROUNDWATER SUSTAINABILITY PROJECT ENVIRONMENTAL IMPACT REPORT DATE: JUNE 13, 2017 RECOMMENDATION: It is recommended that the City Council approve and authorize the City Manager to sign the Memorandum of Agreement (MOA) for preliminary engineering work for the Regional Groundwater Sustainability Project (RGSP) Environmental Impact Report (EIR). IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The cost share for the City to support preliminary engineering work for the Regional Groundwater Sustainability Project (RGSP) EIR is $85,500 to be paid from the Water Availability fund. Additionally, staff resources will continue to be required for participation in the review of the Environmental Impact Report, modeling efforts, and development of a basin level response plan. Addressing water supply and increasing water security remains a top priority of the City as identified in the Critical Needs Action Plan and reiterated in the City Council's 2016 Goals. BACKGROUND: In 2014, the Council directed staff to pursue the following goals: y Meet the City's future projected water demand of its buildout population by: • Meeting the reduction in per capita use as prescribed in the Water Conservation Act of 2009; • Proceeding with work necessary to develop a recycled water project that can be used to prevent seawater intrusion in order to provide long- range protection of the City's groundwater supply; and y Ensure water use efficiency and drought protection through regional conjunctive use, storage and management of surface and groundwater supplies. Additionally, in 2014, the Council supported the NCMA Technical Group's Strategic Plan that provides a framework for identifying common water resource planning goals and Item 9.e. - Page 1 CITY COUNCIL CONSIDERATION OF A MOA BETWEEN CITY OF PISMO BEACH AND CITIES OF ARROYO GRANDE AND GROVER BEACH TO PROVIDE FUNDING FOR PRELIMINARY ENGINEERING WORK FOR REGIONAL GROUNDWATER SUSTAINABILITY PROJECT EIR JUNE 13, 2017 PAGE 2 objectives and to establish a 10-year work plan for implementation of those efforts, including pursuing recycled water options. In November 2014, the Regional Recycled Water Strategic Plan (RRWSP) was completed that was funded by a Round 2 Integrated Regional Water Management (IRWM) Regional Planning Grant from the California Department of Water Resources (DWR). According to the study, the South San Luis Obispo County Sanitation District (SSLOCSD) has the largest volume of effluent considered in the RRWSP and the largest opportunities for large-scale reuse. In May of 2015, an IRWM planning grant funded a groundwater basin characterization study of the Santa Maria Groundwater Basin. It provided a basis for future studies related to a Salt and Nutrient Management Plan and the development of a numerical groundwater model. Also in 2015 and 2016, two specific recycled water studies identified potential regional projects. The first was the City of Pismo Beach's Recycled Water Facilities Planning Study. The second was the SSLOCSD/City of Arroyo Grande grant funded Recycled Water Facilities Planning Study. These efforts have now merged into the RGSP. In January 2017, the Council adopted a Letter of Intent (LOI) as a first step to advance the RGSP and secure a commitment to continue to collaborate toward establishing a new, local, drought resistant, sustainable and highly purified water resource. ANALYSIS OF ISSUES: The RGSP will inject advanced treated recycled water into the Northern Cities Management Area (NCMA) of the Santa Maria Groundwater Basin (SMGB) to prevent groundwater contamination caused by seawater intrusion. Once implemented, the RGSP will significantly increase water supply reliability for the agencies that pump from the NCMA, including the Cities of Pismo Beach, Arroyo Grande and Grover Beach, and the Oceano Community Services District. The RGSP will be implemented in two phases, the first of which will include advanced treatment and injection of flows from the Pismo Beach wastewater treatment plant, and the second of which would include upgrades to the Advance Treatment Facility (ATF) to increase capacity and additional injection wells to allow increased injection and/or distribution to irrigation customers of flows from the District's wastewater treatment plant. An EIR is required prior to project approval in accordance with the California Environmental Quality Act. The City of Pismo Beach is the lead agency for the EIR, Item 9.e. - Page 2 CITY COUNCIL CONSIDERATION OF A MOA BETWEEN CITY OF PISMO BEACH AND CITIES OF ARROYO GRANDE AND GROVER BEACH TO PROVIDE FUNDING FOR PRELIMINARY ENGINEERING WORK FOR REGIONAL GROUNDWATER SUSTAINABILITY PROJECT EIR JUNE 13, 2017 PAGE 3 with the SSLOCSD and member agencies acting as responsible agencies. The EIR is fully funded equally by the City of Pismo Beach and the SSLOCSD. The cost of preliminary engineering and agricultural outreach activities associated with Phase 2 of the RGSP is proposed to be divided equally by Arroyo Grande and Grover Beach for a maximum not-to-exceed amount of $171,000. The EIR consultant selection has occurred