MARCH 13, 1973
The City Council met in regular session with Mayor Schlegel presiding. .Upon
roll call, Council Members Millis, Talley, Wood .and de Leon reported present,
PLEDGE OF ALLEGIANCE AND INVOCATION
Mayor Schlegel lead the Pledge of Allegiance to our Flag; and immediately
thereafter, Councilman Millis delivered the invocation.
APPROVAL OF MINUTES
The minutes of the regular meting of February 27, 1973, were approved as
prepared.
APPROVAL OF WA RANTS
On motion of Councilman de Leon, seconded by Councilman Talley and unanimously
carried, General Warrants No. 12026, No. 12029, No. 12030, and No. 12049 through
No. 12177, in the total amount of $6,523.57; and Payroll Warrants No. 4121, and
No. 5293 through No. 5370, in the total. amount of $19,573.14, were approved and
ordered paid.
RECEIFT OF CITY'S WINTER ISSiF OF NEWSLETTER.
The winter issue of the City's newsletter entitled "The City of ..Arroyo Grande
Reports"', was received by the Council. Administrator Butcb introduced Mike Hurtado,
the student intern from Cal. Poly who prepares the newslet~.~=~~:. Mike was commended by
the Council for his goad work on the newsletter.
TREASURER'S REPORT FOR THE MONTH OF FEBRUARY 1973
The Treasurer's Report for the month of February,. 1373, was received b}~ the
Council, reviewed .and ordered filed.
DEPARTMENTAL REPORT FOR THE MONTH OF FEBRUARY 1973
The Departmental Report for the month of Febr?.;~:~ 1973, was received by
the Council, reviewed and ordered filed.
Administrator Butch encouraged citizens to participate in the Police
Department's "Citizens on Patrol" program and also reminded them of the Police
Department's service of checking residents' houses while they are on vacation.
ORAL REPORT - RECENT CITY .SELECTION COMMITTEE MEETING - MAYOR SCHLEGEL
Mayor Schlegel reported orally on the March 8th meeting of the City-Selection
Committee, at which time the rules and procedures prepared for the selection of
future representatives to various organizations_ were amended.
ORDINANCE REPEALING ORD 77 C S - REZONING FROM RAB3 TO RGD FAIR .OAKS--1ST READ.
City Attorney Shipley read, for its first reading, the title of an ordinance
amending the Municipal Cade so as to repeal Arroyo Grande Ordinance No. 77 C.S.
relating to the rezoning of certain property in the City of-Arroyo Grande from
RA-B3 to R.G.-D; thereafter, a motion was made by Councilman Millis, seconded by
Ct~uncilman de Leon and unanimously carried, to dispense w~,~th'reading the balance
~f this ordinance.
APPOINTMENT OF CITIZENS' COMMITTEE - HELD OVER
Mayor Schlegel reported that the Council is not yet ready to make appoint-
ments to the Citizens' Committee, as the petition (opposing adoption of Ordinance
No. 77 C.S.) from which appointees will be selected, is still being circulated
among the Council for their suggested appointees. The Citizens' Committee will
work with the Planning Commission on the Land Use Element of the General Plan.
DISCUSSION RE .CITY REPRESENTATIVES TO SO COUNTY HUMAN RELATIONS COMMISSION
Administrator Butch reported that no recommendations for two City representa-
tives to the South County Human Relations. Commission are available-at this time due
to no volunteers as yet. Councilman Millis stated that it was preferred if member-
ship on the Commission does not include Councilmen or persons involved in the
formation of the Commission. Mayor Schlegel urged citizens to volunteer to serve
on this commission and also urged that additional applications to serve on the
various other City commissions be submitted to replenish the Reservoir of .Citizens
.list.

