APPROVE PROGRESS PAYMENT N0. 2(FTNAL) RE. CONCRETE .IMPROVEMENTS - FOREMAS'T~R
A motion was made by Councilman de I~eon, seconded by Councilanan Spi~rling
and unanimously carried, approving Progress Payment No..2(Fina~.j in the amount of
$5,442,01 (excluding the 10% of total proj~ct costs'being retained in the-amount
of $2,062.14) to Jahn E, Foremas~er for construction of cazrbs, gutters, s'id.ec~ialks,
driveways and cross gutters at various locations in the City, p~r Contract
No. 90-74-6.
REFER PROPOSED SEWER ABANDONMENT IN TRACT 531 AREA_TO:PI~ANNING COMMTSSION
Administrator Butch explained: tha.t in proceeding with tr~ x~quested
abandonment of an inactive sewer easement in.I,ot 108 of the Ran~ho Corral de
Piedra, in conjunction with development of Tract 531, the matter h..a.d bypassed
the Planning Commission.. The I'lanning Comunission's next regular meeting is
Apri1 15th, at which time t~ia~ Commission will review tHe mat~er ancl make its
recommendations to the Council, and if favorable, the public hearing se~ by the
Council for Apri1 22, 1975, will proceed as scheduled. After Ca~ncil discussion,
a motion was made by Councilman Spierling, seconded by Councilman de Leon and
unanimously carried, the request to abandon an inactive sewer easement in the
area of Tract 531 was referred to _the Planning Conanission.
ADJOURNMENT
On motion of C~~ncilman de Leon, seconded by Councilman Spierling and
unanimously carried, the meeting adjourned at 9:05 P.M. until 7:30 P,M. on
M,~nday, April 14, 1975 for a joint session with the Downtown Parking and
Improvement Advisory Board.

The Cmuncil xnet in special session with Mayor Ta11ey presiding. Upon roll
call, Council Members Spierling, de Leon, Schlegel and Millis reported present.
DISCUSSION RE. PROPOSED CITY SEMINAR ON MAY 3, 1975
Pursuant to a lawsuit having been filed by several area newspapers and
reporters against the City on Friday, Apri1 11, 1975, Mayor Talley had called
this special meeting to discuss the praposed City semi.n~r to be held on
Sa~urday, Ma.y 3, 1975. The major complaint of the suit is the proposed Los Alamos
location of the s~mina.r and costs of same.
The Council reviewed a report prepared by Administrator B~utch, which
suggested the meeting be held at the San Luis Bay Inn in Avila Beach, which
appears to be the anly facility in the County to be able to accommodate the type
of ineetings proposed for this seminar. Rental of space would cost $10.00 and
luncheons available fram $1.80 to $4.50.
Ma.yor Talley read a prepared statement regardi.ng the meeting, and intent
of same, encouraging the Council to pursue it and offering citizens transporta-
tion and cost of the seminar if these items are obstacles to their attendance.
He requested comments from the Council. Councilmen Schlegel, Spierling and
de Leon supported the Mayor's position.
Councilman Millis read a prepared statement, indicating his support of
the concept of the seminar, but feeling the meeting should be located ~urithin th.e
City, which he wo~nld then attend. ,
In respons~ to Ma.yor Talley's inquiry, City Attorney Shipsey stated ~ehat
the Courts would decide if the meeting as proposed is possible, He further
advised the Council of Section 2-1.102 of the Arroyo Grande Municipal Code
regarding meetings held outside of the Council Chambers.

After Council discussion, a motion raas made by Councilman Schl~gel,
seconded by Councilman de Leon and on the following ro11 ca11 vote, to wit:
AYES: Councilmen Spierling, de I~eon, 5chlegel and Mayor Talley
NOES: Councilman,Millis
ABSENT; None .
the motion that the proposed City seminar be held at the San Luis Bay Inn on
May 3, 1975, providing that the Court does not disallow the meeting, saas carried
by a 4/5th majority vote. In addition, the Council indicated that reservations
wi11 be taken at City Hall for anyone wishing to attend said m~~~~.ng.
ADJOURNMENT
On motion of Councilman de Leon, seconded by Cat~ncilman Spierling and
unanimously carried, the meeting adjourned at 7:40 P.M. to a joint meeting with
the Downtown Parking & Improvement Advisory Board immediately following
adjournment of this special session.
