APPROVAL OF WARRANTS On motion of Councilman Schlegel, s~conded by Counailznan Spa.erling and unanimously carried, General Warrants No, 5322 through No~ 5422, in the total amount af $24,228.89; and Payroll Warrants Noa 726~ throu~~ No. 7356, in the total amount of $34,~48.19, were approved and ordered p~~d, CONDITIONED APPROVAL OF REQUEST FOR FENCTNG PORT~ON O~ WZI,HOT~M LANE - WRIGHT The Council read a letter from Joseph Wright, Route 2, Box 630 B, Arroyo Grande (Lot 7 of Tract 541), request~ng he be authori;zed to fence and maintain an unpaved portion of Wilholm Lane, to deny public aecess of motor- bikes, trucks, etc, on this area until it is needed for a public road. City Engineer Garcia indicated the subject area on a map and review~d with the Council his memo of September 10th outlining his and Director of Public Wqrks Anderson`s review of the matter and recommendations. Mr, and Mrs. W~ight were present and restated the nuisance and possible hazards created by motorcye~es using this access as a recreational area. The portion of Wilholm Lane in question will be used eventually to connect the third unit of Terra de O~o with Corbett Canyon Road, when the third unit is bu~lt. The Council discussed ~he matter, generally agreeing ~hat the City would put up the fence w~th a prominent m~ke~ °te~ a,nda,cate its pl,acement. After fu~ther Council discussion, a motion was m~de by Councilman Gal~~.gher, seconded bv Councilman Millis and unanimously carried, ~hat the Cit~ erect a fence, and properlq mark said fence, on a port~on of Wi~holm Lane running through I~ot 7 of Tract 541, until such t~.me as ~his portion of G3ilholm Lan~ is required by tY~e City. Councilman Gallagher then amended his motic~n, which wa~ seconded by Councilman Spierling, accepted by Councilman Millis and unan~mously carried, that the adjacent property owners of the subject portion of Wilholm Lane to be tenced, be contacted and if they have no objection to the for~gaing motion, that the City proceed with the fencing wi~hout further Council action. R~VIEW OF INFO. ON PROPOSED PROPOSITION 2- P~11RK BOND ACT 8F 1976 The Council reviewed information ~rom the California Park and Recreatian Society, Inc. endorsing Proposition 2 on the November 2, 1976 ballot, entitled the "Coastal and Park Bond Act of 1976"e Administx~ator Butch stated ~here is indication that the County and Cities within it would be eligible for approx~- mately $519,000 of the p~roposed bond issue, No Council act~~n was taken. REQIJEST FOR REMOVAIr OF PEDESTRIAN CROSSING SIGN ON SO. ELM - FURTHER STUDY The Council ~°ead a letter from Mr. and Mrs. Kenneth Qwen, 641 So. E1m Street, requesting removal of a Pedestrian Crossing sign in the middle of the sidewalk at 641 So. Elm, contending it is unattractive as well as hazardaus to those using the sidewalk. The Council reviewed a report on the matter from City Engineer Garcia, as well as photographs taken of the subject sign and its placement. It was pointed out ~hat these signs are placed aceording to State Code standards. Council discussion was held, with a suggestion made for the sign to be cantilevered. After further Council discussion, the City staff was directed to explore all possibilities for the subject sign and come bacl~ ta the Council with its recom2nendations. PUBLIC HEARING - IMPROVEMENTS ON DEL SOL - ASSES~MENT DTSTRTCT TO PROCEED Administrator Butch advised that a public hearing had been set,by the Public Works Department, as previously directed by the Council, for the forma- tion of an Improvement District under the 1911 Act, Shart ~o~°m, fo~r the instal.- lation of concrete curbs, gutters, driveway apron5 ~nd sidewalks can Del Sol Street. The matter had been inadvertently left off tonight's agenda, but property owneXS involved in the district had been notifisd af the hearing and are present. After Council discussion, a motion was made by Councilman Gallagher, ?2~ CITY COUNCIL SEPTEMBER 14, 1976 ARROYO GRANDE, CALIFORNIA PAGE 2 seconded by Counci].man Schlegel and unanimously car~~.ed, that the public heasi,ng, as noticed to property owners on the "Notice to Cor~struct", be added to the agenda and proceed at this time. Director of Public Works Anderson rev~.ewed the background of this mat~~r, as