Nadine Silva, 115 Flora Road, asked qu~;stiozxs regarding the creek which
runs between the property under discussion for rezaz~i.ng and her pr~~perty, where-
upon Councilman de Leon made additional inquiries regarding the creek. Developer
Langford answered all questioi±s.
Cindy Silva, 102 Pearrr~oc*d, spoke against the ~aro~ .~ rezoning.
There being no further discussion for or against. +.~°:- rezoning, Mayor Schlegel
declared the hearing closed. After Council discussion, City Attornr~y Shipley read,
for its first reading, the title of acx ordinancl~ amending t~'ae M~znicipal Code sa as
to rezone .froze RA-B3 to R°G°D, certain property in tie '_ ~:;~ ref Arroyo Grande;
thereafter, a motion was made by Councilman Talley, :;. ,~#e~3, by Councilman de Leon

Administrator Butch reviewed that a recommendation had been received from.
the Parks and Recreation Commission to class the sc>utherly Si+ feet of Short Street
adjacent to the creek for park purposes, Upon being assured by Deputy City Clerk
Butch that all. requirements as provided by law had been complied with, Mayor Schlegel
declared the hearing opeLr and .all persons would now be heard.
Claude Moss, 143+ Newport Avenue, raised questions regarding the costs of
the park development. Administrator Butch replied that without the proposed
gazebo, the rough estimates run between $1800 to $2000.
There being na further discussion for or against the closure of a portion
of Short Street, Mayor Schlegel declared the hearing closed. Aftr~r Council
discussion, City Attorney Shipley read the title of a resolution to establish a
pedestrian ma11 along a portion of Short Strr~Et; thrreafter, a motion was made by
Councilman. Talley, seconded b`~ Councilman Millis and unanimously carried, to

D RECEIPT OF TENTATIVE PROGRESS SCHEDULE FOR SETnTER PROJECT
A tentative progress schedule for the construction o the Arroyo? Grande
Sewer Assessment District from the County Engineering Department and cc~r.~;ra.ctor
Salata-Zorn, was received by the Council and reviewed.
.PROGRESS REPORT - SOUTH SAN LUIS OBISPO COIJI3TY SANITATION DISTRICT
The Chief Plant Operator's Monthly Report for February, 1973, regarding the.
South San .Luis Obispo County Sanitation Districts was received by the Council,
reviewed and ordered filed.
Administrator Butch reported that due to the rough seas, it has not been
possible as yet to fix the broken ocean outfall Iine~ but assured that the
discharge from the broken point in the line was well chlorinated.
PROGRESS REFORT RE. FLOOD DAMAGE CLAIM & CORRECTIQN OF TAF__':Fa' 1T0 ROAD PROBLEM
Administrator Butch reported that a call .was rece:~. from the Corps of
Engineers regarding the City's request to them for :aid in correcting the flooding
problem occurring in the Tally Ho Road.area,-their reply indicating they will
investigate the matter further. He also indicated that the Director of Public
Works received word from the State Office of Emergency Preparedness regarding
the City's claim for flood .damages, and that there is a pcsssibility that the City
might receive approximately fi100,000 in disaster funds for a project to correct
the Ta11y Ho Road flooding problems. The project w~~ :~~:~~.~olve clearing a more
than mile long channel from Arroyo Grande Creek to i` .~st city limits and would
have to be done within 90 days because of the emerg~.r~~;~., status of the project. As
the ground in the proposed project area is still tc~o soggy to be worked, it is hoped
that the time limit will be waived, if the funds are granted for the project.
NOTICE RE. MEETING TO DISCUSS FOOTPATHS IN PISMO STATE_BEACH AREA
Administrator Butch reviewed a letter received fram the State Department
of Parks .and Recreation, notifying the City that an advisory group of the
Department, the California Recreational Trails Committee, will be holding meetings
in San Luis Obispo on March 15th - 16th, 1973, to discuss with interested citizens
in the County their views regarding the need .for footpaths and bikeways in and
adjacent to the Pismo State Beach as well as other proposals for trails in other
parts of the County.
MAYOR'S COMMENTS RE. LATEST STATE ACTION IN_ BANNING DOGS FROM BEACHES
Mayor Schlegel commented on the most recent action by the State Department
of Parks and Recreation in banning dogs from the South County beaches, which
action was taken without any local voice on the matter to which he strongly
objected.