in collaboration with all participating agencies and the City of Pismo Beach is anticipated to award a contract at their June 20, 2017 City Council meeting. ALTERNATIVES: The following alternatives are provided for the Council's consideration: 1. Approve and authorize the City Manager to sign the MOA; or 2. Provide staff other direction. ADVANTAGES: The MOA approves the necessary commitment of funds to support the preliminary engineering required for the RGSP EIR. DISADVANTAGES: The City's cost is $85,500 to fund the preliminary engineering work, however, the City will not be required to fund the necessary groundwater model work that was previously anticipated and budgeted. ENVIRONMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City's website in accordance with Government Code Section 54954.2. Item 9.e. - Page 3 MEMORANDUM OF AGREEMENT BETWEEN CITY OF PISMO BEACH AND CITIES OF ARROYO GRANDE AND GROVER BEACH TO PROVIDE FUNDING FOR PRELIMINARY ENGINEERING WORK FOR REGIONAL GROUNDWATER SUSTAINABILITY PROJECT ENVIRONMENTAL IMPACT REPORT This Memorandum of Agreement (Agreement or MOA) is entered into effect on between the City of Pismo Beach ("City") and the Cities of Arroyo Grande and Grover Beach ("Cities") (collectively referred to as the "Parties" and individually a "Party"). RECITALS WHEREAS, the Regional Groundwater Sustainability Project ("RGSP") is a collaborative water reuse project between the City, the South San Luis Obispo County Sanitation District ("District") and the District member agencies (i.e. City of Arroyo Grande, City of Grover Beach and the Oceano Community Services District), which is anticipated to include the phased implementation and construction of an Advanced Treatment Facility (ATF), conveyance infrastructure, and injection wells to protect against seawater intrusion in the Santa Maria Groundwater Basin and improve water supply reliability for the region; WHEREAS, the RGSP is envisioned to be implemented in two phases, the first of which will include advanced treatment and injection of flows from the Pismo Beach wastewater treatment plant, and the second of which would include upgrades to the ATF to increase capacity and additional injection wells to allow increased injection and/or distribution to irrigation customers of flows from the District's wastewater treatment plant; WHEREAS, the proposed scope of work for the RGSP is set forth on Exhibit "A", attached hereto and incorporated herein by reference; WHEREAS, the City will be leading the efforts to complete the program management, preliminary engineering and environmental impact review for the RGSP and will be the contracting entity for the services; WHEREAS, the District will be a co-equal with the City in the RGSP project concerning the environmental review process and the District will contribute co-equal funding for the environmental review; WHEREAS, the Cities will contribute funding for preliminary engineering work and agricultural outreach activities associated with the environmental review of Phase 2 of the RGSP review; and WHEREAS, nothing in this Memorandum of Agreement is intended to approve the RGSP project; instead, this agreement shall be read to require consideration of the environmental effects of the project, including but not limited to its potential rejection, as required by the California Environmental Quality Act. NOW, THEREFORE, for valuable consideration, receipt for which is hereby acknowledged, the Parties agree as follows: 1. The term of this Agreement shall begin on Item 9.e. - Page 4 2. The City will contract for environmental review services to prepare an Environmental Impact Report for the RGSP pursuant to its own contracting policies. The environmental review services shall be scoped to comply with the California Environmental Quality Act and other applicable law. City shall be designated as the lead agency for such environmental review. The Cities agree to pay for the cost of the preliminary engineering and agricultural outreach activities associated with Phase 2 of the RGSP to a maximum total of$171,000 divided equally by Arroyo Grande and Grover Beach. 3. The City will contract for program management and engineering services for the RGSP pursuant to its own contracting policies. 4. The City will contract for all other services necessary to complete the first phase of the RGSP pursuant to its own contracting policies. The City shall pay for such services, and the Cities shall not be required to pay for such services, other than as set forth in paragraph 2 and 3 above. 5. Except as set forth in this Agreement, each Party shall be responsible for the costs it incurs in the performance of the tasks contemplated by this Agreement. To the extent this Agreement calls for one Party to make payment to the other Party for expenses incurred in the RGSP, each Party agrees to submit payment for its cost share set forth in this Agreement within 30 calendar days of receipt of an invoice for such cost share from the other Party. 