outlined in the Council's August 10, 1976 mi,nutes. Mayor de Leon then declared the public heaxing open and all persons would now be heard for or against the installation of concrete improvements on Del Sol Street. Mike F~sher, 641 Del Sol, spoke in favor of the matter. No one spoke in oppasition ~o the improvements. There being no further public comment, Mayor de Leon declared the hearing closed. After Council discu.ssion, a motion was made by Councilman Gall.agher, seconded by Councilman Spierling and unanimously ca~ried, to go ahead with the proceedings under the Improvement Act of 1911, Short ~°orm, for the ~ installation of concrete curbs, gutters, driveway aprons and sidewalks on Del Sol Street. FEDERAL GOV'T LQC.~L PUBLIC WORKS CAPITAL ~EVELOPo PROGRAM City Engineer Gax°cia reviewed with the Council hi5 report regarding project funding possible under the Public Works Employment Act of 1976. Under the Act, 25U million dollars has been allocated to the State of California, for use by public agencies in completing unbudgeted projects for which unemploysd persons can be hized. He listed several projects for rahich application might be considered for grant monies under this program. He recommended applying fo~ three of the suggested projects, with the Council to set priorities and City s~af~ will then work out the costs, etc. for each application. After Council discus- sion, general consensus was that discretian of which projects to apply for be left up to City Staff when they get into filling out the applications. Projects suggested were as follows: Remodel of City Hall and constructian of the first phase of the Civic Center Master Plan; Completion of the Fair 0aks area storm drains (i.e. Grand Ave., Sunset Drainage System); Installation of major water transmiss~on lines pe~ water master plan and construction of a million gallon reservoir at Reservoir #1 site; Replace settled curb, gutter, and sidewalks in older portions of Arroyo Grande; Install a~ million gallon reservoir and required piping at high level location.(perhaps 2 locations); and Improvernent of Strother Park. 223 CITY COUNCIL SEPTEMBER 14, 1976 ARROYO GRANDE, CALIFORNIA PAGE 3 AUTHOR:IZE OPENING OF LEASE-PURCHASE F'OR MA~ON ST. PROP~R~Y 50UTH OF CITY HALL Administrator Butch reviewed that the Council had previously received a sale quote on property at 126 South Mason Street, vr~th said offer to expire October 1, 1976. The Citizens Advisory Gommittee on a Civic Center Needs' Study had recommended purchase of said property by the City for future parking expansion in conjunction with the remodeling of the Civic Centez°. After Council discussion, a motion was made by Counailman Spierling, seconded by Councilman Gallagher and carried, authorizing City staff to open excrow for a lease-purchase agreement for property at 126 South Mason Street. REVIEW OF REPORT RE. AMENDMENTS OF E~EES FOR REZONINGS, USE PERMITS, ETC. Administrator Butch reviewed with the Council his s°eport dated September 1, 1976, regarding zoning ordinance procedures and the cost to both the City and the petitioner. He recommended that changes be made to the City's present fees to increase the cha.rges for rezonings, use permit fees, variances and appeals to better cover the City's costs for these procedures (postage, publication costs, etc.). The report included a comparison of what other cities charge for these procedures. After Council discussion, City Attorney Shipsey ~ was directed to prepare an ordinance to amend the City's present fees as per the recommendation, as follows: Rezonings -$125, plus an additional deposit of $125 to cover ordinance publication aosts, with the balance of the $125 deposit not expended to be refunded ~o the applicant; Use Permits -$:50.00; Variances -$75.U0; and $50.00 for appeals on any of the foregoing. Discussion was also held on costs of Planned Developments, such as the one just completed - Oak Park Acres - in which much staff time was expended. The City staff was directed to study this matter and come back to the Council with its recom~r?endations for charges on future Planned Developments. REVIEW OF INFORMATION FROM LEAGUE OF CALIFORNIA CITIES The Gbuncil reviewed various pieces of information from the League