AN ORDINANCE OF THE CITY OF ARROYO GRANDE ADDING SECTION 4-3.20 TO THE MUNICIPAL CODE CONCERNING CITY REMOVAL OF ILLEGALLY PARKED VEHICLES THE CITY COUNCIL OF THE 'CITY OF ARROYO GRANDE DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Section 4-3.20 is hereby added to the Municipal Code reading in full as follows: "Sec. 4-3.20. City Removal of Illegally Parked Vehicles. Any regularly employed and salaried officer or designated employee of the police department of this city may remove or cause to be removed: (a) Any vehicle that has been parked or left standing upon a street or highway for seventy-two (72) or more consecutive hours. For purposes of this subsection, the mere moving or relocation of a vehicle for a short distance shall not suffice to interrupt the 72 hour period, or to constitute the beginning of a new 72 hour period. Proof that the vehicle was moved less than 500 feet in a normal traffic lane at any given time shall constitute prima facie evidence that the 72 hour period was not interrupted or terminated. The provisions of this subsection are to be interpreted and enforced consistent with a pUblic policy against long term storage of vehicles upon public streets. A copy of this subsection shall be included as a part of any notice or citation placed on a vehicle concerning the 72 hour parking limit. (b) Any vehicle which is parked or left standing upon a street or highway when such parking or standing is prohibited by ordinance or resolution of this city and signs are posted giving notice of such removal. (c) Any vehicle which is parked or left standing upon a street or highway where the use of such street or highway or a portion thereof is necessary for the cleaning, repair or construction of the street or highway for the installation of underground utilities or where the use of the street or highway or any portion thereof is authorized for a purpose other than the normal flow of traffic or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size and the parking of such vehicles would prohibit or interfere with such use of movement; provided that signs giving notice that such vehicle may be removed are erected or placed at least twenty-four (24) hours prior to the removal. (d) Any vehicle which is blocking designated fire lanes or alleys where parking is prohibited." SECTION 2: This ordinance shall be in full force and effect thirty (30) days after its passage; and within fifteen (15) days after its passage, it shall be published once, together with the names of the city Council Members voting thereon, in a newspaper of general circulation within the city.