6. Either Party may withdraw from this Agreement for any reason or for no reason at all by giving the other Party at least thirty (30) calendar days' written notice thereof. The withdrawing Party shall be responsible for its allocated costs up to the date of its withdrawal. From the date of a Party's withdrawal or the date that the withdrawing Party pays all of its allocated costs, whichever is later, that Party shall no longer be bound by any term of this Agreement other than the indemnification and hold harmless provision. 7. Each Party shall assume the defense of, indemnify and hold harmless the other Party and each of its officials, officers, employees and agents from and against any and all actions, damages, liability or claims for death, injury, loss, damage or expense to persons or property arising from or related to the negligent or willfully wrongful acts or omissions of the indemnifying and defending Party in connection with performance of this Agreement, except to the extent such actions, damages, liabilities or claims have arisen from or relate to the negligent or willfully wrongful acts or omissions of the other Party. 8. Nothing in this Agreement is intended, nor may be construed, to create any rights, confer any benefits, or relieve any liability, of any kind whatsoever in any third person not party to this Agreement. 9. Waiver by a Party of any one or more of the conditions of performance under this Agreement shall not be a waiver of any other conditions of performance under this Agreement. In no event shall the making by any Party of any payment constitute or be construed as a waiver by that Party of any breach of covenant or any default that may then exist on the part of any other Party, and the making of any such payment by a Party shall in no way impair or prejudice any right or remedy available to that Party or any other Party with regard to such breach or default. Item 9.e. - Page 5 10. The Parties acknowledge that activities under this Agreement will require the frequent interaction between them in order to pursue opportunities and resolve issues that arise. The Parties shall work cooperatively and in good faith, with the goal of completing the RGSP in an expeditious and cost-effective manner. 11. As a condition precedent to a Party bringing any suit for breach of this Agreement, that Party must first notify the other party in writing of the nature of the purported breach and seek in good faith to resolve the dispute through negotiation. If the Parties cannot resolve the dispute through negotiation, they may agree to a mutually acceptable method of non- binding alternative dispute resolution with a qualified third party acceptable to both Parties. Each Party shall pay an equal share of any costs for the services provided by such a third party as such costs are incurred. The existence of a dispute shall not excuse the Parties from performance pursuant to this Agreement. 12. This Agreement, including any other documents incorporated herein by specific reference, constitutes the entire and integrated agreement of the Parties regarding the subject matter described herein. This Agreement supersedes all prior oral or written communications, negotiations, representations, agreements and promises. This Agreement may not be modified or amended, nor any provision or breach waived, except in a writing signed by all Parties which expressly refers to this Agreement. 13. No Party shall assign or transfer any interest in this Agreement or any part thereof, whether by assignment or novation, without every other Party's prior written consent. Any purported assignment without written consent shall be null, void, and of no effect. In the exercise of their respective rights and obligations under this Agreement, the Parties each act in an independent capacity, and neither is to be considered the officer, agent, or employee of the other. In the exercise of its rights and obligations under this Agreement, neither Party shall provide, without the consent of the other Party, any contractor with a release that waives or purports to waive any rights the other Party may have to seek relief or redress against that contractor either pursuant to any cause of action that the other Party may have or for violation of any law. 14. In the exercise of their respective rights and obligations under this Agreement, each Party shall comply with all applicable Federal and California laws and regulations applicable to the subject matter of the Agreement. The validity, interpretation, and performance of this Agreement shall be controlled by and construed under the laws of the State of California, excluding California's choice of law rules. Venue for any such action relating to the Agreement shall be in the San Luis Obispo County Superior Court. 15. Any person executing this Agreement on behalf of a Party warrants and represents that he or she has the authority to execute this Agreement on behalf of that Party and has the authority to bind that Party to the performance of its obligations hereunder. 