of California Cities. One item was notice of a session set in Los Angeles on September 22, 1976, which wa.ll be a briefing i.n implementation of new legislation. The City Administrator was authorized to attend said meeting. Administrator Butch also advised that the Council needs to appoint a voting delegate for the annual League meeting in San Diego from October 17 thru 20, 1976. After Council discussion, a motion was made by Councilman Millis, seconded by Counc~lman Spierling and unanimously carried, designating Mayor de Leon as the City's Voting Delegate at the upcoming League Conference, and Councilman Gallagher as al~ernate. REVIEW OF SURVEY RE. PROPOSED TRANSIT PLAN IN SOUTH COUNTY Councilman Spierling reviewed with the Council a letter from Transit Manager Nickelson, addressed to Dave Systems, Inc., solici~inq a management and operating financial bid from that firm, for a proposed Five Cities Transit System. Also reviewed was a sur~vey made in Shell Beach, Pisma Beach, Arroyo Grande, Grover City and Oceano, of 1525 persons, asking whether they would use a transit system and for what purposes. The overall results showed that in the South County, 86~ of the people questioned ind~cated they would use the system about 1 or 2 times per week, mostly for shopping, and desired ~.he frequency of buses to be every 1 or 2 hours. REPORT - RECENT ANIMAL CONTROL MEETING The Council reviewed a report from Police Chi~f Clark rega~°ding the August 26th Animal Control meeting. Candidates for the posi°tion of Animal Control Supervisors were interviewed, with the Committe~ ~ecommending that a Mr. Robert Dollahite be hired for the position. He raas employed by Marin County and has extensive experience in ~his field. RESOLUTTON ADOPTION - REQUEST AUTHORTZATtON TO CLOSE BRP,NCH F°OR PARADE:-10/2/76 Administrator Butch reported that the Department of Transportation requires a resolutian from the Council, requesting permi.ssion to close a portion of Branch Street Calso known as State Highway 227) during the morning hours of Saturday, October 2, 1976 for the annual Harvest E"estival Par~ade. After Council discussion, a motion was made by Councilman Gallagher, seconded by Councilman Spierling and unani- mously carried, approving the placement of a bike rack on Bridge Street adjacent to the ice cream factory. REPORT RE. PLACEMENT OF ADDITIONAL BENCHES IN C~I~ITRAL ~USINESS DISTRICT The Council reviewed a repart from Planning Director Gallop, advising that the Parking & Business Improvement Area Advisory Board has authorized the purchase of three benches without backs and one bench with a back for placement in the Central Business Distriet, with costs not to exceed $150.00 and to be built by the high school students. RESOLUTION ADOPTION - FINDING LT. YOUNG'S DISABILITY AS INDiJSTRIAL Administrator Butch reported that Police Lieutenant James Young has applied for disability retirement from the City as the result of a back inaury, effective October 1, 1976. The Public Employees Retirement System now reqireg that the City Cauncil, by resolution, ma.ke a finding ~hat said disability i.s industrial. After Council discussion, City Attorney Shipsey read the title o~ a resolution finding Lt. Young's disability as indus~trial; thereafter, a mo~ion was made by Councilm~.n Schlegel, seconded by Councilman Gallagher and unani- mously carried, to dispense with reading the balance of this resolution. A standard island in the middle of the street has been budge~~d ($2,800), but after approximately ten variations were presented, the present curvilinear street was selected instead of the island median. Costs for this new pxoposal are $2,152 for construction and approximately $2p0 for landscapingm The Council discussed the redesign, stating concern over the loss of 6 parking spaces. Peggy Porter, speaking for the Downtown Parking Advisory Board, stated this had been discussed, but not considered a negative factor in view o~ the additional parkir~g area being acquired in ~he alley south of Branch StreQt. After Council discussion, a motion was made by Councilman Gallagher, seconded by Councilman Millis and unanimously carried, approving the redesign of Short Street as presented and approving the reconstruction project.