16. This Agreement may be executed in one or more counterparts, each of which shall be deemed to be an original and all of which, when taken together, shall be deemed to be one and the same agreement. A signed copy of this Agreement transmitted by email or other means of electronic transmission shall be deemed to have the same legal effect as delivery of an original executed copy of this Agreement for all purposes. 17. Deliverable: Water Quality Sampling Plan 10.2 Mass Balance and Water Quality Analysis ➢ Modify the model of the advanced wastewater treatment processes to include the flow contribution from the SSLOCSD WWTP to estimate recovery rate, pollutant removal, finished water quality and brine quality. ➢ Characterize the planned secondary effluent that will be produced by the District WWTP following completion of the Redundancy Project for incorporation into the blending analysis (see Task 11.0). • Develop of a table of flows and pollutant loads, including TDS, nitrate, and chloride for both the Pismo Beach WWTP and District WWTP. ➢ Develop of a table of brine flows and pollutant loads for both the Pismo Beach WWTP and District WWTP. A list of pollutants will be developed based on the discharge limits in the Pismo Beach NPDES discharge permit. ➢ Identify the product water quality considering separate contributions for the Pismo Beach WWTP and District WWTP as well as the water quality for the combined product water. Item 9.e. - Page 11 10.3 Preliminary Flow Equalization Analysis ➢ Incorporate flows from the District WWTP into the equalization analysis to determine the amount of equalization volume necessary to maximize the product water capacity from the combined Pismo Beach WWTP and District WWTP flows. ➢ Estimate planning level costs of incorporating equalization.The analysis, discussion and decision will be documented in the 10% Design TM (Task Error! Reference source not found.). TASK 11.0 OUTFALL ANALYSIS 11.1 Outfall Analysis The purpose of this task is to identify any fatal flaws in the feasibility of using the existing ocean outfall line to discharge brine from the ATF and peak flows from the City and District's WWTPs. ➢ Blending Analysis (1) Provide information on brine quality from the treatment of the combined Pismo Beach WWTP and District WWTP. (2) Provide technical support for the mass balance/blending model development for the combined Pismo Beach WWTP and District WWTP. TASK 18.0 PHASE 2 OFFSITE PRELIMINARY ENGINEERING - 10% DESIGN 18.1 Infrastructure Alternatives Analysis ➢ Injection Well Sites (1) In coordination with the City,the District and NCMA Agencies, evaluate the conceptual well sites included in the RW Study, and select up to seven (7) recommended injection well sites. Evaluation criteria will include hydrogeologic performance, construction area requirements, length of pipeline required to reach the site, potable well setbacks, jurisdictional boundaries & requirements, availability of utilities, property ownership, and environmental impacts. (2) Based on the recommended injection well sites, recommend up to fourteen (14) monitoring well sites, including the use of existing monitoring wells where appropriate. Total number of monitoring wells required will be determined through negotiations with the Regional Board. (3) Provide a list of recommended sites to the Property Acquisition consultant (under separate contract)to initiate property and easement acquisition. ➢ Potable Production Well Sites Item 9.e. - Page 12 (4) In coordination with the City and NCMA Agencies, identify and evaluate up to three (3) sites for new production wells and select one (1) preferred site for a new production well. Evaluation criteria will include hydrogeologic performance, construction area requirements, length of pipeline required to reach the site, injection well setbacks, jurisdictional boundaries& requirements, availability of utilities, property ownership, and environmental impacts. ➢ Pipeline Alignment Alternatives (1) Based on the locations of the recommended injection well sites, identify a preferred alignment for the distribution piping from the existing WWTPs to the ATF and from the ATF to the injection wells. Considerations will include minimizing the length of pipeline, avoiding high traffic streets, and preference of local jurisdiction where the pipeline is located. (a) Prepare an alignment map in GIS. ➢ RW Storage Tank and Booster Station (1) It is anticipated that the RW storage tank and booster station will be located on the ATF site or alternative site. Evaluate four(4)tank and booster station location alternatives. Evaluation criteria will include proximity to RW effluent discharge location, conflict with existing utilities, compatibility with other existing or proposed site uses, grading requirements, Project Team preference, and environmental impacts. (2) In collaboration with the Project Team, select one preferred alternative for the RW storage tank and booster station. Deliverable:List of recommended injection well, monitoring well and potable well sites for property acquisition 18.2 Treatment Plant Upgrades—10%Design ➢ Design Criteria (1) Based on estimated effluent flows, effluent characteristics, modeling analysis of the advanced wastewater treatment processes, and regulatory requirements, develop preliminary design criteria for the MF, RO, and UV/ADP processes. The site layout will include major processes and ancillary support systems including a new administration building. (2) Identify any data gaps and approaches to obtain necessary data to refine the design criteria. ➢ Process Flow Diagram and Mass Balance Item 9.e. - Page 13 (1) Based on selected treatment processes and preliminary design criteria, develop a process flow diagram and a mass balance that includes the major processes and ancillary support systems such as chemical feed systems, membrane clean in place systems, pumps, meters, and sampling locations. (2) Identify any data gaps needed to complete/refine the process flow diagram. ➢ Site Plan (1) Based on selected treatment technologies and preliminary design criteria, develop preliminary process footprints and conceptual site layout. The site layout will include major processes and ancillary support systems. (2) Identify any fatal flaws in the feasibility of constructing the treatment processes at an offsite ATF site. ➢ Hydraulic Analysis and Profile (1) Develop a hydraulic profile for the advanced wastewater treatment facilities. The profile will tie into the existing hydraulic profile for the wastewater treatment plant. A hydraulic analysis will be performed to determine minimum and maximum pumping rates and pressures for pumping to and from the advanced wastewater treatment facilities. ➢ List of Major Equipment (1) Develop a list of major process and ancillary equipment. 18.3 Distributed Infrastructure—10% Design ➢ Prepare Conceptual Plans (1) Prepare conceptual site layout for each preferred injection well site. (2) Prepare conceptual site layout for each preferred production well site. (3) Prepare conceptual pipeline alignment plan depicting the preferred pipeline alignment, including new sections which are proposed to be installed using trenchless technology and sections of existing pipe which are proposed to be lined in place. (4) Prepare a conceptual site layout for the RW storage tank and booster station. 18.4 Cost Estimate ➢ Prepare an opinion of probable construction cost for the advanced wastewater treatment processes based on the information summarized in the conceptual design report. Cost opinion will be classified as a Class 4 Conceptual Opinion of Probable Construction Cost by AACE. 18.5 Schedule ➢ Prepare a preliminary schedule for the design and construction of Phase 2 of the RGSP. Item 9.e. - Page 14 18.6 10% Design TM ➢ Develop a Draft and Final 10% Design TM that summarizes the design criteria, alternatives analysis and selected alternatives,treatment process flow diagram, preliminary process sizing, hydraulic analysis and major equipment list, data gaps, recommended additional analyses, cost estimate, and schedule. TASK 19.0 PHASE 2 ONSITE PRELIMINARY ENGINEERING - 10% DESIGN To complete the Phase 2 Onsite Preliminary Engineering task WSC will leverage the common elements from the Task 18 Phase 2 Offsite Preliminary Engineering. 19.1 Infrastructure Alternatives Analysis ➢ Pipeline Alignment Alternatives (1) Based on the locations of the recommended injection well sites, identify a preferred alignment for the distribution piping from the WWTP to the injection wells. Considerations will include minimizing the length of pipeline, avoiding high traffic streets, and preference of local jurisdiction where the pipeline is located. (a) Prepare an alignment map in GIS (b) Prepare a conceptual cost opinion for the pipeline. Cost opinion will be classified as a Class 4 Conceptual Opinion of Probable Construction Cost as developed by the Association for the Advancement of Cost Engineering (AACE) Cost Estimate Classification System. 19.2 Treatment Plant Upgrades—10%Design ➢ Site Plan (1) Based on selected treatment technologies and preliminary design criteria, develop preliminary process footprints and conceptual site layout. ➢ Hydraulic Analysis and Profile (1) Develop a hydraulic profile for the advanced wastewater treatment facilities. The profile will tie into the existing hydraulic profile for the wastewater treatment plant. Cost opinion will be classified as a Class 4 Conceptual Opinion of Probable Construction Cost by AACE. 19.5 10% Design TM ➢ Develop a Draft and Final 10% Design TM that summarizes the design criteria, alternatives analysis and selected alternatives,treatment process flow diagram, preliminary process sizing, hydraulic analysis and major equipment list, data gaps, recommended additional analyses, cost estimate, and schedule. TASK 20.0 AGRICULTURAL OUTREACH 20.1 Agricultural Outreach ➢ Outreach to local agricultural growers to evaluate the interest in utilizing disinfected tertiary water for agriculture irrigation. ➢ Plan and facilitate meetings with agriculture representatives to inform them about the project, coordinate with related initiatives and develop strategies to allow them to engage. ➢ Because of the uncertainty related to the level of effort for this task, the budget is based on an allowance of 62 hours for the next 12 months.
